(3)  48\n 1991 SCC  (2) 198\t  JT 1990 (4)\t590\n 1990 SCALE  (2)1102\n\n\nACT:\n    Army  Act, 1950\/Army Rules, 1954  Sections 80,  83,\t 84,\n85\/Rules  22,  25, 53,\t177---Commanding  Officer  directing\ndisciplinary  action against a Major--Proceedings  initiated\nand  summary trial ordered-Major opting to accept the  award\nof    Court   Martial\t reprimand    recommended--Affecting\npromotion--Validity of proceedings.\n\n\n\nHEADNOTE:\n    The\t petitioner was commissioned in the Indian  Army  in\nJanuary\t 1959  and was promoted to the substantive  rank  of\nMajor  on  March 11, 1983. In January 1986,  the  petitioner\njoined\t63rd Fd. Regiment. The 24th Rising Day of  the\tUnit\nfell  on September 1, 1986. In connection with the  celebra-\ntions of the said Day, the petitioner went to respondent No.\n2,  Regimental Medical officer of the Unit, at\tabout  10.30\np.m. on 29.8.86 to pursuade him loan his steel almirah,\t for\ntwo  or\t three days. Respondent No. 2 refused  to  loan\t the\nAlmirah to the Petitioner which led to hot exchange of words\nbetween them at about 11.00 p.m. Thereupon Respondent No.  2\nlodged\ta complaint with the Commanding Officer that he\t had\nbeen beaten by the petitioner. The Commanding Officer visit-\ned the quarters of the Respondent No. 2 at about 15  minutes\npast  midnight of 29\/30th August 1986. He made some sort  of\ninquiries at that time and made a noting that the accusation\nmade  by respondent No. 2 against the petitioner was  unsub-\nstantiated.  It\t appears Respondent No. 2 at that  point  of\ntime was not able to participate in the investigation due to\nhead injuries received by him. However the documents  reveal\nthat respondent No. 2 had to be hospitalised as a result  of\ninjuries received by him at the hands of the petitioner.  In\nor  about September 1986, a staff court of inquiry was\theld\nwhich  opined  that due to contradictions and lack  of\tevi-\ndence,\tit was not possible to pin-point the blame  for\t in-\njuries\tsustained  by respondent No. 2. The  proceedings  of\nthe  court of inquiry were later reviewed by the  Commanders\nin chain upto General Officer Commanding 4 Corps who came to\nthe  conclusion\t that there  was  sufficient  circumstantial\nevidence,  corroborated by independent evidence of the\thead\ninjuries  suffered  by\trespondent No. 2  showing  that\t the\npetitioner  was\t responsible for the  same.  The  Commanding\nofficers,  therefore, inter alia directed that\tdisciplinary\naction be taken against the petitioner for causing  injuries\nto respondent No. 2\n49\nand  further  the  case be dealt with summarily\t by  GOC,  2\nMountain Division. Accordingly Disciplinary proceedings were\ninitiated  and a summary of evidence against the  petitioner\nwas  recorded. After recording the evidence, the  Commanding\nOfficer\t remanded  the\tpetitioner to the  GOC,\t 2  Mountain\nDivision,  for\tsummary trial under section 84 of  the\tArmy\nAct, 1950. The petitioner was attached to 54 Fd Regiment for\npurposes of completing the disciplinary action against\thim.\nAt  the trial, the petitioner pleaded not guilty,  but\twhen\nasked  by the GOC as to whether he would elect to  face\t the\ntrial by the General Court Martial or would accept the award\npassed\tby the General Officer Commanding, 2 Mountain  Divi-\nsion,  the petitioner opted to accept the award of the\tGOC.\nThe  petitioner\t was  thereupon awarded\t the  punishment  of\nsevere\treprimand. By the instant petition under Article  32\nthe petitioner seeks the quashing of the sentence of 'severe\nreprimand', as according to him his promotion is held up  on\nthat account.\nDismissing the petition, this Court,\n    HELD:  A perusal of sub-rule (i) of Rule 22\t shows\tthat\nthe rule deals with the charges against a person subject  to\nthe Army Act other than officers. Admittedly, the petitioner\nin the instant case was an officer and hence, the provisions\nof  Rule  22 had no application to it. It is Rule  25  which\nlays  down the procedure in respect of the  charges  against\nthe officers and it contains no provisions analogus to\tsub-\nrule (2) of Rule 22 of the Army Rules. In view of this, Rule\n22 does not come into play at all. [53B-D]\n    The provisions of sub-rule (i) of the Rule 177 show that\nthe inquiry must be by an assembly of officers of the  ranks\ndescribed in sub-rule (1) and the purpose of this inquiry is\nmerely\tto  collect evidence and if so required,  to  report\nwith regard to any matter which may be referred to the\tsaid\nofficers.  This\t is merely in the nature  of  a\t preliminary\ninvestigation and cannot be equated with a trial. [53F]\n    From his record it appears that, apart from his  impetu-\nousness exhibited by the incident in question, the petition-\ner  is considered by his superiors to be a good officer\t and\nafter a reasonable time, the army authorities could consider\nhim  for promotion if permissible under the law,  the  rules\nand the practice followed in the army.
