     This is revision registered on receipt<\/p>\n
of   petition   from   the   accused   from   prison<\/p>\n
complaining   of   the   correctness   of   the<\/p>\n
conviction and sentence passed against him<\/p>\n
by the Judicial First Class Magistrate-II,<\/p>\n
Kannur   in   C.C.642\/1995   on   the   file   of   his<\/p>\n
court   confirmed   in   appeal   by   the   Sessions<\/p>\n
Judge,   Thalassery   in   Criminal   Appeal<\/p>\n
No.226\/1997.\n<\/p>\n
     2.   The   petitioner   was   the   accused   in<\/p>\n
C.C.642\/95   on   the   file   of   the   Judicial<\/p>\n
First   Class   Magistrate’s   Court-II,   Kannur<\/p>\n
for   offence   punishable   under   Section   379<\/p>\n
of   IPC   he   having   been   charge   sheeted   by<\/p>\n
Crl. R. P. No.275 of  2002      -2-<\/span><\/p>\n
       the   S.H.O.,   Valapattanam   in   Crime   No.160\/94<\/p>\n
       of Valapattanam Police Station.\n<\/p>\n
              3. The allegation is that during night<\/p>\n
       on 12-05-1994, he committed theft of a car<\/p>\n
       stereo   worth   Rs.4,000\/-   from   the   car<\/p>\n
       bearing   registration  No.KEZ  1828  belonging<\/p>\n
       to   PW1   which   was   parked   in   the   car   porch<\/p>\n
       of   the   house   of   PW1   situated   in   Puzhathi<\/p>\n
       desom of Chirakkal amsom. On the next day,<\/p>\n
       by   about   7.00   am,   when   PW1   attempted   to<\/p>\n
       take the car, it was found that the stereo<\/p>\n
       set   was   missing   from   the   car   which   was<\/p>\n
       worth   Rs.4,000\/-.   Immediately,   she   gave<\/p>\n
       Ext.P5 F.I. statement to the Police at the<\/p>\n
       Valapattanam   Police   Station.   PW7,   the<\/p>\n
       A.S.I   attached   to   the   said   Police   Station<\/p>\n

       conducted   preliminary  investigation  in  the<\/p>\n
       case.   As   the   Police   could   not   detect<\/p>\n
       either           the         material         object         or         the<\/p>\n
       offender,   the   case   was   transferred   to   the<\/p>\n
       register   of   undetected   cases.   In   the<\/p>\n
       meanwhile,   on   13.03.1995,   PW6,   the   Sub<\/p>\n
       Inspector   of   Police,   Kannur   effected<\/p>\n
       arrest   of   the   petitioner\/accused   from   the<\/p>\n
       Muncipal   bus   stand   when   he   was   found   in   a<\/p>\n
       suspicious   circumstances   carrying   a   box.\n<\/p>\n
       On   questioning   by   the   Police,   he   was   not<\/p>\n
       able   to   give   satisfactory   explanation   for<\/p>\n
       his   possession   of   the   box   which   contained<\/p>\n
       the   car   stereo   set.   He   was   taken   to   the<\/p>\n
       Police   Station   and   on   questioning   by   PW6,<\/p>\n
       it   is   alleged   that   the   petitioner   gave<\/p>\n

       Ext.P3(a)   information   to   PW6   and   that   on<\/p>\n
       the   basis   thereof   and   with   the   assistance  of<\/p>\n
       the   petitioner\/accused,   he   could   effect<\/p>\n
       recovery   of   MO1   stereo   set   from   PW3   who<\/p>\n
       was   the   purchaser   thereof   from   the   accused,<\/p>\n
       under Ext.P3 Mahazar attested also by PW4.\n<\/p>\n
              4.   As   the   place   of   occurrence   was<\/p>\n
       within   the   territorial   limits   of   Valapattanam<\/p>\n
       Police   Station,   he   transmitted   the   case<\/p>\n
       records to the Valapattanam Police Station<\/p>\n
       where   PW7   and   after   him   his   successor   in<\/p>\n
       office   conducted   investigation   in   the   case.\n<\/p>\n
       MO1   was   got   identified   through   PW1   and<\/p>\n
       after   due   investigation   the   Police   laid<\/p>\n
       charge against him. The learned Magistrate<\/p>\n
       heard   preliminary   arguments   in   the   case<\/p>\n

       and   framed   charge   against   the   petitioner<\/p>\n
       for   offence   under   Section   379   IPC.   As   he<\/p>\n
       denied the charge, a trial of the case was<\/p>\n
       conducted.   Prosecution   examined   PWs.1   to<\/p>\n
       7,   got   marked   Exts.P1   to   P5   and   got<\/p>\n
       identified MO1. On the prosecution closing<\/p>\n
       their evidence, the accused was questioned<\/p>\n
       under   Section   313   Cr.P.C.   Thereupon,   he<\/p>\n
       generally   denied  all  incriminating  circum-\n<\/p>\n
       stances   appearing   in   evidence   against   him<\/p>\n
       and   maintained   that   he   is   innocent.\n<\/p>\n
       According   to   him,   the   case   is   one   falsely<\/p>\n
       foisted against him.\n<\/p>\n
              5.   The   learned   Magistrate   considered<\/p>\n
       the   case   in   the   light   of   the   evidence<\/p>\n
       adduced as aforesaid, found the petitioner<\/p>\n

