Jani, learned<br \/>\n\tAdditional Public Prosecutor, waives service of Rule on behalf of<br \/>\n\tthe respondent-State.\n<\/p>\n<p>Present<br \/>\n\tapplication is filed by the applicant under Section 389 of the Code<br \/>\n\tof Criminal Procedure, 1973 to suspend the sentence imposed upon him<br \/>\n\tvide order dated 18th December 2010 passed by the learned<br \/>\n\tSessions Judge, Patan in Sessions Case No.25 of 2009 by releasing<br \/>\n\tthe applicant-accused on bail during the pendency of the appeal.\n<\/p>\n<p>The<br \/>\n\tlearned Sessions Judge, Patan by his judgment and order dated 18th<br \/>\n\tDecember 2010 convicted the applicant for the offences punishable<br \/>\n\tunder Section 326 of the Indian Penal Code and ordered to undergo<br \/>\n\trigorous imprisonment for a period of two-and-half-years and also<br \/>\n\timpose fine of Rs.05,000\/-.\n<\/p>\n<p>Heard<br \/>\n\tMr.Devang Joshi, learned counsel for the applicant and Mr.H.L. Jani,<br \/>\n\tlearned Additional Public Prosecutor for the respondent-State.\n<\/p>\n<p>Mr.Joshi<br \/>\n\thas contended that the applicant is on bail today and fine amount<br \/>\n\thas also been deposited by the applicant.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced before me as well as the<br \/>\n\tjudgment and order of conviction passed by the learned Sessions<br \/>\n\tJudge, Patan.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the case, I am of the opinion that this is a fit<br \/>\n\tcase to suspend the sentence awarded to the applicant. Hence, the<br \/>\n\tpresent application is hereby allowed. The substantive sentence is<br \/>\n\thereby placed under suspension pending hearing and disposal of the<br \/>\n\tmain appeal and the applicant-original accused is hereby ordered to<br \/>\n\tbe released on bail on his furnishing surety of Rs.10,000\/- and a<br \/>\n\tpersonal bond of the like amount on usual terms and conditions. Rule<br \/>\n\tis made absolute to the aforesaid extent.\n<\/p>\n<p>Direct<br \/>\n\t\t\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
