No.20221 of 2007\n\n             -------------------------\n\n                  Dated this the 2nd  day of July, 2007.\n\n\n\n                               JUDGMENT\n<\/pre>\n<p>             The   petitioners   have   approached   this   court<\/p>\n<p>challenging   Ext.P8   proceedings   and   also   the   accompanying<\/p>\n<p>seniority list, Ext.P9, of Driller\/Driller Mechanic as on 1.3.2005.<\/p>\n<p>As per the earlier seniority list,  the  petitioners  were assigned<\/p>\n<p>seniority   in   the   said   cadre   above   respondents   3   to   15.     The<\/p>\n<p>basis of preparation of the seniority list was the date of joining<\/p>\n<p>duty in the said post.  But, recently, when the draft seniority list<\/p>\n<p>was   published,   several   persons   filed   objections   stating   that<\/p>\n<p>seniority   should   be   fixed   with   reference   to   the   date   of   first<\/p>\n<p>effective advice as provided in Rule 27(c) of the Kerala State<\/p>\n<p>and   Subordinate   Services   Rules.     The   said   contention   was<\/p>\n<p>upheld and the seniority list was revised basing on the date of<\/p>\n<p>advice,   instead   of   the   date   of   joining   duty.     The   petitioners,<\/p>\n<p>who   joined   duty   earlier,   though   juniors   in   the   advice   list,   are<\/p>\n<p>aggrieved  by  the  present   re-arrangement of   the  seniority  list.<\/p>\n<p>So, this writ petition is filed challenging Exts.P8 and P9.<\/p>\n<p>W.P.(C). No.20221 of 2007<\/p>\n<p>                                                       :: 2 ::\n<\/p>\n<\/p>\n<p>                  2.     The   main   ground   of   attack   is   that   there   is<\/p>\n<p>considerable delay in revising the seniority list and therefore,<\/p>\n<p>the petitioners are entitled to sit back.<\/p>\n<p>                  3.     The   petitioners   have   raised   only   the   above<\/p>\n<p>technical contention.  On merits, they do not have any case.<\/p>\n<p>The Government themselves, at the time of finalisation of the<\/p>\n<p>list, have decided to correct the mistake committed by them.<\/p>\n<p>I   think,   this   court   is   not   justified   in   interfering   with   the   said<\/p>\n<p>decision under Article 226 of the Constitution of India.<\/p>\n<p>                  Accordingly,   the   writ   petition   fails   and   it   is<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<p>                                                            Sd\/-\n<\/p>\n<p>                                              (K.BALAKRISHNAN NAIR)<\/p>\n<p>                                                                     JUDGE<\/p>\n<p>sk\/<\/p>\n<p>                                             \/\/true copy\/\/<\/p>\n<p>                                             P.S.
