Justice R.BASANT\n\n Dated :20\/09\/2007\n\n O R D E R\n                             R.BASANT, J\n                   = = = = = = = = = = = = =\n                          Cr.M.C.Nos.2938\n                           &amp; 2939 of 2007\n                  = = = = = = = = = = = = = =\n\n              Dated this the 20th day of September, 2007\n\n                                ORDER\n<\/pre>\n<p>      The common petitioner in these two petitions faces indictment in<\/p>\n<p>two separate prosecution for offences punishable, inter alia, under<\/p>\n<p>Sec.138 of the Negotiable Instrument Act .      The petitioner entered<\/p>\n<p>appearance before the learned Magistrate and was enlarged on bail.<\/p>\n<p>But the petitioner could not appear before the learned Magistrate.<\/p>\n<p>Consequent to non-appearance of the petitioner, he finds coercive<\/p>\n<p>processes issued by the learned Magistrate chasing him now.<\/p>\n<p>     2.   The learned counsel for the petitioner submits that he is<\/p>\n<p>innocent. His absence was not wilful.      The petitioner is willing to<\/p>\n<p>appear before the learned Magistrate and seek bail; but he<\/p>\n<p>apprehends that his application for bail may not be considered by the<\/p>\n<p>learned  Magistrate   on   merits,   in   accordance  with   law   and<\/p>\n<p>expeditiously. He therefore prays that a direction may be issued under<\/p>\n<p>Section 482 Cr.P.C to the learned Magistrate to release him on bail<\/p>\n<p>when he appears and applies for bail.\n<\/p>\n<p>     3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate the circumstances<\/p>\n<p>Cr.M.C.No.2938 &amp;<br \/>\n2939 of 2007<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>under which he could not earlier appear before the learned Magistrate.<\/p>\n<p>The learned Magistrate must consider such application for bail on<\/p>\n<p>merits, in accordance with law and expeditiously. I have no reason to<\/p>\n<p>assume that the learned Magistrate would not consider such<\/p>\n<p>application on merits, in accordance with law and expeditiously. Every<\/p>\n<p>court must do the same. No special or specific direction appears to be<\/p>\n<p>necessary. Sufficient general directions have already been issued in<\/p>\n<p><a href=\"\/doc\/147290035\/\">Alice George v. The Deputy Superintendent of Police<\/a> [2003(1)<\/p>\n<p>KLT 339].\n<\/p>\n<p>       4.
