SANKARAN, J.\n                   ---------------------------\n                    B.A. No.3563 of 2009\n               ------------------------------------\n              Dated this the 8th day of July, 2009\n\n                          O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under<\/p>\n<p>Section 438 of the Code of Criminal Procedure. The petitioner<\/p>\n<p>is the accused in Crime No.161\/2009 of Kuravilangadu Police<\/p>\n<p>Station, Kottayam.\n<\/p>\n<p>     2.    The offence alleged against the petitioner is under<\/p>\n<p>Section 376 of the Indian Penal Code.\n<\/p>\n<p>     3.    This is a case involving peculiar facts. A girl aged<\/p>\n<p>14 years was admitted in Cardinal Specialty Hospital,<\/p>\n<p>Monipally for alleged mental illness. She was admitted on<\/p>\n<p>20\/04\/2009. She was an inmate of room No.95 in the 5th floor<\/p>\n<p>of the hospital. The accused is stated to be a mentally ill<\/p>\n<p>person. His father filed a petition before the Circle Inspector<\/p>\n<p>of Police, Manimala on 22\/04\/2009 stating that the petitioner<\/p>\n<p>was showing symptoms of mental disease and that his father<\/p>\n<p>was unable to manage the petitioner. He sought help of the<\/p>\n<p>police for the purpose of forcibly removing the petitioner to a<\/p>\n<p>mental hospital. The police afforded necessary help to the<\/p>\n<p>B.A. No.3563 \/ 2009<br \/>\n                             Page numbers<\/p>\n<p>father of the petitioner and accordingly, the petitioner was<\/p>\n<p>admitted      in   Cardinal  Specialty   hospital, Monipally  on<\/p>\n<p>24\/04\/2009. Annexure II is the discharge summary dated<\/p>\n<p>22\/06\/2009 issued by the Cardinal Specialty Centre, which<\/p>\n<p>indicates that the petitioner was admitted in the hospital on<\/p>\n<p>24\/04\/2009 and that he was brought by his father with the help<\/p>\n<p>of police. The discharge summary also shows the diagnosis thus:<\/p>\n<p>&#8220;Schizophrenia, Unspecified&#8221;. The petitioner was treated in the<\/p>\n<p>hospital and he was discharged on 10\/06\/2009.<\/p>\n<p>      4.     The incident occurred on 1\/05\/2009. The prosecution<\/p>\n<p>case is that on 1\/05\/2009 at 12.30 hours, the petitioner<\/p>\n<p>committed rape on the victim girl. The girl did not report the<\/p>\n<p>matter to anybody. After discharge from the hospital on<\/p>\n<p>18\/05\/2009, she was asked to visit the hospital again, but she<\/p>\n<p>did not do so. Later, she was examined by the doctor on<\/p>\n<p>1\/06\/2009. It would appear that the girl had reported to her<\/p>\n<p>relatives about the incident and they wanted to ascertain the<\/p>\n<p>facts and to conduct pregnancy test. Pregnancy was ruled out,<\/p>\n<p>but it was reported to the doctor that she was raped by the<\/p>\n<p>B.A. No.3563 \/ 2009<br \/>\n                              Page numbers<\/p>\n<p>petitioner on 1\/05\/2009. The F.I.R. was registered only on<\/p>\n<p>20\/06\/2009.\n<\/p>\n<p>      5.     The petitioner seeks anticipatory bail in these<\/p>\n<p>circumstances apprehending arrest in the case. The learned<\/p>\n<p>Public Prosecutors opposed the Bail Applications.<\/p>\n<p>      6.     In the peculiar facts and circumstances of the case, I<\/p>\n<p>am of the view that anticipatory bail can be granted to the<\/p>\n<p>petitioner. If the relief is denied to the petitioner, there is every<\/p>\n<p>likelihood that the petitioner would be arrested and detained in<\/p>\n<p>judicial custody. That would not serve any purpose. It cannot be<\/p>\n<p>said that the petitioner would try to influence the witnesses or<\/p>\n<p>intimidate them. If the petitioner is detained in judicial custody,<\/p>\n<p>sometimes, his illness may aggravate           and it may become<\/p>\n<p>necessary to shift him to the        mental hospital. On the other<\/p>\n<p>hand, if he is granted anticipatory bail, it would not affect the<\/p>\n<p>investigation of the case. All relevant facts are to be investigated<\/p>\n<p>upon by the investigating agency.          For that purpose, the<\/p>\n<p>cooperation of the petitioner is also necessary.<\/p>\n<p>      7.     The learned counsel for the petitioner submits that the<\/p>\n<p>B.A. No.3563 \/ 2009<br \/>\n                                Page numbers<\/p>\n<p>petitioner is prepared to appear before the police on any number<\/p>\n<p>of occasions and he is prepared to abide by any conditions that<\/p>\n<p>may be imposed by this Court.\n<\/p>\n<p>      8.     Taking into account the facts and circumstances of the<\/p>\n<p>case, there will be a direction that in the event of arrest of the<\/p>\n<p>petitioner     in   connection      with     Crime    No.161\/2009 of<\/p>\n<p>Kuruvilangadu Police Station, the officer in charge of the police<\/p>\n<p>station shall release him on bail on his executing bond for<\/p>\n<p>Rs.50,000\/- with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>         A) The petitioner shall          report     before   the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on all Mondays, Wednesdays and Fridays, till the<br \/>\n             final report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The     petitioner     shall    appear    before  the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not try to influence the<br \/>\n             prosecution    witnesses or        tamper   with the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<p>B.A. No.3563 \/ 2009<br \/>\n                           Page numbers<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.\n<\/p>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                 K.T.
