As some of the workers were illegally locked out and were<br \/>\nnot provided with work, the said workers through petitioner-Union<br \/>\nraised a dispute before the Industrial Tribunal  which was numbered<br \/>\nas  Reference [I.T.] No. 8 of 1995.  The Industrial Tribunal vide<br \/>\naward dated 10.04.2007 directed the  respondent to allow the workers<br \/>\nto work and to pay them salary and other consequential benefits.<br \/>\nBeing aggrieved by the said order, respondent no. 1 preferred Special<br \/>\nCivil Application No. 13590 of 2007 before this Court. This Court<br \/>\nvide order dated 31.05.2007 stayed the impugned award dated<br \/>\n10.04.2007 passed by the Industrial Tribunal.\n<\/p>\n<p>3.1.\t\tIt<br \/>\nis the case of the petitioner that pending reference and the petition<br \/>\nbefore this Court, the workers continued to stay in Jetty Colony and<br \/>\nsomewhere in April, 2010, as the workers of the petitioner-Union had<br \/>\nan apprehension that the workers would be evicted forcefully from the<br \/>\nresidential premises, they preferred Civil Application No. 3672 of<br \/>\n2010 praying to direct respondent no. 1 not to evict the workers from<br \/>\nthe residential premises.  The said Civil  Application was withdrawn<br \/>\nby the petitioner-Union on 17.06.2010 with a liberty to approach<br \/>\nappropriate forum. It is the case of the petitioner-Union that<br \/>\nseveral requests were made to respondent no. 1 not to evict the<br \/>\nworkers from the residential premises, but there was no response and<br \/>\ntherefore the present petition has been filed.\n<\/p>\n<p>4.0\t\tMrs.\n<\/p>\n<p>Sangeeta Pahwa, learned Advocate for the petitioners  submitted that<br \/>\nthe workers of the petitioner-Union are working  with respondent no.<br \/>\n1  since last many years and therefore, respondent no. 1 should not<br \/>\nevict the workers of the petitioner-Union without any notice<br \/>\nespecially when they are staying at the premises for quite long time.<br \/>\n It is further submitted that  security threats have been given by<br \/>\nrespondent no. 1 in order to harass the workers staying in Jetty<br \/>\nColony. She has further submitted that  the proposed action of the<br \/>\nrespondent no.1 of dispossessing the workers without due process of<br \/>\nlaw is illegal and arbitrary.\n<\/p>\n<p>4.1\t\tAt<br \/>\nthis stage, Mrs Mauna Bhatt, learned Advocate for respondent no.1 has<br \/>\nraised a preliminary contention that a writ petition  is not<br \/>\nmaintainable before this Court against KRIBHCO. She submitted that<br \/>\nrespondent no. 1- &#8220;KRIBHCO&#8221; is neither a &#8220;State&#8221;<br \/>\nunder Article 12 of the Constitution of India nor is &#8220;an<br \/>\ninstrumentality of State&#8221; or &#8220;other authorities&#8221;<br \/>\nand  as such a writ petition under Article 226 of the Constitution of<br \/>\nIndia cannot be preferred against KRIBHCO.\n<\/p>\n<p>4.2\tIn<br \/>\nsupport of her submission, she has placed reliance upon order of this<br \/>\nCourt dated  29th December 2008 passed by this Court in<br \/>\nSpecial Civil Application No.12229 of 2008 wherein the following<br \/>\ndecisions were considered in favour of his contention:\n<\/p>\n<p>1)<br \/>\nR.K. Mishra &amp; Others vs. Krishak Bharati Cooperative Limited &amp;<br \/>\nOthers reported in 2002(3) AD (Delhi) 663.\n<\/p>\n<p>2)<br \/>\n<a href=\"\/doc\/120257808\/\">M\/s. L.K.L Construction Company vs. The General Manager (Prodn.) &amp;<br \/>\nOthers<\/a> delivered by this Court in SCA 259 of 1994.\n<\/p>\n<p>3)<br \/>\nS. Vijayan vs. Krishak Bharati Co-operative Ltd. delivered by this<br \/>\nCourt in SCA 1830 of 1986.\n<\/p>\n<p>3)<br \/>\nAshok kumar and Others vs. Union of India and Others with Sunil<br \/>\nShastry and Others vs. Union of India and Others delivered by<br \/>\nAllahabad High Court in CMWP No. 21772 of 2006.\n<\/p>\n<p>4)<br \/>\nBihar State Co-operative Marketing Union Ltd and Another vs. Indian<br \/>\nFarmers Fertilizer Co-operative Ltd. And others delivered by Patna<br \/>\nHigh Court in Civil Writ Jurisdiction Case No. 7303 of 1993.\n<\/p>\n<p>5)<br \/>\nChhitar Singh vs.  The Indian Farmers Fertilizer Co-operative Ltd.