No. 3819 of 2008\n         -------------------------------------------------\n       Dated this the 15th day of October, 2008\n\n                            ORDER\n<\/pre>\n<p>     The petitioner, who faces indictment as the 2nd<\/p>\n<p>accused in a prosecution under Sec.138 of the Negotiable<\/p>\n<p>Instruments Act; who had entered appearance before the<\/p>\n<p>learned Magistrate and was enlarged on bail earlier; who<\/p>\n<p>had promptly appeared before the court either personally<\/p>\n<p>or through his counsel on all dates of posting till 30\/9\/08;<\/p>\n<p>who could not unfortunately appear before the court on<\/p>\n<p>30\/9\/08; whose counsel also could not present before court<\/p>\n<p>on that day and against whom a warrant of arrest has been<\/p>\n<p>issued by the learned Magistrate to procure his presence,<\/p>\n<p>has now come to this Court with this petition              under<\/p>\n<p>Section 482 Cr.P.C. with a prayer that direction may be<\/p>\n<p>issued to ensure that      the dictum in       <a href=\"\/doc\/1236335\/\">Alice George v.<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No.<\/span><\/a> 3819 of 2008         2<\/p>\n<p>Dy.S.P. of Police (2003 (1) KLT 339) is complied with and that<\/p>\n<p>the petitioner&#8217;s  application for regular bail is considered on<\/p>\n<p>merits, in accordance with law and expeditiously &#8211; on the date of<\/p>\n<p>surrender itself.\n<\/p>\n<p>     2.   I  am not persuaded to agree      that any   special or<\/p>\n<p>specific direction deserves to be issued.      Sufficient general<\/p>\n<p>directions have already been issued by this Court in the decision<\/p>\n<p>in Alice George (supra). I am not satisfied that any special or<\/p>\n<p>separate direction deserves to be issued in each case to the<\/p>\n<p>learned Magistrate to comply with the directions in        Alice<\/p>\n<p>George (supra).     I have no reason to assume that the learned<\/p>\n<p>Magistrate shall not follow the      decision in Alice George<\/p>\n<p>(supra).   If  there   be  non-compliance,     the   avenues   of<\/p>\n<p>challenge\/complaint are available to the petitioner.<\/p>\n<p>     3.   This application  is   dismissed, but with the above<\/p>\n<p>specific observations.\n<\/p>\n<p>     4. In the peculiar facts and circumstances of this case,<\/p>\n<p>there shall be a direction that the coercive processes issued<\/p>\n<p>against the petitioner shall not be executed till 29\/10\/08 &#8211; the<\/p>\n<p>next date on which the case is posted.   On or before that date,<\/p>\n<p>the petitioner shall surrender before the learned Magistrate and<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 3819 of 2008          3<\/span><\/p>\n<p>seek regular bail.\n<\/p>\n<p>     5. Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioner.\n<\/p>\n<\/p>\n<p>                                                 Sd\/-\n<\/p>\n<p>                                      (R.
