In pursuance of the said impugned<br \/>\norder, the petitioner is detained in jail.\n<\/p>\n<p>\t\tHeard the learned advocate<br \/>\nfor the petitioner and the learned AGP for the respondents. It is<br \/>\nfound from the order that as the detenu was not released by the lower<br \/>\ncourt, order dated 26.2.2008 was executed on him and thus, the actual<br \/>\ndate of detention is 20.3.2008. It is submitted by the learned<br \/>\nadvocate for the petitioner that the detenu was released on bail by<br \/>\nthis court vide  order dated 19.3.2008 and so also the  detenu was in<br \/>\njudicial custody from 26.2.2008 to 19.3.2008.\n<\/p>\n<p>2.\t\tFrom the grounds of<br \/>\ndetention, it appears that one offence being CR.I.No.5069  of 2008<br \/>\nunder sections 66 (1)b and 65(e)  etc.  under the Bombay Prohibition<br \/>\nAct,  was registered with Naroda police station, wherein  Indian made<br \/>\nforeign liquor and beer tins and a four wheeler were found from the<br \/>\npossession of the detenu.    On the basis of registration of this<br \/>\ncase, the detaining authority held that the present detenu was<br \/>\ncarrying activities of selling  liquor which is harmful to the health<br \/>\nof the public.  It is held by the detaining authority that as the<br \/>\ndetenu is indulged in illegal activities, it is required to restrain<br \/>\nhim from carrying out further illegal activities i.e. selling of<br \/>\nliquor. The detaining authority has placed reliance  on  the above<br \/>\nregistered offence and statements of  unnamed witnesses.   In the<br \/>\nopinion of this court, the activities of the detenu  can, by no<br \/>\nstretch of reasoning, be said to be disturbing the public order.   It<br \/>\nis seen from the grounds that a general statement that has been made<br \/>\nby the detaining authority that consuming liquor is injurious to<br \/>\nhealth.   In fact, a perusal of the order passed by the detaining<br \/>\nauthority shows that the grounds which are mentioned in the order are<br \/>\nin reference to the situation of &#8216;law and order&#8217; and not &#8216;public<br \/>\norder&#8217;.  Therefore, on this ground, the subjective satisfaction of<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>3.\t\tExcept two statements of<br \/>\nthe anonymous witnesses, there is no material on record which shows<br \/>\nthat the petitioner-detenu is carrying out illegal activities of<br \/>\nselling  liquor which is harmful to the health of the public.  In the<br \/>\ncase of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki  v. Police<br \/>\nCommissioner, Surat<\/a> (2001 (1) GLH 393), having considered the<br \/>\ndecision of the Hon&#8217;ble Apex Court in the case of Ram Manohar<br \/>\nLohia v. State of Bihar (AIR 1966 SC 740), this court held<br \/>\nthat the cases wherein the detention orders are passed on the basis<br \/>\nof the statements of such witnesses fall under the maintenance of<br \/>\n\u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p>4.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing  an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the &#8216;public order&#8217; and it<br \/>\nis very clear that  the present case  would not fall within the<br \/>\ncategory of threat to a public order.  In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.  \t\tNo affidavit-in-reply is filed by the learned AGP on behalf<br \/>\nof the respondent-detaining authority controverting the averments<br \/>\nmade in the petition.\n<\/p>\n<p>5.\t\t I am fortified in my view<br \/>\nby the decision taken by this court in the case of <a href=\"\/doc\/662396\/\">Sandip<br \/>\nOmprakash Gupta  v. State of Gujarat<\/a> (2004 (1) GLR 865) that<br \/>\nsolitary incident of violation of prohibition law, normally would not<br \/>\nbe a problem to the maintenance of public order and for such solitary<br \/>\noffence, no person can be detained under the Act.\n<\/p>\n<p>6.\t\tIn the result, this Special<br \/>\nCivil Application is allowed.  The impugned order of detention  dated<br \/>\n26.2.2008 passed by the Commissioner of Police, Ahmedabad is hereby<br \/>\nquashed and set aside.  The detenu is ordered to be set at liberty<br \/>\nforthwith, if not required in any other case.  Rule is made absolute<br \/>\naccordingly.
