Singh, Sr. Advocate.\n                                                -----------\n<\/pre>\n<p>4   28.10.2010                  Both sides present.\n<\/p>\n<p>                                Informant has filed the present case questioning the<\/p>\n<p>                   sustainability and\/or legality of the order impugned whereby some<\/p>\n<p>                   of the co-accuseds facing trial (O.P. nos. 3 to 13) have been<\/p>\n<p>                   acquitted of the charge(s) punishable under Sections 302, 149,<\/p>\n<p>                   452 and 389 of the Indian Penal Code.\n<\/p>\n<p>                                Mr. Akhileshwar Prasad Singh, learned senior counsel<\/p>\n<p>                   appearing on behalf of the opposite parties, handed in a copy of<\/p>\n<p>                   the order dated 2.7.2008 passed in Govt. Appeal (DB) no. 25 of<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>      2008 (The State of Bihar versus Ashwani Kumar Singh &amp; Ors)<\/p>\n<p>      and submitted that the Government appeal preferred against the<\/p>\n<p>      present judgment has already been considered and dismissed by<\/p>\n<p>      a Division Bench of this Court, the copy is taken on record and<\/p>\n<p>      marked &#8220;X&#8221;.\n<\/p>\n<p>                Mr. Ajay Kumar Thakur, learned counsel appearing on<\/p>\n<p>      behalf of the petitioner, submits that in view of amended provision<\/p>\n<p>      of the Code, the petitioner shall have right to file appeal.<\/p>\n<p>                Learned counsel appearing on behalf of the opposite<\/p>\n<p>      parties, on the other hand, controverts the aforesaid stand of the<\/p>\n<p>      petitioner in view of the date from which the aforesaid<\/p>\n<p>      amendment had taken effect.\n<\/p>\n<p>                Be that as it may, since the Government appeal arising<\/p>\n<p>      out of the present judgment and order has already been<\/p>\n<p>      dismissed, this Court is not inclined to interfere with the present<\/p>\n<p>      judgment and order.\n<\/p>\n<p>                The application has no merit.
