Sharma\nRespondent:         Dy. Commissioner of Police (East)\n\n\nFACTS<\/pre>\n<p>      By an application of 1-3-07 Shri S.C. Sharma, Advocate of Patiala<br \/>\nHouse Court, New Delhi applied to the Commissioner of Police, Police Hqrs.<br \/>\nseeking the following information:\n<\/p>\n<blockquote><p>      &#8220;A.    What is the present status of the complaint against the<br \/>\n             SHO, Krishna Nagar, and the Superdar Shri Harbans<br \/>\n             Mehta and whether this matter has been closed and if so<br \/>\n             what is the outcome of the enquiry.\n<\/p><\/blockquote>\n<blockquote><p>      B.     That this matter is also pending in the court of M. M. Dr.<br \/>\n             Archna Sinha, Karkardooma Court and the summons<br \/>\n             were issued against the Superdar, Harbans Mehta<br \/>\n             through SHO, Krishna Nagar, by M.M. for the last two<br \/>\n             years, however SHO Krishna Nagar has failed to produce<br \/>\n             the Superdar, Harbans Mehta as the &#8220;Summons Cells&#8221;<br \/>\n             failed to sent the summons to SHO Krishna Nagar.<br \/>\n             These Summonses were sent by the Naib Court attached<br \/>\n             to the court of Dr. Archna Sinha, M. M. Karkardooma<br \/>\n             Court.\n<\/p><\/blockquote>\n<blockquote><p>      C.     Whether it is a fact that this matter was widely reported in<br \/>\n             various newspapers particularly in Times of India East<br \/>\n             Delhi Plus dated 28.8.2001, Copy enclosed as Annexure-<br \/>\n             E and if so what is the status of investigation in this<br \/>\n             matter by the Vigilance Department.\n<\/p><\/blockquote>\n<blockquote><p>      D.     What is the procedure for sending summons through<br \/>\n             &#8220;Summons Cell&#8221; of Delhi Police, in East Delhi and<br \/>\n             whether any enquiry has been conducted as to how the<br \/>\n             summons could not be served on the Superdar through<br \/>\n             SHO Krishna Nagar, through Summons Cell?&#8221;<\/p><\/blockquote>\n<p>      To this he received a response from DCP (East) on 13-4-2007, who<br \/>\nreceived the application on 15-3-07, as follows:-\n<\/p>\n<blockquote><p>      &#8220;B.    The case FIR No. 235\/95 u\/s 379\/304A IPC, PS Krishna<br \/>\n             Nagar is pending trial in the court of Smt. Dr. Archana<br \/>\n             Singh, MM, Karkardooma Courts. During the last two<br \/>\n             years from 25.10.04 to 12.12.06, five Summons\/ Bailable<\/p>\n<p><span class=\"hidden_text\">                                       1<\/span><br \/>\n               Warrants have been issued from the concerned court<br \/>\n              against Harbans Lal Mehta (Superdar) and other public<br \/>\n              witnesses. The detail of summons\/ bailable warrants is as<br \/>\n              under:-\n<\/p><\/blockquote>\n<blockquote><p>              (i)   For 18.2.05 summon was issued to execute<br \/>\n                    through IO and was not served as the IO HC<br \/>\n                    Swarn Singh has died.<\/p><\/blockquote>\n<pre>\n\n              (ii)    For 4.06.058 summon was issued to execute\n                      through SHO.        The same was sent to PS\n<\/pre>\n<blockquote><p>                      Shakarpur as the address of the superdar falls in<br \/>\n                      the jurisdiction of PS Shakarpur and was not got<br \/>\n                      served, as the address given as incorrect.\n<\/p><\/blockquote>\n<blockquote><p>              (iii)   For 12.8.05 bailable warrant was issued to execute<br \/>\n                      through IO and was not got served due to incorrect<br \/>\n                      address.\n<\/p><\/blockquote>\n<blockquote><p>              (iv)    For 14.12.05 Summon was issued to execute<br \/>\n                      through summon cell but was not got served due<br \/>\n                      to incorrect address.\n<\/p><\/blockquote>\n<blockquote><p>              (v)     For 8.5.06 summon was issued to execute through<br \/>\n                      summon cell but was not got served due to<br \/>\n                      incorrect address.\n<\/p><\/blockquote>\n<blockquote><p>              (vi)    For 16.5.07 Summon was issued to execute<br \/>\n                      through SHO but has not been served due to<br \/>\n                      incorrect address.\n<\/p><\/blockquote>\n<blockquote><p>       Further, SHO\/ Krishna Nagar has not received any summon to<br \/>\n       get it served on Harbans Lal Mehta.\n<\/p><\/blockquote>\n<blockquote><p>       D.     The summonses received in the Summons Cell\/ East<br \/>\n              Distt are marked to process Servers. The Process<br \/>\n              Server then gets it executed and gives his report thereon<br \/>\n              which is then sent to the concerned court. The summons<br \/>\n              that are marked to SHO are executed by the concerned<br \/>\n              SHO himself.