<br \/>\nAnd others delivered by the Jaipur Bench of Rajasthan High Court in<br \/>\nCivil Writ Petition No. 139 of 1986.\n<\/p>\n<p>6)<br \/>\nShyam Lal vs. IFFCO and others delivered by the Allahabad High Court<br \/>\nin Civil Misc. Writ Petition No. 6143 of 1984.\n<\/p>\n<p>h)<br \/>\nLaxman Singh vs.  Indian Farmers Fertilizer Co-operative Ltd. and<br \/>\nothers delivered by Delhi High Court in Civil Writ Petition No. 2024<br \/>\nof 1990.\n<\/p>\n<p>4.3<br \/>\nAs against the above contention,  learned Advocate for the petitioner<br \/>\nhas  submitted that respondent no. 1 is a &#8216;State&#8217; within the meaning<br \/>\nof Article 12 of the Constitution of India. In support of her<br \/>\nsubmission, she has placed reliance on the decision of the Delhi High<br \/>\nCourt in the case of N.K. Aggarwal v. Union of India &amp; Ors.<br \/>\nrendered in Letters Patent Appeal No. 219\/2002 dated 03.12.2006,<br \/>\nwherein the Court has held that KRIBHCO is amenable to the writ<br \/>\njurisdiction of this Court under Article 226 of the Constitution.\n<\/p>\n<p>4.4\tAccording<br \/>\nto the learned Advocate for the respondent no.1, apart from the<br \/>\nmaintainability of the petition,  the Industrial Tribunal, Surat has<br \/>\nheld that  there is no employer-employee relationship between KRIBHCO<br \/>\nand the contract workers and therefore  also no relief can be granted<br \/>\nby this Court to the petitioners.  She submitted that under the guise<br \/>\nof being the erstwhile contractor&#8217;s workers, not only the members of<br \/>\nthe petitioner Union were squatting on KRIBHCO land but there was<br \/>\nmovement of other unauthorized persons in the vicinity of Heavy Water<br \/>\nPlant and the subject area is a center of various illegal activities,<br \/>\nwhich is required to be viewed as a serious threat not only for the<br \/>\nHeavy Water Plant but also the installation of KRIBHCO. She therefore<br \/>\nsubmitted that the petition deserves to be dismissed.\n<\/p>\n<p>5.0\tHaving<br \/>\nheard the learned Advocates for the respective parties and perused<br \/>\nthe relevant materials on record, I am of the view that the<br \/>\npetitioners are unable to produce on record of this petition any<br \/>\ndocument showing that the members of the union were granted<br \/>\npossession of the premises in question. For the very same relief the<br \/>\npetitioners had approached this Court by way of Civil Application<br \/>\nwhich came to be withdrawn with a view to challenging the action<br \/>\nbefore appropriate forum, but thereafter the  present petition has<br \/>\nbeen filed.  Admittedly disputed questions of facts  with regard to<br \/>\npossession, relation between employer-employee, etc.   are involved<br \/>\nin the matter which cannot be gone into by this Court.\n<\/p>\n<p>5.1\tFurther,<br \/>\nhaving regard to the nature of the relief sought in this petition,<br \/>\nthis Court  is not required to enter into the  question whether a<br \/>\nwrit is maintainable against KRIBHCO or not inasmuch as the relief<br \/>\nsought in the present petition is direction against the eviction of<br \/>\nthe workers of the petitioner Union from Jetty Colony. Assuming that<br \/>\na writ remedy is available, the relief which is claimed by the<br \/>\npetitioner cannot be granted by this court under Article 226 of the<br \/>\nConstitution of India. The adjudication in that<br \/>\nbehalf necessarily involves disputed questions<br \/>\nof fact which require investigation. In such a case, proceedings<br \/>\nunder Article 226 of the Constitution can hardly be an appropriate<br \/>\nremedy and the  appropriate remedy for the petitioners is to<br \/>\napproach the Civil Court  or any other  appropriate authority under<br \/>\nthe provisions of Eviction  Act, which may be available to them. In<br \/>\nthat view of the matter I do not find any merits in the matter and<br \/>\ntherefore the petition is rejected.\n<\/p>\n<p>6.0\tHowever,<br \/>\nit is hoped that the respondent authority will not commit any<br \/>\nillegality for evicting the members of the petitioner No.1 Union<br \/>\nfrom the residential premises in question.
