Shrivastava, Advocate.\n\n6\/16.09.2009<\/pre>\n<p>      Heard the parties.\n<\/p>\n<p>                  The petitioner is said to be appointed as a Vaccinator in the<\/p>\n<p>    year 1951 by the District Board, Ranchi. He retired from service on<\/p>\n<p>    30.01.1988. Now by filing the present writ petition in 2003, the petitioner, who<\/p>\n<p>    is now dead, has prayed for pensionary benefits as admissible to the other<\/p>\n<p>    Government servants.\n<\/p>\n<p>                  It appears that on earlier occasions also, in the year 2000 said<\/p>\n<p>    deceased-petitioner Dani Das Adhikari (now substituted by his widow and<\/p>\n<p>    sons) had filed C.W.J.C. 4079 of 2000 claiming retiral benefits. The said writ<\/p>\n<p>    petition was disposed of by order dated 06.02.2001 considering the fact<\/p>\n<p>    that there was no provision for payment of pension in Zila Parishad.<\/p>\n<p>                  Therefore, it appears that for the same cause of action, the<\/p>\n<p>    present writ petition has been field. The present case is fully covered by the<\/p>\n<p>    decision of the Division Bench in L.P.A. No. 17 of 2009 passed on 18.04.2009<\/p>\n<p>    wherein it has been held that after 22 years of retirement the claim for<\/p>\n<p>    retiral benefits cannot be entertained. The present case has also been filed<br \/>\n       after more than 15 years and at this belated stage, this application cannot<\/p>\n<p>      be entertained, more so when his earlier writ petition for the same cause of<\/p>\n<p>      action was disposed of finally holding that he is not entitled to the retiral<\/p>\n<p>      benefits.\n<\/p>\n<p>                   In this view of the matter, I do not find any merit in this writ<\/p>\n<p>      petition.
