 2.   The appellants are aggrieved against that part of the<\/p>\n
 judgment delivered in a bunch of the writ petitions decided<\/p>\n
 by   judgment   dated     30\/03\/11   whereby     respondents’<\/p>\n
 appointments have been protected.\n<\/p>\n
 3.   The appellants’ contention is that as per the Service<\/p>\n
 Rules governing the services of the employees of the<\/p>\n
 Jharkhand State Electricity Board, there is no cadre post<\/p>\n
 of the Assistant Engineer (IT) and, therefore, merely<\/p>\n
 because advertisement was issued by the Board inviting<\/p>\n
 application from the candidates having qualification of<\/p>\n
 Graduate in Information Technology cannot create right in<\/p>\n
 favour of those incumbent merely because of the fact that<\/p>\n
 they succeeded to get through in that process of selection.<\/p>\n
 It is submitted that any appointment in the cadre of the<\/p>\n
 services of the employees in the Jharkhand State Electricity<\/p>\n
 Board could have been given provided that post would have<\/p>\n
 been in the cadre.\n<\/p>\n
 4.   Learned counsel for the respondents submitted that<\/p>\n
the Board itself took a decision to offer appointment to the<\/p>\n
I.T. Graduates in Engineering on the post of Assistant<\/p>\n
Engineer (IT). The need of these technical persons is<\/p>\n
admitted by the Board and not only this, the Board itself<\/p>\n
subsequently has included the post of Assistant Engineer<\/p>\n
(IT) in the cadre post as stated by counsel for the Board<\/p>\n
today with the help of resolution of the Board’s 82nd<\/p>\n
meeting dated 19.11.2010. It is also submitted that after<\/p>\n
filing of the writ petition and when the Court already<\/p>\n
passed the order that any appointment given in pursuance<\/p>\n
of any subsequent advertisement, will be subject to the<\/p>\n
decision of the writ petition, even then the Board has given<\/p>\n
appointment to other persons selected by the same process<\/p>\n
of selection and that too without there being any Rules for<\/p>\n
appointment for the post of Assistant Engineer (IT) thereby<\/p>\n
the Board which itself has selected the candidates for<\/p>\n
appointment on the post of Assistant Engineer (IT) by a<\/p>\n
process, want to replace the selected candidates on the<\/p>\n
basis of the same process by giving     appointment of the<\/p>\n
same nature. It is submitted that the appointees appointed<\/p>\n
by one mode cannot be removed by giving appointment to<\/p>\n
other persons by same mode taking the plea that they have<\/p>\n
selected other persons to replace earlier selected persons.<\/p>\n
5.   We have considered the submissions of the learned<\/p>\n
counsel for the parties and since the facts are not in<\/p>\n
dispute, we need not to go in detail of the facts except that
\n the services in the Jharkhand State Electricity board are<\/p>\n
governed by the Rules framed by the Board which are<\/p>\n
known as Service regulation, 1976; Electrical Engineer<\/p>\n
(General) Cadre Rules, 1976; Civil Engineers Cadre Rules,<\/p>\n
1976; Recruitment Promotion and Cadre Rule for the<\/p>\n
Subordinate Accounts Service; The Bihar State Electricity<\/p>\n
Board (Generation-cum-Transmission Cadre) Rules, 1976<\/p>\n
and The Bihar State Electricity Board Junior Engineers<\/p>\n
(Generation-cum-Transmission Cadre) Regulations, 1976. It<\/p>\n
is not in dispute that post of the Assistant Engineer (IT) is<\/p>\n
not a cadre post in the definition given in the relevant<\/p>\n
Rules and particularly Rule 5 of the Bihar State Electricity<\/p>\n
Board (Generation-cum-Transmission Cadre) Rules, 1976<\/p>\n
and not within the cadre as given in Rule 6. Therefore, the<\/p>\n
appointment of any person selected for the post which is<\/p>\n
not the cadre post cannot be treated to be an appointment<\/p>\n
in the cadre and can be treated to be ex-cadre post<\/p>\n
appointment. In facts situation where the Board itself has<\/p>\n
admitted that there is need of such technical persons in<\/p>\n
service and the need of the Board for these technical<\/p>\n
persons has further fortified by the Resolution taken in the<\/p>\n
Board’s 82nd meeting dated 19.11.2010 whereby such<\/p>\n
posts have been included in the cadre post. However, even<\/p>\n
after including the said post as cadre post vide Resolution<\/p>\n
dated 19.11.2010, the Rules yet have not been framed and<\/p>\n
as per resolution dated 19.11.2010, copy of which has been<\/p>\n
provided by the learned counsel for the Board, read with
\n                  Board’s order in Agenda No. 694\/2010-11, only it has been<\/p>\n
                 proposed that now the Rules may be framed obviously,<\/p>\n
                 prescribing educational and further requirements for<\/p>\n
                 giving regular appointment in the cadre. In view of the<\/p>\n
                 above   reasons,   by     subsequent   advertisement,     if   any<\/p>\n
                 appointment is given, that appointment is also only without<\/p>\n
                 there being any Rule. Therefore, the respondents who have<\/p>\n
                 been selected by the appellant Board for appointment,<\/p>\n
                 though as ex-cadre employee, sought to be replaced by<\/p>\n
                 another set of ex-cadre employee and not by regularly<\/p>\n
                 selected employees which is impermissible and, therefore,<\/p>\n
                 on this count also, we do not find any reason to interfere in<\/p>\n
                 the impugned order .\n<\/p>\n
                 6.   Therefore, the L.P.A. preferred by the Board, having<\/p>\n
                 no merit, is dismissed.\n<\/p>\n<\/p>\n
