Justice C.K.ABDUL REHIM\n\n Dated :11\/10\/2010\n\n O R D E R\n                   C.K.ABDUL REHIM, J.\n\n                -------------------------------------------\n                  W.P.(C).No.30801 of 2010\n                -------------------------------------------\n\n           Dated this the 11th day of October, 2010\n\n\n                        J U D G M E N T\n<\/pre>\n<p>                        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>       Challenge in this writ petition is against Ext.P7 to<\/p>\n<p>P9 interlocutory orders passed by the statutory<\/p>\n<p>appellate authority, the 2nd respondent herein.                Stay<\/p>\n<p>petitions filed along with the appeals filed against<\/p>\n<p>orders of assessments with respect to the years<\/p>\n<p>2007-&#8217;08, 2008-&#8217;09 and 2009-&#8217;10 were disposed of<\/p>\n<p>granting stay on condition of the petitioner remitting<\/p>\n<p>1\/3rd of the tax amount in dispute.\n<\/p>\n<p>     2.    It is the contention of the petitioner that the<\/p>\n<p>assessments have no legs to stand and the same<\/p>\n<p>happened to be completed on a total erroneous<\/p>\n<p>consideration of the relevant provisions of law. Since<\/p>\n<p>the statutory appeals are pending consideration and<\/p>\n<p>disposal before the appellate authority, it is not proper<\/p>\n<p>for this court to consider merits of the contentions.<\/p>\n<p>W.P.(C).30801\/10-A                 -2-\n<\/p>\n<\/p>\n<p>      3.    I am of the opinion that the question which need<\/p>\n<p>be looked into is as to whether the appellate authority had<\/p>\n<p>exercised its discretion in a proper manner. It is revealed<\/p>\n<p>from the impugned orders that the appellate authority had<\/p>\n<p>afforded an opportunity of hearing before disposing the<\/p>\n<p>stay petitions. All the contentions raised by the petitioner<\/p>\n<p>were illustrated in the interim order. After narrating such<\/p>\n<p>contentions, the appellate authority had observed as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>          &#8220;I have carefully considered the above contentions<\/p>\n<p>          and    verified   the  available   records.      The<\/p>\n<p>          sustainability or otherwise of the contentions raised<\/p>\n<p>          can be examined in detail only on verification of the<\/p>\n<p>          connected assessment records at the time of final<\/p>\n<p>          hearing of the appeal. However, I find prima facie<\/p>\n<p>          case for conditional stay and hence the following<\/p>\n<p>          orders are issued.&#8221;<\/p><\/blockquote>\n<p>      4.    It is revealed that the appellate authority had<\/p>\n<p>applied its mind and formed an opinion on the basis of the<\/p>\n<p>contentions raised. After being satisfied that a prima facie<\/p>\n<p>case for granting stay has been established, Ext.P7 to P9<\/p>\n<p>W.P.(C).30801\/10-A            -3-\n<\/p>\n<p>orders were issued. Imposition of a condition for granting<\/p>\n<p>stay is a matter which is falling within the discretion of the<\/p>\n<p>appellate authority. Merely because the condition imposed<\/p>\n<p>is rigorous in nature or it causes onerous liability on the<\/p>\n<p>assessee to comply with, this court is not expected to<\/p>\n<p>interfere with such conditions.          Under the above<\/p>\n<p>circumstances I am of the considered opinion that Ext.P7 to<\/p>\n<p>P9 orders are perfectly legal and warrants no interference<\/p>\n<p>by this court.\n<\/p>\n<p>      5.    However, the petitioner had narrated various<\/p>\n<p>aspects regarding his financial position and appealed to<\/p>\n<p>this court to permit him to make payment of a sum of Rs.10<\/p>\n<p>lakhs for the time being and to furnish security for the<\/p>\n<p>balance amount in any of the forms stipulated under Rule<\/p>\n<p>19(2) of the KVAT Rules.      Eventhough the writ petition<\/p>\n<p>deserves no merit, by way of an indulgence I am inclined to<\/p>\n<p>permit such a modification in the interim order.<\/p>\n<p>      6.    In the result the writ petition is disposed of<\/p>\n<p>modifying Ext.P7 to P9, to the extent of granting stay on<\/p>\n<p>W.P.(C).30801\/10-A           -4-\n<\/p>\n<p>condition of the petitioner remitting a sum of Rs.10 lakhs<\/p>\n<p>together in all the three cases, and on furnishing security<\/p>\n<p>in any of the forms prescribed under Rule 19(2) of the<\/p>\n<p>KVAT Rules, within a period of one month from today.<\/p>\n<p>      7.
