NO. 316 OF 2010\n           = = = = = = = = = = = = = = =\n     Dated this the 30th day of September, 2010.\n\n                    J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the award of the<\/p>\n<p>Motor Accidents Claims Tribunal, Ernakulam in O.P.(MV)<\/p>\n<p>224\/03.    It is the case of the claimant that a Maruthi<\/p>\n<p>Car driven by the 2nd respondent hit on the motorbike<\/p>\n<p>ridden by the husband of the claimant and thereby she<\/p>\n<p>sustained injuries. On the other hand the respondent<\/p>\n<p>would contend that the negligence was absolutely on<\/p>\n<p>the side of the husband of the claimant and therefore<\/p>\n<p>the petitioner is not entitled to any compensation. The<\/p>\n<p>Tribunal after analysis of the materials found the driver<\/p>\n<p>of the car negligent and awarded a sum of Rs.17,978\/-.<\/p>\n<p>The respondents, aggrieved by the said decision had<\/p>\n<p>come up in appeal.\n<\/p>\n<p>     2.   Heard both the sides. The accident had taken<\/p>\n<p>place in a junction which joins Mattancherry Fort Kochi<\/p>\n<p>M.A.C.A. 316 OF 2010<br \/>\n<span class=\"hidden_text\">                            -:2:-<\/span><\/p>\n<p>road to Fort Kochi-Amaravathi road.     The motorcycle<\/p>\n<p>was coming from east to west and was turning to the<\/p>\n<p>north to join Fort Kochi Amaravathi road. The car was<\/p>\n<p>coming from Nazareth Fort-Kochi road and it was to join<\/p>\n<p>the junction to proceed to Mattancherry-Fort Kochi road.<\/p>\n<p>     3.   In order to get an idea of the location I<\/p>\n<p>appointed a Commissioner and he had submitted a plan<\/p>\n<p>and report in this matter.    The place of accident is<\/p>\n<p>located by him as shown in the scene mahazar by<\/p>\n<p>marking the points. It is almost on the northern side of<\/p>\n<p>the Mattancherry Fort Kochi road.    Now the question<\/p>\n<p>that may have to be considered is whether the<\/p>\n<p>claimant&#8217;s husband was justified in moving towards the<\/p>\n<p>northern extremity if it is the place of accident or<\/p>\n<p>whether he had to comply with further statutory<\/p>\n<p>requirements. So also the movement of the car and it&#8217;s<\/p>\n<p>turning also requires correction. Unfortunately in this<\/p>\n<p>case though the matter is very seriously contested the<\/p>\n<p>M.A.C.A. 316 OF 2010<br \/>\n<span class=\"hidden_text\">                             -:3:-<\/span><\/p>\n<p>respondent did not adduce any evidence so as to make<\/p>\n<p>the Tribunal understand their real stand. Now the plan<\/p>\n<p>and report filed by the Commissioner is available.<\/p>\n<p>Therefore the Court can understand the position of the<\/p>\n<p>place and then try to find out the place of accident and<\/p>\n<p>then decide the question of negligence in accordance<\/p>\n<p>with law.     Therefore I am inclined to grant an<\/p>\n<p>opportunity for both the sides to adduce further<\/p>\n<p>evidence in this matter.\n<\/p>\n<p>     4.   So the award under challenge is set aside and<\/p>\n<p>the matter is remitted back to the Tribunal with a<\/p>\n<p>direction to permit both the parties to adduce<\/p>\n<p>documentary as well as oral evidence in support of their<\/p>\n<p>respective contentions and then dispose of the matter in<\/p>\n<p>accordance with law.\n<\/p>\n<p>     5.   While sending back the records the Registry is<\/p>\n<p>also directed to forward the Commissioner&#8217;s original<\/p>\n<p>plan and report to the trial court so that the parties can<\/p>\n<p>M.A.C.A. 316 OF 2010<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>let in evidence on the basis of the same and<\/p>\n<p>unnecessary expenses again on that regard can be<\/p>\n<p>avoided. Being a matter of the year 2003 the Tribunal<\/p>\n<p>shall try to expedite the matter and dispose it of within<\/p>\n<p>a period of three months from the date of first<\/p>\n<p>appearance of the parties.          Parties are directed to<\/p>\n<p>appear before the Tribunal on 25.10.2010.<\/p>\n<p>     The amount which is deposit shall remain in<\/p>\n<p>deposit until a final decision is taken in the matter.<\/p>\n<p>                           M.N.
