The  husband  of the petitioner, who was  working  as<br \/>\n       permanent Gangman, as is evident from the service book<br \/>\n       (Annexure   P\/2)  died in harness on 20.10.2005.  The<br \/>\n       petitioner,  being the widow, made an application  on<br \/>\n       14.03.2006 for appointment on compassionate basis as Labour<br \/>\n       (Reja) in place of her husband. The respondent-authorities,<br \/>\n       by  order dated 27.4.2006 (Annexure R\/1) rejected the<br \/>\n       application of the petitioner on the ground that the husband<br \/>\n       of the petitioner namely Shri Ram Lal Yadav, was not a<br \/>\n       permanent Gangman in work-charged establishment.\n<\/p>\n<p>  2.   Shri  Anthony,  learned  counsel  appearing  for  the<br \/>\n       petitioner submits that the rejection of the application of<br \/>\n       the petitioner is not based on factual matrix. Admittedly,<br \/>\n       the husband of the petitioner, after completing 15 years of<br \/>\n       service as Gangman, was made permanent Gangman, as is<br \/>\n       evident from Annexure P\/2, i.e. the service book. Shri<br \/>\n       Anthony relies on the decision of this Court in Govind &amp;<br \/>\n       Others v. State of C.G. &amp; Others1 in order to support his<br \/>\n       contention and prays for quashing of the impugned order<br \/>\n       dated 29.05.2006 (Annexure P\/4) and further prays for<br \/>\n       direction to the respondents to consider the petitioner for<br \/>\n       appointment on compassionate basis as there is no other<br \/>\n       reason for rejecting the application of the petitioner.\n<\/p>\n<p>  3.   Per contra, Shri Thakur, learned Panel Lawyer appearing<br \/>\n       for the State\/respondents relies on its return dated 13th<br \/>\n       November, 2006 and submits that the application of the<br \/>\n       petitioner was rejected not on any other ground but on the<br \/>\n       ground  that  the deceased employee was  not  regular<br \/>\n       (permanent) as is clear from Annexure R\/1. Thus,  the<br \/>\n  petitioner was not entitled to be considered for appointment<br \/>\n       on compassionate basis.\n<\/p>\n<p>4.   Having heard learned counsel appearing for the parties,<br \/>\nperused the pleadings and documents appended thereto, it is<br \/>\nevident from the service record (Annexure P\/2) that the<br \/>\nhusband of the petitioner was a permanent Gangman in the<br \/>\nwork charged establishment and as such, the impugned order<br \/>\ndated 29.05.2006 (Annexure P\/4) passed by the respondent-<br \/>\nauthority is without any basis and without verification of<br \/>\nthe facts involved in the present case.\n<\/p>\n<p>5.   There is no quarrel on the point that if a permanent<br \/>\ngangman in the work charged establishment dies in harness,<br \/>\nas per policy, one of the dependent of the deceased employee<br \/>\nwould be entitled to consideration for compassionate<br \/>\nappointment. Admittedly, the application of the petitioner<br \/>\nhas not been rejected on any other ground except the ground<br \/>\nthat he was not a permanent Gangman in the work charged<br \/>\nestablishment.\n<\/p>\n<p>  6.   The  question with regard to definition of  permanent<br \/>\n       Gangman came into consideration before this Court in the<br \/>\n       matter  of Govind (supra) . This Court, after  having<br \/>\n       considered all the aspects observed as under:\n<\/p>\n<blockquote><p>           &#8220;15.  Thereafter, in the  Madhya  Pradesh<br \/>\n           Workcharged    and    Contingency    Paid<br \/>\n           Employees  Revision of Pay  Rules,  1977,<br \/>\n           framed  under the proviso to Article  309<br \/>\n           of the Constitution of India, the post of<br \/>\n           gangmen  was shown at serial No.  (xxvii)<br \/>\n           in  Annexure-I, (under Rule 3), under the<br \/>\n           column  &#8220;name  of  the  post  held  by  a<br \/>\n           workcharged    or    contingency     paid<br \/>\n           employee&#8221;.   The   definition   of    the<br \/>\n           `contingency    paid    employee&#8221;     and<br \/>\n           &#8220;workcharged employee&#8221; are the same under<br \/>\n           the  provisions  of the Rules,  1976  and<br \/>\n           that  of the Rules, 1979. In Rules, 1979,<br \/>\n           the  `permanent employee&#8217; was defined  in<br \/>\n           Rule  2(c) as a workcharged employee  who<br \/>\n           has  completed 15 years of service on  or<br \/>\n           after  1.1.1974.  Reading  the  circulars<br \/>\n           dated 14.6.1974  and 29.9.1975, Rule 2(h)<br \/>\n           of  the Rules, 1976, Rule 8 of the Rules,<br \/>\n           1976  Annexure 1 to Rules  1977  and  the<br \/>\n           definition  enshrined in Rule 2(b) and in<br \/>\n           Rule   2(c)  i.e.  `permanent  employees&#8217;<br \/>\n           under  Rules, 1979 together,  it  clearly<br \/>\n           follows  that the permanent  gangmen  are<br \/>\n           governed   by   the   same   policy   for<br \/>\n           superannuation, as is applicable  to  the<br \/>\n           Class IV government employees. It is  not<br \/>\n           in  dispute that the amendment to F.R. 56<br \/>\n           under  the Act, 1967, as amended  by  the<br \/>\n           Madhya     Pradesh    Shashkiya     Sevak<br \/>\n           (Adhivarshiki-Ayu) Sanshodhan  Adhiniyam,<br \/>\n           1999 (M.P. Act No. 13 of 1999), published<br \/>\n           in  the  Gazette (Extraordinary) on  29th<br \/>\n           April,   1999,  provides   for   age   of<br \/>\n           retirement  to  the Class  IV  government<br \/>\n           servants  on  attaining  the  age  of  62<br \/>\n           years.&#8221;\n<\/p><\/blockquote>\n<p>  7.   Applying  the well-settled principles of law  to  the<br \/>\n       facts of the case, and further that the husband of the<br \/>\n       petitioner was a permanent Gangman in the work charged<br \/>\n       establishment, the petitioner is entitled to be considered<br \/>\n       for appointment on compassionate basis.\n<\/p>\n<p>  8.   In view of the foregoing, the petition is allowed. The<br \/>\n       impugned letter\/order dated 29.05.2006 (Annexure P\/4) based<br \/>\n       on letter dated 27.4.2006 (Annexure R\/1) is quashed. The<br \/>\n       respondent-authorities shall consider the case of the<br \/>\n       petitioner afresh for appointment on compassionate basis in<br \/>\n       accordance with law and in light of the observations made<br \/>\n       hereinabove.
