            Challenge in the appeal is to the order dated September 27,<\/p>\n
1985 passed by Commissioner under Workmen’s Compensation Act,<\/p>\n
Amritsar, whereby application filed by the appellants for a direction to the<\/p>\n
respondents to pay compensation to the appellants was dismissed.<\/p>\n
      Gurmej Singh was employed with the Punjab State Electricity Board.<\/p>\n
However, on 2.7.1981 he died as a result of an accident which arose out of<\/p>\n
and in the course of his employment. The appellants, who are his parents<\/p>\n
sought the compensation under the Workmen’s Compensation Act
\n F.A.O. No. 1155 of 1985                                           -2-<\/span><\/p>\n
(hereinafter referred to as ‘the Act’) as they had been dependant upon him.<\/p>\n
             Respondents No. 1 to 5 opposed the claim petition by pleading<\/p>\n
that the appellants had not approached the Court with clean hands as they<\/p>\n
concealed the fact that Gurmej Singh had left behind Sukchain Kaur as his<\/p>\n
widow. Moreover, the death of Gurmej Singh was caused due to his own<\/p>\n
negligence. Respondent No. 6 also claimed that she, being widow of Gurmej<\/p>\n
Singh, was the only one who was dependant upon him and, thereafter,<\/p>\n
entitled to receive the amount.\n<\/p>\n<\/p>\n
             Learned Commissioner framed the following issues on the<\/p>\n
basis of the pleadings of the parties :-\n<\/p>\n
             1.     Whether Gurmej Singh died on 2.7.1981 due to<\/p>\n
                    electric shock ? OPA.<\/p>\n
<\/blockquote>\n
             2.     Whether the applicants were dependant of the<\/p>\n
                    deceased ? OPA.\n<\/p><\/blockquote>\n
<\/blockquote>\n
             3.     Whether Shmt. Sukchain Kaur widow of Gurmej<\/p>\n
                    Singh has remarried and is not entitled to any<\/p>\n
                    compensation ? OPA.\n<\/p><\/blockquote>\n
<\/blockquote>\n
             4.     Whether the applicants have got no locus standi to<\/p>\n
                    file the present petition ?\n<\/p><\/blockquote>\n
<\/blockquote>\n
             5.     Whether this court has no jurisdiction to entertain<\/p>\n
                    the present petition? OPR.<\/p><\/blockquote>\n
             6.     Relief

            After going through the material on the record and hearing<\/p>\n
learned counsel for the parties, learned Commissioner held that respondent<\/p>\n
No. 6 being widow of Gurmej Singh and who had not re-married after the<\/p>\n
death of Gurmej Singh was entitled to receive the amount of compensation<\/p>\n
and, that too, in preference to the appellants who were parents of the<\/p>\n
deceased.   Hence, the present appeal by the parents of the deceased<\/p>\n
employee under Section 30 of the Act.\n<\/p>\n<\/p>\n
            The only issue which arises for determination in the present<\/p>\n
appeal is as to whether the appellants are entitled to receive the amount of<\/p>\n
compensation, being parents of deceased Gurmej Singh, or respondent No. 6,<\/p>\n
who stood married to the deceased employee at the time of the accident.<\/p>\n
            Section 2(1)(d) of the Act defines the term “dependant” as fol-
\nlows :-\n<\/p>\n
      (d)   “dependent” means any of the following relatives of a de-\n<\/p><\/blockquote>\n
            ceased workman, namely :-\n<\/p><\/blockquote>\n
            (i)     a widow, a minor legitimate or adopted son, an unmar-\n<\/p><\/blockquote>\n
                    ried legitimate or adopted daughter, or a widowed
\n                    mother; and<\/p>\n<\/blockquote>\n
            (ii)    if wholly dependent on the earnings of the workman at
\n                    the time of his death, a son or a daughter who has at-
\n                    tained the age of 18 years and who is infirm;\n<\/p><\/blockquote>\n
            (iii)   if wholly or in part dependent on the earnings of the
\n                    workman at the time of his death,-\n<\/p><\/blockquote>\n
                    (a)    a widower,\n\n\n                    (b)    a parent other than a widowed mother,\n F.A.O. No. 1155 of 1985                                              -4-<\/span>\n\n<\/pre>\n
                  (c)   a minor illegitimate son, an unmarried illegiti-\n<\/p><\/blockquote>\n
                        mate daughter or a daughter legitimate or ille-
\n                        gitimate or adopted if married and a minor or if
\n                        widowed and a minor,<\/p>\n<\/blockquote>\n
                  (d)   a minor brother or an unmarried sister or a wid-\n<\/p><\/blockquote>\n
                        owed sister if a minor,<\/p>\n<\/blockquote>\n
                  (e)   a widowed daughter-in-law,<\/p>\n<\/blockquote>\n
                  (f)   a minor child of a pre-deceased son,<\/p>\n<\/blockquote>\n
                  (g)   a minor child of a pre-deceased daughter where
\n                        no parent of the child is alive, or<\/p>\n<\/blockquote>\n
                  (h)    a paternal grandparent if no parent of the work-\n<\/p><\/blockquote>\n
                        man is alive;\n<\/p><\/blockquote>\n
                  Explanation : For the purposes of sub-clause (ii) and
\n                  items (f) and (g) of sub-clause (iii), references to a son,
\n                  daughter or child include an adopted son, daughter or
\n                  child respectively.<\/p><\/blockquote>\n<\/blockquote>\n
            The appellants are the parents of the deceased. Pritam Kaur,<\/p>\n
mother of the deceased was not a widowed mother so that she could be<\/p>\n
termed as a dependant of deceased workman.             The parents could be<\/p>\n
considered dependants of deceased workman only if they were wholly or in<\/p>\n
part dependant on the earnings of the workman at the time of his death.<\/p>\n
There is no material on the file that the appellants were dependents on the<\/p>\n
earnings of deceased workman. It was not disputed that the appellants had<\/p>\n
four other children, who were also earning hands. Therefore, the appellants<\/p>\n
were not shown to be wholly or in part dependant upon their deceased son.<\/p>\n
On the other hand, it had been admitted by Pritam Kaur-appellant that her<\/p>\n
deceased son Gurmej Singh left behind his widow Sukchain Kaur,
\n F.A.O. No. 1155 of 1985                                            -5-<\/span><\/p>\n
respondent No. 6. Mere fact that Sukchain Kaur, respondent No. 6 could get<\/p>\n
remarried is no ground to disentitle her from the compensation or to hold<\/p>\n
that she was not a dependant of deceased workman.            Learned counsel<\/p>\n
appearing for respondent No. 6 states that the said respondent has not<\/p>\n
remarried. This stand of respondent No. 6 could not be refuted by learned<\/p>\n
counsel representing the appellants. If that be the position even today, i.e.<\/p>\n
more than 23 years after the passing of the impugned order by learned<\/p>\n
Commissioner, it was respondent No. 6, who was exclusively entitled to<\/p>\n
receive the amount of compensation and not the appellants.<\/p>\n
            The findings arrived at by the learned Commissioner, while<\/p>\n
denying the payment of compensation amount to the appellants were based<\/p>\n
on proper appreciation of the material available on the file. These findings<\/p>\n
of facts cannot be disturbed in an appeal under Section 30 of the Act, which<\/p>\n
is maintainable only on a substantial question of law and not otherwise.<\/p>\n
            Resultantly, the appeal is dismissed, being without any merit.<\/p>\n
