LETTERS PATENT APPEAL No. 2551 of 2004\n\n\n            Appellant in person\n            MR BD KARIA for Respondent No. 1\n            Respondents Nos. 2-3 SERVED\n\n\n     --------------------------------------------------------------\n\n\n                CORAM : HON'BLE MISS JUSTICE R.M.DOSHIT\n                                   and\n                        HON'BLE MR.JUSTICE S.R.BRAHMBHATT\n\n\n                Date of Order: 01\/02\/2005\n\n\nORAL ORDER<\/pre>\n<p>                     (Per : HON&#8217;BLE MISS JUSTICE R.M.DOSHIT)<\/p>\n<p>     Heard the learned advocate and the appellant who<br \/>\n     has appeared in person.\n<\/p>\n<p>     Feeling   aggrieved   by   the order dated 3rd<br \/>\n     December, 2004 made by the learned Single Judge in<br \/>\n     Special     Civil    Application    No.15491\/2004, the<br \/>\n     petitioner-appellant has preferred the present appeal<br \/>\n     under clause 15 of the Letters Patent.\n<\/p>\n<p>     The petitioner, an officer in the respondent &#8211;<br \/>\n     Punjab National Bank was, by order dated 17th November,<br \/>\n     2004, transferred from Ahmedabad to branch office at<br \/>\n Dhandhuka.   Feeling aggrieved, he preferred the above<br \/>\nSpecial Civil Application No.15491\/2004.   The same was<br \/>\nsummarily rejected by impugned order dated 3rd December,<br \/>\n2004. The appellant was, however, reserved liberty to<br \/>\nmake   representation   in the subject matter of the<br \/>\npetition. We are informed that the petitioner did make<br \/>\nrepresentation pursuant to the said order. Nevertheless,<br \/>\nhe has preferred the present appeal.\n<\/p>\n<p>The appellant has submitted that the appellant<br \/>\nhad been serving at Ahmedabad for little more than 5<br \/>\nyears. Whereas, several other officers who had served at<br \/>\nAhmedabad for more than 5 years or 7 years were continued<br \/>\nat Ahmedabad. The appellant was singled out for transfer<br \/>\nout of Ahmedabad because he belongs to a Scheduled Caste.<br \/>\nHe has relied upon the judgment of this Court in the<br \/>\nmatter of   Indulal G.Trivedi v\/s.      General Manager,<br \/>\nWestern Railway, Bombay and others [1985(1) SLR 332]. He<br \/>\nhas submitted that in the said judgment this Court has<br \/>\nissued guidelines with respect to the transfer of public<br \/>\nservants. It is held that, &#8220;&#8230;The general principle of<br \/>\ntransfer is that the persons who were posted for a longer<br \/>\nperiod should be first transferred to another place and<br \/>\nnot the persons who are there for a shorter period.&#8221; It<br \/>\nshould be noted here that the said matter arose from the<br \/>\ntransfer of a servant of Western Railway. The rules of<br \/>\ntransfer prevalent in the Western Railway and the Punjab<br \/>\nNational Bank may not be the same.\n<\/p>\n<p>The transfer policy of the respondent &#8211; Bank<br \/>\nprovides that, &#8220;&#8230;No officer shall remain in the same<br \/>\noffice for more than 3 years. The period of stay in the<br \/>\noffice will exclude the period of service as workmen in<br \/>\nthe same office.&#8221; It further provides that, &#8220;&#8230;No<br \/>\nofficer in the rank of Officer Incharge\/Asstt. Manager<br \/>\nshall remain for more than 6 years at the same station.<br \/>\nFor other officers, the period of stay at one station<br \/>\nshall be restricted to 7 years. The period of stay at<br \/>\none station will exclude the period of service as workmen<br \/>\nin the same station.&#8221;\n<\/p>\n<p>The above referred policy clearly establishes<br \/>\nthat ordinarily an officer of the Bank should         be<br \/>\ntransferred after 3 years&#8217; service at one station. In no<br \/>\ncase he should be continued at one station for more than<br \/>\n6 years\/7 years, as the case may be.     Admittedly, the<br \/>\npetitioner had completed more than 3 years&#8217; service at<br \/>\nAhmedabad.   He, therefore, cannot have a legitimate<br \/>\ngrievance against his transfer made after more than 3<br \/>\nyears. No exception has been made with respect to a<br \/>\n Scheduled Caste employee.    The petitioner, therefore,<br \/>\ncannot claim a favourable treatment being a Scheduled<br \/>\nCaste employee.\n<\/p>\n<p>Learned   advocate Mr.Karia appearing for the<br \/>\nrespondent &#8211; Bank has also made a statement that all<br \/>\nofficers of the Bank who have served for more than 7<br \/>\nyears at a given station shall be transferred out of<br \/>\nstation, subject to the administrative exigencies. Such<br \/>\ntransfers shall be effected during the forthcoming summer<br \/>\nvacation.\n<\/p>\n<p>As discussed hereinabove, the appellant cannot<br \/>\nhave a legitimate grievance against the impugned order of<br \/>\ntransfer.\n<\/p>\n<p>Appeal is dismissed. Notice is discharged. Civil<br \/>\nApplication is rejected. Interim relief is vacated.\n<\/p>\n<p>The appellant requests that the ad-interim stay<br \/>\nbe continued for a period of six weeks.
