Whether the records of AERO A-32 office are duly catalogued and indexed as<br \/>\n      mandated by Section 4(1)(a) of the RTI Act?\n<\/p>\n<p>   2. Power and duties of each officer and employee of AERO AC-32.\n<\/p>\n<p>   3. Procedure followed by AERO AC-32 office in decision making process including<br \/>\n      channel of supervision and accountability.\n<\/p>\n<p>    4. Provide details of rules, instructions, manuals and records held by AERO AC-32<br \/>\n       or under its control or used by its employees for discharging its functions.\n<\/p>\n<p>   5. Provide categories of documents that are held by AERO AC-32 or under its<br \/>\n       control.\n<\/p>\n<p>   6. Provide details of budget allotted to AERO AC-32 indicating the particulars of all<br \/>\n       plans, proposed expenditures and reports on disbursements made during last 2<br \/>\n       years.\n<\/p>\n<p>   7. Particulars of facilities provided by AERO AC-32 to citizens for obtaining<br \/>\n       information.\n<\/p>\n<p>   8. Has the office of AERO AC-32 displayed necessary boards about RTI Act, details<br \/>\n       of PIO and FAA?\n<\/p>\n<p>   9. Does the office of AERO have complaint books and suggestion box available for<br \/>\n       lodging complaints by public?\n<\/p>\n<p>   10. Procedure of registering grievances against the office of AERO AC-32. Has the<br \/>\n       office of AERO AC-32 displayed necessary boards about it?\n<\/p>\n<p>Reply of the Public Information Officer (PIO):<br \/>\nNot on record.\n<\/p>\n<p>Grounds for the First Appeal:\n<\/p>\n<p>No information was furnished by the PIO.\n<\/p>\n<p>Order of the First Appellate Authority (FAA):<br \/>\nThe FAA observed that the information provided to the Appellant was unsatisfactory.<br \/>\nThe AERO- 32 (Uttam Nagar) has taken an arbitrary and negative stand in his reply and<br \/>\nhas attempted to block the flow of information. The AERO- 32 was directed to provide<br \/>\nproper, detailed reply to each question raised in the RTI application within 3 working<br \/>\ndays.\n<\/p>\n<p>Grounds for the Second Appeal:\n<\/p>\n<p>Non- compliance of the order of the FAA.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Commission has perused the documents submitted by the Appellant. The FAA has<br \/>\ngiven a clear order dated 28\/06\/2010 directing the AERO-32, the deemed PIO to provide<br \/>\nthe Appellant with a reply within 3 working days. The Appellant has not been provided<br \/>\nwith the information requested for despite the order of the FAA. The Commission<br \/>\ntherefore directs the PIO\/ SDM and AERO- 32, the deemed PIO to provide the<br \/>\ninformation requested for by the Appellant. Denial of information to an Appellant under<br \/>\nthe RTI Act can only be done if what is sought is not &#8220;information&#8221; as defined under<br \/>\nSection 2(f) of the RTI Act or is exempt under Section 8(1) of the RTI Act. The PIO\/<br \/>\nSDM and AERO- 32, the deemed PIO have neither claimed that it is not &#8220;information&#8221;<br \/>\nnor have they claimed that it is exempt under Section 8(1) of the RTI Act.\n<\/p>\n<p>The Appeal is allowed. The PIO\/ SDM and the AERO- 32, the deemed PIO are<br \/>\ndirected to provide the information requested by the Appellant before August 23,<br \/>\n2010.\n<\/p>\n<p> From the facts before the Commission it is apparent that the PIO\/ SDM and AERO- 32,<br \/>\nthe deemed PIO are guilty of not furnishing information within the time specified under<br \/>\nSection 7(1) by not replying within 30 days as per the requirement of the RTI Act. The<br \/>\nAERO- 32, the deemed PIO has further refused to obey the orders of the FAA, which<br \/>\nraises a reasonable doubt that the denial of information may also be mala fide. The FAA<br \/>\nhas clearly ordered the information to be given. It appears that the actions of the PIO\/<br \/>\nSDM and AERO- 32, the deemed PIO attract the penal provisions of Section 20(1) of the<br \/>\nRTI Act. A show cause notice is being issued to them and they are directed to give their<br \/>\nreasons to the Commission to show cause why penalty should not be levied on them.\n<\/p>\n<p>The PIO\/ SDM and AERO- 32, the deemed PIO will present themselves before the<br \/>\nCommission at the above address on September 1, 2010 at 12:30 pm along with their<br \/>\nwritten submissions showing cause why penalty should not be imposed on them as<br \/>\nmandated under Section 20(1) of the RTI Act. They will also submit proof of having<br \/>\ngiven the information to the Appellant.\n<\/p>\n<p>If there are other persons responsible for the delay in providing the information to the<br \/>\nAppellant and for not complying with the order of the FAA, the PIO\/ SDM and AERO-<br \/>\n32, the deemed PIO are directed to inform such persons of the show cause hearing and<br \/>\ndirect them to appear before the Commission with them.<br \/>\nNotice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n<p>                                                                                           Shailesh Gandhi<br \/>\n                                                                                 Information Commissioner<br \/>\n                                                                                            August 2, 2010<\/p>\n<p>(In any correspondence on this decision, mention the complete decision number.)
