Justice ANTONY DOMINIC\n\n Dated :11\/09\/2007\n\n O R D E R\n                    ANTONY DOMINIC, J.\n                   ===============\n                  O.P NO. 18975 OF 1999\n               ====================\n\n        Dated this the 11th day of September, 2007\n\n                       J U D G M E N T\n<\/pre>\n<p>     The prayer in this original petition is to quash Ext.P4<\/p>\n<p>and to direct the respondents to return 18 logs of timber<\/p>\n<p>which was seized from a mill in Perumbavoor. It is noticed<\/p>\n<p>that even according to the petitioner, he had sold 18 logs of<\/p>\n<p>timber to the mill in Perumbavoor, from which these were<\/p>\n<p>seized by the forest authorities. Subsequent to the seizure,<\/p>\n<p>the mill owner had lodged a claim as per Ext.P3.          With<\/p>\n<p>notice to him, the matter was decided and was ordered to<\/p>\n<p>be confiscated as per Ext.P4. The contention of the<\/p>\n<p>petitioner is that he was the actual owner and that he<\/p>\n<p>should have been put on notice, before Ext.P4 order was<\/p>\n<p>passed.\n<\/p>\n<p>     In my view, even according to the petitioner, as he had<\/p>\n<p>sold the logs to the mill owner, even if notice was not issued<\/p>\n<p>OP 18975\/99<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>to the petitioner, the proceedings will not get vitiated. Since<\/p>\n<p>he had already passed over the title of the goods to the mill<\/p>\n<p>owner, none of his rights are affected.
