BASANT, J.\n\n              -------------------------------------------------\n\n                       CRL.M.C.NO. 87 OF  2007\n\n              -------------------------------------------------\n\n            Dated this the 11th day of January, 2007\n\n\n                                  ORDER\n<\/pre>\n<p>      The  petitioner is  the   2nd  accused  in   a prosecution,  inter<\/p>\n<p>alia, under Sec.324 read with Sec.149 of the IPC.  Some of the<\/p>\n<p>co-accused   have   already   been   tried,   found   not   guilty   and<\/p>\n<p>acquitted.  The petitioner was not available for trial.  The case<\/p>\n<p>against   him   has   been   split   up.     The   petitioner   now   wants   to<\/p>\n<p>appear before the learned Magistrate.  He apprehends that his<\/p>\n<p>application   for   regular   bail   may   not   be   considered   by   the<\/p>\n<p>learned   Magistrate   on   merits,   in   accordance   with   law   and<\/p>\n<p>expeditiously.   He has hence come to this Court with a prayer<\/p>\n<p>that directions may be issued under Sec.482 of the Cr.P.C. to<\/p>\n<p>the   learned   Magistrate   to   release   him   on   bail   when   he<\/p>\n<p>surrenders and applies for bail.\n<\/p>\n<\/p>\n<p>      2.     It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate.   I have no reason to assume that the<\/p>\n<p>learned   Magistrate   would   not   consider   the   petitioner&#8217;s<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 87 OF  2007                  -: 2 :-<\/span><\/p>\n<p>application for regular bail on merits in accordance with law and<\/p>\n<p>expeditiously.       No   special   or   specific   directions   appear   to   be<\/p>\n<p>necessary.     Every   court   must   do   the   same.       Sufficient   general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<\/p>\n<p>        3.       In   the   result,   this   Crl.M.C.   is   dismissed;   but   with   the<\/p>\n<p>observation  that if  the petitioner surrenders before  the  learned<\/p>\n<p>Magistrate   and   seeks  bail   after   giving   sufficient   prior   notice   to<\/p>\n<p>the   Prosecutor   in   charge   of   the   case,   the   learned   Magistrate<\/p>\n<p>must   proceed   to   pass   appropriate   orders   on   merits   and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself, unless compelling<\/p>\n<p>and exceptional reasons are there.\n<\/p>\n<\/p>\n<p>                                                                      Sd\/-\n<\/p>\n<p>\n                                                         (R.
