No.25602 of 2010\n                      MOHIT KUMAR, SON OF LATE AMARNATH SINGH\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   29.07.2010                Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                               The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Section 379 of the Indian Penal Code.<\/p>\n<p>                               It has been submitted that the petitioner is not<\/p>\n<p>                  named in the First Information Report which pertains to<\/p>\n<p>                  snatching of the Mobile of the Informant but subsequently, his<\/p>\n<p>                  named transpired in the confessional statement of the co-<\/p>\n<p>                  accused and, thereafter, the looted Mobile was recovered from<\/p>\n<p>                  his house.\n<\/p>\n<p>                               Considering that the petitioner is in custody since<\/p>\n<p>                  24.5.2010 and the petitioner&#8217;s mother undertakes responsibility<\/p>\n<p>                  of the petitioner&#8217;s conduct after he is released from jail custody,<\/p>\n<p>                  let the petitioner above named, be released on bail on<\/p>\n<p>                  furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                  sureties of the like amount each to the satisfaction of Chief<\/p>\n<p>                  Judicial Magistrate, Gaya, in Rampur P.S. Case No. 75 of 2010<\/p>\n<p>                  subject to the following conditions: (i)That one of the bailors will<\/p>\n<p>                  be a close relative of the petitioner who will give an affidavit<\/p>\n<p>                  giving genealogy as to how he is related with the petitioner and<\/p>\n<p>                  the other shall be the mother of the petitioner. The bailor will<\/p>\n<p>                  undertake to furnish information to the Court about any change<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        in address of the petitioner. (ii)That the bailor shall also state on<\/p>\n<p>        affidavit that he will inform the court concerned if the petitioner<\/p>\n<p>        is implicated in any other case of similar nature after his release<\/p>\n<p>        in the present case and thereafter the court below will be at<\/p>\n<p>        liberty to initiate the proceeding for cancellation of bail on the<\/p>\n<p>        ground of misuse. (iii)That the petitioner will give an undertaking<\/p>\n<p>        that he will receive the police papers on the given date and be<\/p>\n<p>        present on date fixed for charge and if he fails to do so on two<\/p>\n<p>        given dates and delays the trial in any manner, his bail will be<\/p>\n<p>        liable to be cancelled for reasons of misuse.
