The present petition fiied ‘ ehallen .exeicutioni’
\nproceedings. The presentp_.pe’titioner  ail tenant in<\/p>\n
respect of certain pre”rnises–_t__ v5Tlvie.”‘I”espondent having filed<\/p>\n
a suithliorivposs.e.ssio’r;..:_’and.’lWejectn’1ent, the same was
\ndecreed: ” The._pejtitio~ne’1~.had however challenged it by<\/p>\n
wa).\u00ab’*of a i’egt1’1a3* appeal which was dismissed for non\u00ab<\/p>\n
  ‘I’helWrespondent had, subsequent to the<\/p>\n
 of-v.the appeal, taken out execution of the<\/p>\n
jti”c1.gen_’ie11t.i”‘ and decree of the trial Court and a delivery<\/p>\n
 Awarrant was issued. In the meanwhile, the petitioner<\/p>\n
 preferred an application seeking restoration of the<\/p>\n
it “appeal and had also fiied an application for stay of<\/p>\n

execution. The same not having been Considered had
\npreferred the present petition seeking stay of exeeutlon<\/p>\n
of the delivery warrant.\n<\/p>\n
2. It transpires that deiiverywwarrafnt <\/p>\n
on 13.11.2009. On the very   <\/p>\n
granted a stay of the saidlfexecuftion deiivery’<\/p>\n
warrant. This Courtr”h_ad  int.e’1″irh order of
\nstay for a period of eight ‘~day’s;:’  coming on for<\/p>\n
hearing on  was stated by the<\/p>\n
Counsel forfjhe respyondent. that possession has been
\ntaken o’f_the  there was no order of stay<\/p>\n

Thhopwevermfwould submit that on 13.11.2009.<\/p>\n

it “since there was a communication gap in intimatirig the<\/p>\n

order, the warrant is said to have been executed. The
\nCounsel therefore sought time to ascertain the position
\nas on 08.12.2009 and the matter was adjournertto this<\/p>\n
day.\n<\/p>\n
3. It is now intimated that it is <\/p>\n

placed  entlitlved for such an order of
\nrestitution._  for the petitioner pleads<\/p>\n
heljplessnelssr ‘Howevevr, he would submit that there is a<\/p>\n
  appeal  and that he be permitted to take<\/p>\n
 the premises. till such time that the<\/p>\n
appeal ‘is:’disposed of. This is not acceptable. In any<\/p>\n
