And whether suit is<br \/>\n\tmaintainable in view of the enactment of the above Act after filing<br \/>\n\tof the suit and more particularly by virtue of Section 7 of the said<br \/>\n\tAct, Sections 81, 82 and 94 of the Indian Trust Act are repealed?\n<\/p>\n<p>Whether,<br \/>\n\ton the facts and circumstances of the case, the suit, claim or<br \/>\n\taction to enforce any right in respect of any property held benami<br \/>\n\twould be maintainable in view of the Benami Transaction<br \/>\n\t(Prohibition) Act, 1988?\n<\/p>\n<p>Whether,<br \/>\n\ton the facts and circumstances of the case, Section 3 of the said<br \/>\n\tAct would apply or Section 4(3)(B) of the said Act would apply to<br \/>\n\tthe present fact situation?\n<\/p>\n<p>Whether,<br \/>\n\ton the facts and circumstances of the case, the lower Appellate<br \/>\n\tCourt is right in holding that Section 4(3)(B) would apply to the<br \/>\n\tpresent fact situation?\n<\/p>\n<p>What<br \/>\n\tis the meaning of &#8220;Fiduciary Relation&#8221; and whether, on<br \/>\n\tthe facts and circumstances of the case, it can be said that<br \/>\n\trelation of uncle (Masa) and nephew is fiduciary relation?\n<\/p>\n<p>2.\tThe<br \/>\nshort facts of the case, briefly stated, are that the plaintiffs<br \/>\nfiled a suit being Special Civil Suit No. 87\/1980 before the Court of<br \/>\nCivil Judge (S.D.), Mehsana for the prayer of declaration that the<br \/>\nplaintiffs are co-owners of the agricultural land with two-third<br \/>\nshare and it may also be declared that the defendants are the<br \/>\nbenamidar holding in a trust for and on behalf of the plaintiffs.<br \/>\nThe said suit, after considering the evidence which has been<br \/>\ndiscussed, came to be dismissed by the learned Civil Judge (S.D.),<br \/>\nMehsana, vide judgment and order dated 5.8.1989.  The said judgment<br \/>\nand order was challenged by way of Regular Civil Appeal No. 16\/2006<br \/>\n(First Appeal No. 1347 of 1989 before the High Court) which came to<br \/>\nbe allowed, whereby the judgment and order passed by the trial court<br \/>\nin Special Civil Suit No. 87\/80 was quashed and set aside for the<br \/>\nreasons discussed therein.\n<\/p>\n<p>3.\tThe<br \/>\nmain focus by the lower appellate court was on  Benami Transaction<br \/>\n(Prohibition) Act and it has been discussed with reference to the<br \/>\nsaid Act as well as the provisions of sec. 81, 82 etc. of the Indian<br \/>\nTrust Act. However, it has also been discussed that even though sec.<br \/>\n82 of Indian Trust Act has been repealed, there was fiduciary<br \/>\nrelation and the appeal was allowed. Therefore, the present Second<br \/>\nAppeal has been preferred by the appellants raising the aforesaid<br \/>\nsubstantial questions of law.\n<\/p>\n<p>4.\tHowever,<br \/>\nafter hearing for some time, both the learned advocates have stated<br \/>\nthat the issue is covered by the judgment of the Hon&#8217;ble Apex Court.<br \/>\nLearned advocate Mr. Mehul Shah has referred to and relied upon the<br \/>\njudgment of the Hon&#8217;ble Apex Court reported in AIR 1989 SC 1247 and<br \/>\nsubmitted that the issue or questions of law sought to be raised in<br \/>\nthis Second Appeal has been decided and squarely covered.  However,<br \/>\nit was pointed out by learned advocate Mr. Parikh that this judgment<br \/>\nhas been subsequently overruled in a judgment in the case of  R.<br \/>\nRajagopal Reddy (dead) by LRs and ors. v. Padmini Chandrasekharan<br \/>\n(dead) by LRs, reported in AIR 1996 SC 238, for which discussions are<br \/>\nto be found in Para 7 &amp; 13.  Learned advocate Mr. Shah has also,<br \/>\nafter perusing the said judgment, fairly stated that the issue is<br \/>\ncovered in this judgment also.\n<\/p>\n<p>5.\tIt<br \/>\nis in this background the substantial questions of law posed in this<br \/>\nSecond Appeal would not survive as it has been covered by the<br \/>\nsubsequent judgment of the Hon&#8217;ble Apex Court in the case of R.<br \/>\nRajagopal Reddy (dead) by LRs and ors. (supra) and therefore the<br \/>\npresent Second Appeal would not survive as there is no substantial<br \/>\nquestion of law and the same has already been decided.\n<\/p>\n<p>6.\tIt<br \/>\nis well-settled that the scope of exercise of discretion under sec.<br \/>\n100 of CPC in the second appeal is very limited and only when there<br \/>\nis substantial question of law involved, as observed in catena of<br \/>\njudicial pronouncements including the judgment of the Hon&#8217;ble Apex<br \/>\nCourt in the case of Gurudev Kaur &amp; ors. v. Kaki &amp; ors.,<br \/>\nreported in (2007) 1 SCC 546 wherein general principles have been<br \/>\nlaid down referring to the scope in Para 70 of the judgment, such<br \/>\ndiscretion is exercised.  It is in these circumstances, the present<br \/>\nappeal deserves to be dismissed and accordingly stands dismissed.\n<\/p>\n<p>7.\tIt<br \/>\ngoes without saying that in light of the disposal of the present<br \/>\nappeal, the procedure which is required to be followed would be<br \/>\nundertaken before the appropriate authority which will be decided in<br \/>\naccordance with law expeditiously.\n<\/p>\n<p>8.\tIn<br \/>\nview of the dismissal of the Second Appeal, the Civil Application<br \/>\nwould not survive and the same is accordingly disposed of.\n<\/p>\n<p>(Rajesh<br \/>\nH.
