PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This appeal  by special  leave arises from the order of<br \/>\nthe Division  Bench of the Punjab &amp; Haryana High Court, made<br \/>\non August  7, 1984  in CWP  No.3447\/84 dismissing  the\twrit<br \/>\npetition in limine.\n<\/p>\n<p>     The appellant-tenant  admittedly was  in possession for<br \/>\nthe post 50 years, of the demised land. As per the contract,<br \/>\nhe is  liable to  pay 1\/3rd  of the produce to the landlord.<br \/>\nThe respondent,\t claiming to  be General  Power of  Attorney<br \/>\n(GPA) of  the landlord, filed on application under Section 9<br \/>\nof the Punjab Security of Land Tenures Act, 1953 (for short,<br \/>\nthe `Act&#8217;).  The appellant pleaded that he has paid the rent<br \/>\nfor all\t the years except for the rabi crop in the year 1978<br \/>\ndue to\tfailure of  crops in that year; he was not obtaining<br \/>\nany receipt  on account of faith in the GPA of the landlord.<br \/>\nThe primary authority held that on the admission made by the<br \/>\nappellant that\the had\tnot paid rent, for the year 1978, he<br \/>\nis liable to be ejected. The appeal was dismissed summarily.<br \/>\nThe revision,  though all  the contentions  of the appellant<br \/>\nwere heard, has been decided against him. As stated earlier,<br \/>\nthe writ petition was dismissed in limine. Thus, this appeal<br \/>\nby special leave.\n<\/p>\n<p>     Shri K.K.\tMohan, learned\tcounsel for  the  appellant,<br \/>\ncontends that  the view\t taken by  the\tauthorities  is\t not<br \/>\ncorrect in  law. Since he has been paying the rent regularly<br \/>\nand there  was no  practice of obtaining receipt in proof of<br \/>\npayment of  it, the appellant was under the bona fide belife<br \/>\nand did\t not obtain  the receipt  from the  landlord. Tenant<br \/>\nfrankly admitted that due to failure of the crop in the year<br \/>\n1978,  he   could  not\t pay  the  share  of  the  crop\t but<br \/>\nsubsequently he\t had  paid  the\t same.\tIt  is\this  further<br \/>\ncontention that\t under Section\t9 (a)  of the  Act read with<br \/>\nSection\t 70   of  the\tPunjab\tTenancy\t Act,  1887,  on  an<br \/>\napplication filed  by the  tenant for  determination of\t the<br \/>\ncompensation for  improvement of  the lands  effected by him<br \/>\nunless it  is decided  and value  of improvements determined<br \/>\nand paid, he is not liable to ejectment and, therefore, even<br \/>\nthe order of ejectment is illegal.\n<\/p>\n<p>     The question,  therefore, is:  whether the\t appellant&#8217;s<br \/>\ndefault in  the payment\t of rent for the year 1978 warranted<br \/>\nhis ejectment  from the\t demised property?  It is brought to<br \/>\nour notice that the GPA of the respondent died and the legal<br \/>\nrepresentatives\t are  not  substituted;\t so  the  appeal  is<br \/>\nabated.\t It   is  seen\t that  since  the  proceedings\twere<br \/>\ninstituted by the GPA on the basis of the power given by the<br \/>\nprincipal, the matter is always to be adjudicated only by or<br \/>\non behalf of the principal. Mere death of the agent does not<br \/>\ncause any  impediment in  the way  for disposal\t without his<br \/>\nLegal Representatives  being brought  on  record  and  given<br \/>\nnotice. As  per the  statement of  the counsel, the landlord<br \/>\ndid not respond to this correspondence. On the facts in this<br \/>\ncase, we  think that  it is  not necessary  to\tadjourn\t the<br \/>\nmatter any  further on\tthe ground that the GPA of the first<br \/>\nrespondent died.\n<\/p>\n<p>     Since the\tappellant has  been tenant  for the  past 50<br \/>\nyears and never committed default in the payment of share of<br \/>\nthe crop, it is unlikely that he would commit default in the<br \/>\npayment of  rent for 1978. The normal probable human conduct<br \/>\nwould show that he must have paid the amount to the agent of<br \/>\nthe principal landlord. It is also an admitted position that<br \/>\nsubsequent to  the filing of the application for three years<br \/>\nhe had\talready paid  the rent\tto the\trespondent&#8217;s  G.P.A.<br \/>\nUnder these  circumstance, the question emerges: whether the<br \/>\nappellant has  subsequently paid  the rent for the year 1978<br \/>\nalso? On  a conspectus\tof the\trelevant provisions  and the<br \/>\nprobable  human\t  conduct,  the\t  finding  recorded  by\t the<br \/>\nCommissioner is\t not sustainable.  Generally, tenant  is not<br \/>\nexpected to demand from the landlord issue of a rent receipt<br \/>\nfor payment  of the  amount. After all, it is a relationship<br \/>\nof confidence  between the  landlord and  the tenant, unless<br \/>\nthere is  a special  contract in  that behalf. In this case,<br \/>\nthere appears  to be  a common practice of payment by way of<br \/>\nthe share  in the  crop, after\tthe harvest, to the agent of<br \/>\nthe landlord.  Under these circumstances, we are of the view<br \/>\nthat the finding that the appellant has committed default in<br \/>\npayment of rent for the year 1978 due to failure of crop and<br \/>\nhad paid  the same  in the  later year is not correct. He is<br \/>\nnot liable  to ejection.  The finding contra is not sound in<br \/>\nlaw. The  High Court  has committed manifest error of law in<br \/>\nnot interfering\t with  the  finding  thus  recorded  by\t the<br \/>\nprimary authority and the revisional authority. In this view<br \/>\nof the\tmatter, it  is unnecessary  to go  into\t the  second<br \/>\nquestion.\n<\/p>\n<p>     It\t is   contended\t by  the  learned  counsel  for\t the<br \/>\nrespondent that\t even during  the pendency  of the appeal in<br \/>\nthis Court,  the appellant  has committed default in payment<br \/>\nof the rent and that he did not deposit the rent as directed<br \/>\nby this\t Court. It  is seen that the appellant has deposited<br \/>\nthe rent for the years 1996 also. Under these circumstances,<br \/>\nit would  be clear that the appellant-tenant is not derelict<br \/>\nin payment  of rent, 1\/3rd share in the form of the crop, as<br \/>\ncontended for.\tIt is also to be seen that on three previous<br \/>\noccasions, the\tGPA  of\t the  respondent  made\tunsuccessful<br \/>\nattempts to  have the  respondent ejected  on the  self-same<br \/>\nground of  the default.\t So, it\t would be  unlikely that  he<br \/>\nwould commit  default. Thus,  it  would\t be  seen  that\t the<br \/>\nappellant was  acting bona  fide to  sustain  his  right  to<br \/>\ntenancy by  paying the\trents regularly\t to the agent of the<br \/>\nlandlord.\n<\/p>\n<p>     The appeal is accordingly allowed.
