The next promotion post is that of<\/p>\n<p>Deputy Director of Agriculture. The petitioner&#8217;s grievance<\/p>\n<p>is that overlooking her seniority and merit,her juniors<\/p>\n<p>have been included in Exhibit-P2 select list for promotion<\/p>\n<p>to the cadre of Deputy Director of Agriculture. The<\/p>\n<p>petitioner submits that among the persons selected for<\/p>\n<p>appointment to the post of Deputy Director of Agriculture,<\/p>\n<p>Serial Nos. 12 to 27 are her juniors and that        for no<\/p>\n<p>justifiable reason she was not considered for promotion to<\/p>\n<p>the post of Deputy Director or included in the select list.<\/p>\n<p>The petitioner has submitted Exhibit-P3 representation to<\/p>\n<p>the Convener of the Departmental Promotion Committee<\/p>\n<p>objecting to the non-inclusion of her name in the select<\/p>\n<p>list and seeking revision of the select list under Rule 28<\/p>\n<p>(b) (i) (8) (a) of Part II of the K.S.&amp; S.S.R. The learned<\/p>\n<p>W.P ( C) No. 24553 of 2008<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>counsel    for  the   petitioner   submits    that  Exhibit-P3<\/p>\n<p>representation was submitted to the          Convener of the<\/p>\n<p>Departmental Promotion Committee within one month from<\/p>\n<p>the date on which Exhibit-P2 select list was published in the<\/p>\n<p>official gazette.\n<\/p>\n<p>      2.   When the writ petition came up for admission<\/p>\n<p>today, the learned counsel for the petitioner submitted that<\/p>\n<p>as the Convener of the Departmental Promotion Committee<\/p>\n<p>is yet to take a decision in the matter the writ petition may<\/p>\n<p>be disposed of with a direction to the second respondent,<\/p>\n<p>the Convener of the Departmental Promotion Committee to<\/p>\n<p>consider Exhibit-P3 and pass orders thereon within a time<\/p>\n<p>limit to be fixed by this Court. The learned counsel for the<\/p>\n<p>petitioner also submitted that the petitioner may be<\/p>\n<p>permitted to supplement Exhibit-P3 by filing an additional<\/p>\n<p>representation.\n<\/p>\n<p>      3.   I have heard Smt.M.R. Sreelatha, the learned<\/p>\n<p>Senior Government Pleader appearing for the respondents<\/p>\n<p>also.   Rule 28 (b) (i) (8) (a) of Part II of the K.S. &amp; S.S.R<\/p>\n<p>enables the officer whose name has not been included in<\/p>\n<p>W.P ( C) No. 24553 of 2008<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>the select list to make a written representation to the<\/p>\n<p>Convener of the Departmental Promotion Committee to<\/p>\n<p>revise the select list and to include his\/her name therein.<\/p>\n<p>It is a statutory remedy available to an employee in the<\/p>\n<p>event of supersession. As the petitioner has availed that<\/p>\n<p>remedy and within the time prescribed therefor, it cannot<\/p>\n<p>be rendered infructuous by the delay in its disposal. In my<\/p>\n<p>opinion, the grievance voiced by the petitioner in Exhibit-P3<\/p>\n<p>merits consideration at the hands of the second respondent.<\/p>\n<p>      In the circumstances, the writ petition is disposed of<\/p>\n<p>with a direction to the second respondent to consider<\/p>\n<p>Exhibit-P3 and      the further representation which the<\/p>\n<p>petitioner shall file within two days from today and pass<\/p>\n<p>necessary orders thereon, within a period of two months<\/p>\n<p>from the date of receipt of a copy of this judgment.
