DAVE  19th October 2010\n\t\t\n\t\n\n \n\n ORAL\nORDER<\/pre>\n<p> (Per :\n<\/p>\n<p>HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)<\/p>\n<p>\t This<br \/>\nApplication has been preferred by the petitioner-Corporation for<br \/>\ncondonation of delay of 520 days in preferring the proposed Appeal<br \/>\nagainst the Order dated 19th January 2009 passed in S.C.A<br \/>\nNo. 10139 of 2008.  By the said Order, the learned Single Judge,<br \/>\nwhile issuing rule, passed ad interim order directing that if<br \/>\nthe respondent-writ petitioner submits development plan for<br \/>\nconstruction of building over the land, the same shall be accepted by<br \/>\nthe petitioner-Corporation, and the processing shall be made in<br \/>\naccordance with law, and shall not be denied on the ground that<br \/>\nacquisition proposal is pending u\/s. 78 of the B.P.M.C Act. The<br \/>\ndecision of the Corporation, if any, has been ordered to be placed on<br \/>\nrecord for sanctioning of the plan or otherwise.\n<\/p>\n<p>\t  In the<br \/>\npresent case, as we find that ad interim order was passed by<br \/>\nthe learned Single Judge and rule was made returnable on 18th<br \/>\nFebruary 2009, we are of the view that instead of condoning delay for<br \/>\nentertaining the proposed Appeal against the interim order, it<br \/>\nwould be desirable if the petitioner-Corporation is given liberty to<br \/>\nmove before the learned Single Judge for disposal of the writ<br \/>\npetition viz., S.C.A No. 10139 of 2008 on merit and\/or for<br \/>\nvacating ad interim order dated 19th January 2009,<br \/>\nas the case having not been taken up for hearing even after one year<br \/>\nand eight months from the date, the rule was made returnable. In such<br \/>\ncase, the learned Single Judge is expected to hear the case on merit<br \/>\nand\/or to take up the petition for vacating the stay which may be<br \/>\ndecided in accordance with law.