&#8221;<\/p><\/blockquote>\n<p>       Not satisfied with this response, however, Shri S.C. Sharma moved his<br \/>\nfirst appeal 3-5-07 with the following plea:\n<\/p>\n<blockquote><p>       &#8220;Incomplete and misleading and the complete information has<br \/>\n       not been furnished in respect of action taken against SHO,<br \/>\n       Krishna Nagar for release of uninsured vehicle involved in the<br \/>\n       fatal accident.&#8221;<\/p><\/blockquote>\n<p>       He also contended that no information has been supplied in respect of<br \/>\nletter sent by Addl. Session Judge to DCP (East). This appeal was examined<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><br \/>\n by Shri Alok Kumar Verma, Jt. Commissioner of Police, New Delhi Range<br \/>\nwho came to the following conclusion:\n<\/p>\n<blockquote><p>      &#8220;Having examined the material available on file, it is found that<br \/>\n      the PIO\/ East District vide letter No. 1465\/ Info. Cell\/ East<br \/>\n      District dated 8.5.2007 has subsequently informed the appellant<br \/>\n      that no information is available on above mentioned two points<br \/>\n      as the record pertaining to complaint of 2001 has already been<br \/>\n      destroyed in the year 2005. However, I am forwarding copy of<br \/>\n      complaint dated 20.6.01 of DCP\/ Vigilance (PIO\/Vig.) for<br \/>\n      furnishing information available in her office.&#8221;\n<\/p><\/blockquote>\n<p>Appellant&#8217;s prayer before us in 2nd appeal is as below:-\n<\/p>\n<blockquote><p>      &#8220;The appellant hereby submits the present appeal and to<br \/>\n      request that an early hearing may be fixed in the above<br \/>\n      matter.&#8221;<\/p><\/blockquote>\n<p>      He also referred to an order by Smt. Mamta Sehgal, Addl. Session<br \/>\nJudge and Appellate Authority under the RTI Act, a copy of which was<br \/>\nenclosed and which the learned judge has come to the following conclusion:\n<\/p>\n<blockquote><p>      &#8220;I have perused the appeal, heard the appellant in person and in<br \/>\n      view of the above discussion, there is no information left to be<br \/>\n      supplied to appellant. Hence, information required by him<br \/>\n      cannot be supplied. Hence, applicant is not maintainable and is<br \/>\n      hereby dismissed. A copy of this order be given to the appellant<br \/>\n      free of cost. File be consigned to the Record room.&#8221;\n<\/p><\/blockquote>\n<p>The appeal was heard on 26-12-08. The following are present.\n<\/p>\n<p>      Appellant.\n<\/p>\n<p>      Shri S.C. Sharma<\/p>\n<p>      Respondents<br \/>\n      Shri Sushil Kumar, Inspector, Addl. SHO, Krishna Nagar.<br \/>\n      Shri R. S. Chauhan, ACP\/ Division (East).\n<\/p>\n<p>      In view of the response given to his application appellant Shri S.C.<br \/>\nSharma was asked what further information in light of the order of 1st<br \/>\nAppellate Authority on the destruction of records, was now sought by him. He<br \/>\nsubmitted that the information given by the CPIO was misleading in that the<br \/>\nsummons served were, in fact, sent to the correct address but yet not served<br \/>\non the owner of Mehta Enterprises. He submitted a copy of the statement<br \/>\nmade before the MM by the same party in which he has given the same<br \/>\naddress. He also submitted that although he has received a letter of 21-6-07<br \/>\nfrom Ms. Shalini Singh, PIO, Vigilance that no enquiry was conducted in this<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><br \/>\n office on his complaint by Inspector Shri Chaudhry in the year 2001, he<br \/>\ncontended that such an enquiry was conducted as reported in the court.\n<\/p>\n<p>                             DECISION NOTICE<\/p>\n<p>       Having heard the parties and examined the records we find that the<br \/>\ninformation sought by appellant Shri Sharma has, in fact, been provided to<br \/>\nhim in the very first instance by the PIO concerned. In his appeals both first<br \/>\nand second he sought further information as is also apparent from his<br \/>\narguments before us. If, however, he suspects that the summons could have<br \/>\nbeen served and were not served on grounds of bribery and corruption it is<br \/>\nopen to him to make a complaint accordingly before the authorised officer of<br \/>\nthe Delhi Police. Such a complaint cannot constitute a request for information<br \/>\nsince the information is quite clearly that the summons has not been served.<br \/>\nSimilarly, as clarified by Shri R.S. Chauhan, ACP (East Division) that so far as<br \/>\nthe Vigilance is concerned no such enquiry was conducted. If such enquiry<br \/>\nwas conducted by some other Division appellant Shri Sharma has already<br \/>\nbeen provided with the results of that enquiry which answers point (a) of his<br \/>\napplication.\n<\/p>\n<p>       The responses to the questions asked have now been received by<br \/>\nappellant. This appeal is therefore now unsustainable. If he has further<br \/>\ncomplaints on the manner of disposal of his complaints before the Police, this<br \/>\nCommission is not the appropriate authority to entertain the same and he may<br \/>\nmake the complaint to the appropriate authority in the Delhi Police or before<br \/>\nthe Addl. Session Court as the case may be.\n<\/p>\n<p>       Announced in the hearing.
