No.<br \/>\n5\/2010 registered with Jamnagar ACB Police Station,  for the alleged<br \/>\noffences under sec. 409, 465, 467, 468, 471, 120B of IPC r\/w sec. 12,<br \/>\n13(1)(c)(d) &amp; 13(2) of the Prevention of Corruption Act.\n<\/p>\n<p>2.\tLearned advocate Mr.<br \/>\nDagli submitted that  at the relevant time he was on duty only for<br \/>\ntwo days where he is said to have prepared the preliminary report.<br \/>\nHe submitted that all other accused persons have been granted<br \/>\nanticipatory bail as per the order passed in Criminal Misc.<br \/>\nApplication Nos. 6127 of 2010, 6037 of 2010, etc.<\/p>\n<p>3.\tLearned APP Mr.<br \/>\nShukla resisted the application.\n<\/p>\n<p>4.\tHaving heard learned<br \/>\nadvocate Mr. Dagli and learned APP Mr. Shukla and considering the<br \/>\nnature of offence, the role attributed and also the fact that other<br \/>\nco-accused have been granted anticipatory bail, the court is of the<br \/>\nopinion that it is a fit case to exercise discretion under sec. 438<br \/>\nof CrPC in favour of the applicant  and therefore the present<br \/>\napplication deserves to be allowed.\n<\/p>\n<p>5.\tThe application is<br \/>\naccordingly allowed. The applicant is ordered to be released on bail<br \/>\nin the event of his arrest in connection with C.R. No. 5\/2010<br \/>\nregistered with Jamnagar ACB Police Station in respect of the offence<br \/>\nalleged against him on his executing a personal bond of Rs. 5,000\/-<br \/>\n(Rupees Five Thousand only) each with one solvent surety for the like<br \/>\namount  and on further conditions that he shall :\n<\/p>\n<p>(a)\tremain present<br \/>\nbefore the trial court regularly as and when directed on the dates<br \/>\nfixed;\n<\/p>\n<p>(b)\tremain present at<br \/>\nthe concerned Police Station on 28.9.2010 between 11.00 am and 2.00<br \/>\npm.\n<\/p>\n<p>(c )\tmake himself<br \/>\navailable for interrogation by the police officer whenever and<br \/>\nwherever required.\n<\/p>\n<p>(d)\tnot directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade him from<br \/>\ndisclosing such facts to the court or to any police officer;\n<\/p>\n<p>(e)\tnot to obstruct or<br \/>\nhamper the police investigation and not to play mischief with the<br \/>\nevidence collected or  yet to be collected by the police;\n<\/p>\n<p>(f)\tat the time of<br \/>\nexecuting the bond, furnish his address to the I.O. and the courts<br \/>\nconcerned, and shall not change his residence till the final disposal<br \/>\nof the case or till further orders;\n<\/p>\n<p>(g)\tnot to leave India<br \/>\nwithout the permission of the court and if having a passport, shall<br \/>\ndeposit the same before the trial court within a week;\n<\/p>\n<p>7.\tIt would be open to<br \/>\nthe I.O. to file an application for remand if he considers it proper<br \/>\nand just and the learned Magistrate would decide it on merits.\n<\/p>\n<p>8.\tThis order will hold<br \/>\ngood if the applicant is arrested at any time within 90 days from<br \/>\ntoday.  The order for release on bail will remain operative only for<br \/>\na period of 10 days from the date of his arrest during which it will<br \/>\nbe open to the applicant to make a fresh application for being<br \/>\nenlarged on bail in usual course which, when it comes before the<br \/>\ncompetent court, will be disposed of in accordance with law having<br \/>\nregard to all the attending circumstances and the materials available<br \/>\nat the relevant time uninfluenced by the act that anticipatory bail<br \/>\nwas granted.\n<\/p>\n<p>\tRule is made absolute.\n<\/p>\n<p> D.S. permitted.\n<\/p>\n<p>(Rajesh H.
