No.6495 of 2011\n                         BITTU KUMAR son of Hemraj Prasad\n                                       Versus\n                              THE STATE OF BIHAR\n                                     -----------\n<\/pre>\n<p>2\/   23.03.2011                    Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                   The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 307 and other allied sections of the Indian<\/p>\n<p>                      Penal Code.\n<\/p>\n<p>                                   It has been submitted that the petitioner is not named in<\/p>\n<p>                      the First Information Report and subsequently during investigation<\/p>\n<p>                      his complicity arose on account of the mobile phone which had been<\/p>\n<p>                      used for calling the injured.\n<\/p>\n<p>                                   Considering the same, let the petitioner, above named,<\/p>\n<p>                      who is in custody since 28.10.2010 and has no criminal antecedents,<\/p>\n<p>                      be released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                      thousand) with two sureties of the like amount each or any other<\/p>\n<p>                      surety to be fixed by the court below to the satisfaction of the Chief<\/p>\n<p>                      Judicial Magistrate, Jamui, in connection with Jhajha P.S. Case<\/p>\n<p>                      No.241 of 2010, subject to the conditions (i) That one of the bailors<\/p>\n<p>                      will be a close relative of the petitioner, who will give an affidavit<\/p>\n<p>                      giving genealogy as to how he is related with the petitioner and<\/p>\n<p>                      another bailor shall be the father of the petitioner. The bailors will<\/p>\n<p>                      undertake to furnish information to the court about any change in the<\/p>\n<p>                      address of the petitioner, (ii) That the affidavit shall clearly state that<\/p>\n<p>                      the petitioner is not an accused in any other case and, if he is, he<\/p>\n<p>                      shall not be released on bail, (iii) That the bailors shall also state on<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       affidavit that they will inform the court concerned if the petitioner is<\/p>\n<p>       implicated in any other case of similar nature after his release in the<\/p>\n<p>       present case and thereafter the court below will be at liberty to<\/p>\n<p>       initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>       misuse, (iv) That the petitioner will give an undertaking that he will<\/p>\n<p>       receive the police papers on the given date and be present on date<\/p>\n<p>       fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>       delays the trial in any manner, his bail will be liable to be cancelled<\/p>\n<p>       for reasons of misuse, and (v) That the petitioner will be well<\/p>\n<p>       represented on each date and if he fails to do so on two consecutive<\/p>\n<p>       dates, his bail will be liable to be cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                            (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Bittu Kumar vs The State Of Bihar on 23 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
