JUSTICE M.E.N.PATRUDU\n\n\nCriminal Appeal(MD) No.958 of 2002\n\n\nK.Kuttai Sekar \t\t..  \tAppellant\n\n\nvs.\n\t\t\t\t\t\t\t\t\n\nState of Tamilnadu,\nRep. by Inspector of Police,\nParamakudi Town Police Station\nCr.No.296 of 2000 \t\t..   \tRespondent\n\n\n\tCriminal Appeal under Section 374 of the Criminal Procedure preferred\nagainst the Judgment dated 15.2.2002 made in S.C.No.88\/2001 by the Court of\nAdditional Sessions Fast Track Judge, Ramanathapuram.\n\n\n!For appellant\t \t...\tMr.A.P.Muthupandian\n\n\n^For respondent   \t...\tMr.K.Radhakrishnan,\n                           \tAddil.Public Prosecutor\n\n\n:JUDGMENT\n<\/pre>\n<p>(Judgment of the Court was delivered by M.E.N.PATRUDU, J)<\/p>\n<p>\tThe appeal arises from the Judgment dated 15.2.2002 rendered in S.C.No.88<br \/>\nof 2001 by the Court of Additional Sessions Fast Track Judge at Ramanathapuram.<br \/>\nThe learned Addl.Sessions Judge convicted the sole appellant for an offence<br \/>\nunder Section 302 and 341 of the IPC and awarded life sentence and a fine of<br \/>\nRs.500\/- and in default of fine, to undergo rigorous imprisonment for one month.\n<\/p>\n<p>\t2.  The facts relevant for the disposal of the appeal are as follows:\n<\/p>\n<p>\t    Marimuthu, the deceased and the accused\/appellant are friends and the<br \/>\naccused is a rickshaw puller.  There was some quarrel between them at Paramakudi<br \/>\nriver bridge and the deceased bate the accused.  The appellant borne grudge and<br \/>\non the next day i.e. On 16.5.2000, the appellant found the deceased standing in<br \/>\nfront of PW.2&#8217;s mobile fruit shop and went there and picked a knife from PW.2&#8217;S<br \/>\nfruit shop and attempted to hit the deceased and due to intervention of PW.2, he<br \/>\ncould not and little later beat the deceased on the left chest with the knife<br \/>\ntaken out from mutton shop and ran away.  The wife of the deceased, viz., PW.1<br \/>\nlodged a complaint with the police and an F.I.R. was registered in Crime No.296<br \/>\nof 2000 and after due investigation charge sheet was laid.\n<\/p>\n<p>\t3. During the course of trial PW.1 to PW.13 were examined and Exs.P1 to<br \/>\nP13 and M.Os.1 to 7 have been marked on the side of the prosecution.  However,<br \/>\nno one was was examined on the side of the accused and no exhibits were also<br \/>\nmarked.\n<\/p>\n<p>\t4. The  Post-mortem  Doctor  (PW.4)  opined  that  the<br \/>\ndeceased died due to shock and haemarrage  due to the injuries to vital organs<br \/>\ni.e. Heart and lungs.  The learned Addl.Sessions Judge convicted the appellant.\n<\/p>\n<p>\t5. Learned counsel for appellant Mr.A.P.Muthupandian very fairly stated<br \/>\nthat he is not arguing for a clean acquittal of the case of the accused because<br \/>\nthe evidence on record clearly establishes that the appellant beat the deceased<br \/>\nbut it is without any intention, without any pre-plan, and it is purely because<br \/>\nof petty quarrel of the previous day and  the incident is without any pre-<br \/>\nmeditation.\n<\/p>\n<p>\t6. Further, learned counsel for the appellant argued for mercy and fairly<br \/>\nsubmitted that this case is squarely falling under section 304(ii) of the IPC<br \/>\nand the appellant has been in jail for the past four years and hence the same<br \/>\nmay be considered.\n<\/p>\n<p>\t7. Learned Addl.Public Prosecutor, however, strongly opposed.  Perused the<br \/>\nevidence on record.\n<\/p>\n<p>\t8. We are in complete agreement with the argument of<br \/>\nthe learned counsel appearing for the appellant.  Our attention has been drawn<br \/>\nto various portions of the evidence of the witnesses.  In our considered<br \/>\nopinion, the evidence of the prosecution witness is trustworthy.  Therefore, we<br \/>\nhold that the death is of the homicide and it is due to the injuries caused by<br \/>\nthe appellant.\n<\/p>\n<p>\t9. Now, it has to be considered whether the appellant had any intention to<br \/>\ncause such injury and had any knowledge that such injury would lead to the death<br \/>\nof the deceased?\n<\/p>\n<p>\t10. The evidence clearly establishes that on 16.5.2000 at about 10.00a.m.,<br \/>\nthe appellant found the deceased standing near PW.2&#8217;s fruit shop and<br \/>\nimmediately, he took out the knife from PW.2&#8217;s fruit shop and tried to attack<br \/>\nthe deceased and due to intervention of PW.2 and PW.3, the problem was subsided<br \/>\nbut the  appellant, thereafter,  took out a knife from mutton stall in front of<br \/>\nshop No.56 and inflicted injury on the left side of the chest.  Thus, the<br \/>\nevidence is establishing that the appellant has inflicted injury on the chest.<br \/>\nBut, the fact is that the appellant was not carrying any knife with him.  If he<\/p>\n<p>had an intention to kill the deceased, he would have planned straight away and<br \/>\ncomplete the offence.  But, on the other, the appellant attacked the deceased at<br \/>\n10.00a.m. in front of many people and it is purely because the previous day&#8217;s<br \/>\nquarrel.  Therefore, the appellant suddenly attacked the deceased and it is<br \/>\nwithout any intention.\n<\/p>\n<p>\t11. We hold that we agree with the contention that the offence of the case<br \/>\ndoes not attract either Section 302 IPC or Section 341 IPC but it is a clear<br \/>\ncase attracting Section 304(ii) of the IPC as the appellant inflicted injury on<br \/>\nthe chest, which is the vital part of the body and the deceased died due to such<br \/>\ninjury.\n<\/p>\n<p>\t12. Under the above facts and circumstances, we hold that the case of the<br \/>\nprosecution is established but the conviction under Section 302 read with 341 of<br \/>\nthe IPC is to be modified to one of  Section 304(ii) and the sentence of<br \/>\nimprisonment for life is to be reduced to a sentence of six years.\n<\/p>\n<p>13.  In the result, the appeal is partly allowed and the<br \/>\nconviction and sentence under Section 302 of the IPC is modified into one under<br \/>\nSection 304(ii) of the IPC and sentenced to undergo Rigorous Imprisonment for<br \/>\nsix years.\n<\/p>\n<p>asvm<\/p>\n<p>To<\/p>\n<p>1.