       guilty   of   the   offence   punishable   under<\/p>\n
       Section   379   IPC,   convicted   him   thereunder<\/p>\n
       and   sentenced   him   to   undergo   rigorous<\/p>\n
       imprisonment   for   a   term   of   two   years.   The<\/p>\n
       petitioner,   filed   Criminal   Appeal   No.226\/97<\/p>\n
       before the Sessions Court, Thalassery. The<\/p>\n
       Sessions   Judge,   confirmed   the   conviction<\/p>\n
       and sentence passed against him and hence,<\/p>\n
       this revision.\n<\/p>\n
              6.   It   is   contended   before   me   by   the<\/p>\n
       learned   Counsel   appearing   on   State   Brief<\/p>\n
       for the petitioner that there is no proper<\/p>\n
       identification of MO1 as PW1 had not given<\/p>\n
       the   number   of   MO1   in   the   F.I.   Statement,<\/p>\n
       though   he   has   given   those   details   in   his<\/p>\n
       deposition   as   PW1.   It   is   worthy   to   note<\/p>\n

       that a person who has owned an article may<\/p>\n
       be   able   to   identify   the   said   article   on<\/p>\n
       sight   though   he   may   not   be   having   any<\/p>\n
       specific   identification   mark   to   be   mentioned.\n<\/p>\n
       Further,   on   seeing   that   the   stereo   set   is<\/p>\n
       stolen   from   her   car,   PW1   has   given   F.I.\n<\/p>\n
       statement   immediately  without  perusing  the<\/p>\n
       records   of   purchase   thereof.   Obviously,<\/p>\n
       then   she   will   not   be   able   to   give   the<\/p>\n
       details   of   MO1   such   a   number   etc.   But   at<\/p>\n
       the   same   time,   when   the   culprit   is<\/p>\n
       arrested and it is learned that the MO1 is<\/p>\n
       recovered   at   his   instance,   it   is   natural<\/p>\n
       that PW1 would verify the identity thereof<\/p>\n
       with the records and then get confirmed as<\/p>\n
       to   its   identity.   The   fact   that   MO1   had<\/p>\n

       been   stolen   in   the   night   on   12.05.1994   is<\/p>\n
       evidenced   from   the   fact   that   on   the   very<\/p>\n
       next   day,   PW1   had   given   Ext.P1   F.I.\n<\/p>\n
       Statement   to   the   Police.   Though   PW5,   the<\/p>\n
       A.S.I   could   not   trace   out   the   culprit,<\/p>\n
       when   PW6   effected   arrest   of   the   accused<\/p>\n
       under   suspicious   circumstances   on   the   basis<\/p>\n
       of   Ext.P3(a)   information   furnished   to   him<\/p>\n
       by   the   accused,   he   could   effect   recovery<\/p>\n
       of   MO1   under   Ext.P3   Mahazar   attested   also<\/p>\n
       by   PW4   from   PW3   who   was   the   purchaser<\/p>\n
       thereof   from   the   accused.   There   is   no<\/p>\n
       valid challenge on the testimony of PW3 as<\/p>\n
       regards his testimony that MO1 was sold to<\/p>\n
       him by the accused. If at all, MO1 was not<\/p>\n
       being          purchased          by         PW3         from         the<\/p>\n

       petitioner\/accused,   he   would   not   have<\/p>\n
       surrendered   it   to   PW6   on   his   approaching<\/p>\n
       him   along   with   the   petitioner\/accused   and<\/p>\n
       given   evidence   in   support   thereof.   The<\/p>\n
       seizure   of   MO1   from   PW3   under   Ext.P3<\/p>\n
       Mahazar   goes   a   long   way   to   establish   the<\/p>\n
       guilt in the accused as it is on the basis<\/p>\n
       of   Ext.P3(a)   information   furnished   by   the<\/p>\n
       accused   that   PW6   was   able   to   effect<\/p>\n
       recovery   of   MO1   from   PW3   to   whom   the<\/p>\n
       petitioner\/accused   disclosed   that   he   has<\/p>\n
       sold   MO1.   Thus,   there   is   sufficient<\/p>\n
       evidence   in   the   case   to   bring   home   the<\/p>\n
       guilt   in   the   accused.   It   was   therefore,<\/p>\n
       that   the   learned   Magistrate   convicted   him<\/p>\n
       for offence under Section 379 IPC. The said<\/p>\n

       conviction was rightly being confirmed  by the<\/p>\n
       Sessions   Judge   in   appeal.   There   is   no<\/p>\n
       illegality   or   impropriety   in   the   conviction<\/p>\n
       and   sentence   so   entered   into   concurrently<\/p>\n
       by   the   courts   below.   The   sentence   awarded<\/p>\n
       to   the   appellant   is   also   moderate,<\/p>\n
       reasonable   and   legal   and   there   is   no<\/p>\n
       reason   to   interfere   with   the   sentence   as<\/p>\n
       well.   This   revision   in   the   circumstances,<\/p>\n
       is devoid of merit.\n<\/p>\n
                7.   In   the   result,   confirming   the<\/p>\n
       conviction and sentence passed against the<\/p>\n
       petitioner   concurrently   by   the   courts<\/p>\n
       below, I dismiss this Criminal Revision.\n<\/p>\n
