MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nappeal has been preferred by the appellant, original petitioner,<br \/>\nagainst the order dated 23.2.2011 passed by the learned Single Judge<br \/>\nin Special Civil Application No.2012 of 2011. By the said order, the<br \/>\nCourt refused to direct the Central Board of Secondary Education<br \/>\n(&#8216;CBSE&#8217; for short) to issue Hall ticket\/ Admit card to the petitioner<br \/>\nto appear in the XII Std. examination, as was scheduled to be held in<br \/>\nMarch 2011.\n<\/p>\n<p>2.\tOn<br \/>\n25.2.2011, this Court by interim order allowed the appellant to<br \/>\nappear in the XII std. examination, subject to the decision of the<br \/>\ncase, and directed the first respondent-CBSE to issue Hall ticket\/<br \/>\nAdmit card on receipt of requisite fees and  forms, but it was<br \/>\nordered not to publish the result without prior permission of the<br \/>\nCourt.\n<\/p>\n<p>3.\tThe<br \/>\ncase of the appellant is that she was studying in the third<br \/>\nrespondent-Ambuja Vidya Niketan  since 1999 till the year 2010. She<br \/>\nappeared in the XI std. examination conducted by the third<br \/>\nrespondent-school authorities and provided with the mark-sheet.<br \/>\nThereafter the appellant took admission in XII std. in the second<br \/>\nrespondent- Om Shanti English Medium School in the year 2010.  When<br \/>\nthe question of appearing in the XII std. examination came, the<br \/>\nappellant was not allowed Hall ticket. Now, the respondents have<br \/>\ntaken a plea that before leaving the third respondent-school, the<br \/>\nappellant could not pass Mathematics paper of XI std. examination<br \/>\nheld by the third respondent-school for that reason she was not<br \/>\nallowed to appear in the examination.\n<\/p>\n<p>4.\tIt<br \/>\nis not in dispute that the appellant was promoted from XI std. to XII<br \/>\nstd. by third respondent-school. Thereafter she was admitted in the<br \/>\nsecond respondent-school. At that time, no objection was raised by<br \/>\nany school about promotion granted to the appellant to the XII std.<br \/>\non the ground of non-passing of Mathematics examination. She was<br \/>\nadmitted on provisional basis, subject to approval by the CBSE. The<br \/>\nmatter remained pending with CBSE till the XII std. Board examination<br \/>\nwas scheduled to be held. The aforesaid facts have not been disputed<br \/>\nby the learned counsel appearing on behalf of the respondents.\n<\/p>\n<p>5.\tHaving<br \/>\nregard to the facts and circumstances and taking into account that<br \/>\nthere is no fault on the part of the appellant-student and this is<br \/>\nthe beginning of her career and first Board examination, we are of<br \/>\nthe view that the appellant should be allowed to appear in the<br \/>\nMathematics examination of the XI std. from third respondent-school<br \/>\nand, if she passes the said examination, the CBSE will regularise her<br \/>\nadmission as was taken in the XII std. in the second<br \/>\nrespondent-school and thereafter will declare  the XII std. result.\n<\/p>\n<p>6.\tThe<br \/>\nPrincipal of the third respondent-school is directed to hold such<br \/>\nexamination for Mathematics subject of XI std. and allow the<br \/>\nappellant to appear in this examination on deposition of requisite<br \/>\nfee, and to publish the result within one month. The result should be<br \/>\nintimated to the second respondent-school and the CBSE, who in their<br \/>\nturn, if find that the appellant is successful in the Mathematics<br \/>\nexamination, will regularise the admission in the XII std. and<br \/>\npublish the result within a month thereof. The total procedure should<br \/>\nbe completed by 30th June 2011. The order passed by the<br \/>\nlearned Single Judge dated 23.2.2011 in Special Civil Application<br \/>\nNo.2012 of 2011 is set aside.\n<\/p>\n<p>7.\tBoth<br \/>\nthe appeal and civil application stand disposed of with the aforesaid<br \/>\nobservations and directions.
