Justice R.BASANT\n\n Dated :19\/09\/2007\n\n O R D E R\n                               R.BASANT, J\n                        ------------------------------------\n                         B.A.No.5654 of 2007\n                       -------------------------------------\n             Dated this the 19th day of September, 2007\n\n                                    ORDER\n<\/pre>\n<p>      Application for regular bail.          The petitioner faces allegations<\/p>\n<p>under Section 379 I.P.C.        The crux of the allegations is that the<\/p>\n<p>petitioner had committed theft of river sand belonging to the local<\/p>\n<p>authority.  He was arrested on 25.08.07.                  He continues in custody<\/p>\n<p>from that date.\n<\/p>\n<p>      2.    The learned counsel for the petitioner prays, the learned<\/p>\n<p>Public Prosecutor does not oppose the said prayer and I am satisfied<\/p>\n<p>that the petitioner can now be enlarged on bail subject to appropriate<\/p>\n<p>terms and conditions.\n<\/p>\n<p>      3.    In the result, this application is allowed.            The petitioner<\/p>\n<p>shall be released on bail on the following terms and conditions.<\/p>\n<p>      i)    The petitioner shall execute a bond for Rs.50,000\/-<\/p>\n<p>(Rupees Fifty thousand only) with two solvent sureties each for the like<\/p>\n<p>sum to the satisfaction of the learned Magistrate;<\/p>\n<p>      ii)   The petitioner shall make himself available for interrogation<\/p>\n<p>before the Investigating Officer between 10 a.m and 12 noon on all<\/p>\n<p>Mondays and Fridays for a period of two months and thereafter as and<\/p>\n<p>when directed by the Investigating Officer in writing to do so.<\/p>\n<p>                                                            (R.BASANT, JUDGE)<br \/>\nrtr\/-\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Suresh Kumar vs State Of Kerala on 19 September, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 5654 of 2007(S) 1.
