JUSTICE GOPAL KRISHAN VYAS\n\nMr.Anil Upadhyay, for the appellants.\n\n\n\n              Heard learned counsel for the appellants\nand perused the memo of appeal as well as order\nimpugned.\n              In my opinion, prima facie finding given\nby     the    learned     trial      court       for     rejection     of\napplication filed under Order 39 Rule 1 and 2 read\nwith     Section        151   CPC     does       not     require     any\ninterference       because        appellants           have   miserably\nfailed to make out prima face case because except\nagreement to sale of their share of property, no\ndocumentary        evidence          was     produced         by      the\nappellants before the trial court with regard to\ntheir possession over the land.                   Further, there is\nfinding of learned trial court that the land in\nquestion is still undivided property of the family\nbecause no partition took place till today.\n              In   my    opinion,         when    appellants         have\nfailed to make out any prima facie case, so also,\nwhen balance of convenience also does not lie in\nfavour       appellants,      then    obviously,         no   temporary\n                                   !! 2   !!\n           injunction can be granted.\n                    In this view of the matter, there is no\n           force in the appeal.
