VViac&#039;ts.\u00bbie&#039;_ading to this appeal are as\n\n is respondent herein, who is said to be\n\ntimber c,ia&#039;tter.-- iivorking under the appeiiants herein. That on\n\nS&quot;&quot;\u00ab.__V*\u00bb1A8vO1\u00a52\u00a7\u00a7S01, while he was cutting the tree in the forest area\n\n.Aifd&#039;ur he feii down and suffered injuries to the left side of\n\n._h__i\u00a7s body, ie., fracture to ieft hand and leg, which has\n\nVh\n\n\n\naward passed by the court below on the following\nsubstantial questions of law:\n\n&quot;(a) Whether the Commissioner has come to.---.,\n\nthe conciusion that the accident was occurred\u00bb.s:&quot;\u00ab\u00ab.y&#039;_i&#039;~i.\n\nduring the course of employment and the   \n\nis justified in law?\n\n(b) Whether the court beiow i-.&#039;_s_\u00b0*j&#039;iustified_:--&#039;\u00bbinx  \n\nawarding compensaho-n_.V &#039;without  \ndocumentary evidence&#039; regardmgii  tine \nreiationship of emp!.oyer,a&#039;r&#039;idiiVen{p~ii.g&#039;yee&quot;ar&#039;i&#039;d the\nsame isjustified in&#039;&quot;ia\ufb01v\\&#039;?&#039;~.   \n\n(cv) &quot;&quot;&quot; &quot;V&#039;i!-hetheiriifiij&quot;thei.V_:Labou&#039;r&#039;&quot;&#039;*&#039;Commissioner is\njustified the documentary\nevidence of\u00bb the :.ern:oVi5Io.yer and the same is\nAjustifieiud&#039;  iaw?&quot;&#039;. &#039;&#039; &quot;\n\n   matter the entire triai court record was\n\nsecured an&#039;di?&#039;iar&#039;guments were heard. Thereafter, this court\n\n &quot;._proceedvt&#039;o answer the aforesaid substantial questions of iaw\n\n  &quot;ifi&#039;h.t:he~_.affirmative for the foiiowing reasons.\na _ _ _ WV&#039;\n\n\n\n&#039;4&#039;;\n\n6. Factually, in this proceedings the appeiiants\n\nherein have not disputed the fact of accident andVV.i&#039;ni&quot;urries\n\nsuffered by the claimant in the said accident;&quot;&quot;&#039;it\u00a7,ji~s&#039;._:aiso&quot;.y\n\ninteresting to note that the accident is take-n..A4_jp&#039;ia&#039;ce::within  \n\nthe reserved forest area. Assurning...sfoZr&quot;mo.m&#039;e&#039;n.t the&#039;\n\nclaimant is not an employee of the ap&#039;pe|&#039;I&quot;ants ;iierxe.i:n,  had_\u00b0;\n\nno right or business to cut anycitfrieegwgin fftiieffiforesft. Under\nthese circumstances, he._.&quot;:s:h&#039;o.;;|d;V--_h&#039;;,:\u00ab\u00a2_e\u00bb.\u00bb..fA5\u00abgen treated as an\ntrespasser into the  attempting to\ncommit thef.t_s&#039;i&#039;s*&quot;:seen that no such\nproceeding   against the claimant\nherein for  Thereby they admit that\nthe claimant  with their permission and he\n\nwas_{:a&quot;rryingV t\u00bbh,eracti\\}ity of cutting the tree under their\n\n igAnSt_f&#039;LiCtiu0iAfi. _ \n\n _f.&#039;V&#039;v&#039;I&#039;in..&#039;the proceedings before the trial Court the\n\n&quot;i.,cIaimant&quot;&#039;has produced documents to show the nature of\n\n&quot;:f:i_n._iuri&#039;es that he has suffered and the treatment that was\n\n taken by him for the said injuries. He has also produced\n\n necessary documents issued by the competent doctor to\n\n&quot;&quot;&quot;\\\n\n\n\n(1\n\nshow the nature of injuries and the extent of disability&#039;\n\nsuffered by him. At the same time the claimant ha:s&quot;&#039;\u00bbalso\n\nexamined two independent witnesses who \n\nalong with him at the time of the acciden.t_l:...,,pl(jIE\ufb01.itlted&#039;ly#K2i,.,,\n\nthose two persons were also enigaged \n\nherein for the purpose of cutti&#039;ng the&quot;&#039;t_re&#039;es anrdiu-lii,\u00bbhe evideril-:e&quot;~.r\n\nof the said two witnesses as  is not\ndenied or challenged  aijpprelrllajintsnhereinleading either\noral or documentary e\\v\/i.d.e:nc.e  iesl&#039;.ab&#039;lisVh,rr--.t-hat the claimant\nand the  imeiiemployees working\n\nunder  7\u00bb. \n\n I It  fact that the forest officers do\n\nappoint ther.ca~sual._ |a~bl&#039;o&#039;uru, daily wagers to carryout menial\n\n;_~.I.ike_ felling---,----..\u00ab\u00abconversion extraction, regeneration,\n\n and buildings, etc. As could be seen from\n\nthelllkarnatallraz Forest Code it is very clear about the rights of\n\n the Forest Officers to get the said works done by casual and\n\n  wage employees. In this proceedings, on behalf of the\n\n appeliants one of its official, namely, Mr. S.R. Prasanna\n\nKumar, Range Forest Officer has given evidence. The said\n\n&#039;&quot;&quot;&quot;\\\n\n\n\nperson is the person incharge of the registers containing the\nnames of casual and daily wage employees. Nothing\n\nprevented this person to produce the said register&quot;ats&quot;-wefllvvas\n\nthe register maintained by them for petty cash \n\nwherein the casual and daily wage&#039;&#039;em&#039;p&#039;i.oyee:s&#039;Vi&#039;were}pa&#039;i\u00bbd &#039;\n\nwith the wages as and when thely;_ar-elpA&#039;empi&#039;oyed,\u00ab.\n\nthat claimant was not emplo&#039;ye&#039;d..y&#039;by the. at any&quot;\n\npoint of time to do any work&quot; w_i&#039;thVih._the&#039;\u00abaf&#039;oresaid range\nforest area and that his iisijnot in any of those\n\nregisters.\n9. &quot;&quot;   cili\u00e9.-a~rly&#039;.lhdicate&#039;s&quot; that sufficient opportunity\nwas av&#039;aiyiaoiei to&#039;tiie.%Va\u00bbpgoeii:i:aote herein before the trial Court\n\nto estabfis&#039;h&quot;by&quot;dVoc.urri.ent~aVry evidence that the claimant was\n\n&quot;&quot;\u00ab.._&#039;not:o.jwo;r.ltii:g unAd&#039;erv------t-hem which they have not utilised. On\n\nthe &quot;cori&#039;trary~,.Vg&#039;ti1.e claimant has not only given oral evidence\n\nto show he was working under the appellants herein as\n\ncasual employee by examining two independent witnesses,\n\n&quot;:lf&#039;wVho&quot;*r_were working in the forest along with him under the\n\n appellants herein at the relevant time. He has also\n\nW .\n\n\n\nproduced evidence to show that while working so the\n\nrespondent has suffered the aforesaid injuries.\n\n10.
