Nurul Hoda<br \/>\n                 For the Respondent\/s      : Mr. Raghib Ahsan(Asst.SG)<br \/>\n                 =============================================<\/p>\n<p>2   16-09-2011            Learned counsel for the petitioner and learned<\/p>\n<p>                 Assistant Solicitor General for the respondent Union and its<\/p>\n<p>                 official are present.\n<\/p>\n<p>                          Learned counsel for the petitioner seeks permission<\/p>\n<p>                 of this Court to delete the averments made in paragraph No.<\/p>\n<p>                 14 of the writ petition.\n<\/p>\n<p>                          Permission is accorded.\n<\/p>\n<p>                          Let the petitioner score off paragraph in its entirety in<\/p>\n<p>                 course of the day.\n<\/p>\n<p>                          The grievance of the petitioner can be seen from<\/p>\n<p>                 averments made in paragraph Nos. 10 and 11 which read as<\/p>\n<p>                 under:\n<\/p>\n<blockquote><p>                          &#8220;10. That, in pursuance his aforesaid application<br \/>\n                          petitioner was called vide letter dated 11.5.2011<br \/>\n                          issued by Respondent No. 3 for re-medical<br \/>\n                          examination on 25.05.2011 at the Composite<br \/>\n                          Hospital    CRPF,     Muzaffarpur,     Bihar   on<br \/>\n                          25.05.2011 with all the requisites and Medical<br \/>\n                          certificates and accordingly the petitioner<br \/>\n                          appeared on the aforesaid date at the aforesaid<br \/>\n                         venue, but as a matter of fact nothing was done,<br \/>\n                        no response was taken and verbally he was told<br \/>\n                        that he is medically unfit, but, no any document<br \/>\n                        to the aforesaid effect was given to the petitioner<br \/>\n                        and the petitioner was returned empty handed.\n<\/p><\/blockquote>\n<blockquote><p>                        11. That thereafter, became highly perturbed<br \/>\n                        and gave a representation to respondent No. 3<br \/>\n                        on 25.05.2011 stating therein the aforesaid fact<br \/>\n                        that as to how nothing was done by the Review<br \/>\n                        Medical Board and he requested for doing his<br \/>\n                        Medical Test again so that he may get justice<br \/>\n                        and may be able to serve the nation.&#8221;<\/p><\/blockquote>\n<p>                        Learned counsel for the petitioner states that in the<\/p>\n<p>                 facts akin to the present case, this Court disposed of one<\/p>\n<p>                 writ petition being C.W.J.C. No. 12642 of 2011 by order<\/p>\n<p>                 dated 4.8.2011. The said order is part of Annexure-6 series.<\/p>\n<p>                 It is contended that the present application may also be<\/p>\n<p>                 disposed of in the aforesaid terms.<\/p>\n<p>                        Learned counsel for the respondent Union prays for<\/p>\n<p>                 and is granted four weeks&#8217; time to take instruction and file<\/p>\n<p>                 counter affidavit, if any.\n<\/p>\n<p>                          Post this matter after six weeks as last zero item. It<\/p>\n<p>                 is made clear that if no counter affidavit is filed, this Court<\/p>\n<p>                 shall proceed to dispose of the writ petition considering the<\/p>\n<p>                 averments made therein and the stand taken by the<\/p>\n<p>                 petitioner.\n<\/p>\n<\/p>\n<p>                                      (Kishore K.
