PUBLIC PROSECUTOR for\nOpponent(s) : 1, \nMR DR BHATT for Opponent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 17\/02\/2010\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tappellant had filed this Appeal under Section 378(4) of the Code of<br \/>\n\tCriminal Procedure, 1973 against the judgment and order of acquittal<br \/>\n\tdated 12th October 2009 passed by the learned<br \/>\n\tMetropolitan Magistrate, Negotiable Instrument Act, Court No.7,<br \/>\n\tAhmedabad, in Criminal Case No.465 of 2008, whereby the<br \/>\n\trespondent accused has been acquitted from the charges levelled<br \/>\n\tagainst him.\n<\/p>\n<p>The<br \/>\n\tbrief facts of the prosecution case is that the respondent-accused<br \/>\n\twas serving in the shop of husband of the original complainant and<br \/>\n\tthus, the appellant-original complainant knows the<br \/>\n\trespondent-accused. It is also the case of the prosecution that<br \/>\n\trespondent-accused had requested the present appellant to give him<br \/>\n\tRs.50,000\/- (Rupees Fifty Thousand Only) for some time, the present<br \/>\n\tappellant had given the said amount to the respondent-accused. It is<br \/>\n\tthe case of the prosecution that thereafter, when the present<br \/>\n\tappellant demanded the said amount, the respondent-accused gave<br \/>\n\tfalse promises. Thereafter, the respondent-accused gave a cheque<br \/>\n\tbearing No.169706 dated 11th July 2006 for Rs.50,000\/-<br \/>\n\tdrawn on The Kalupur Commercial Co-operative Bank Limited, Ashram<br \/>\n\tRoad.  However, when the appellant presented the said cheque with<br \/>\n\this banker i.e. The Kalupur Commercial Co-operative Bank Limited,<br \/>\n\tVastrapur Branch on 11th July 2006, the said cheque was<br \/>\n\treturned dishonoured with endorsement  Account Closed , which<br \/>\n\twas intimated by the banker to the present appellant on 13th<br \/>\n\tJuly 2006. It is also the case of the prosecution that because of<br \/>\n\tthis, the appellant issued statutory notice through her advocate to<br \/>\n\tthe respondent-accused under Section 138 of the Negotiable<br \/>\n\tInstrument Act on 20th July 2006 by RPAD and UPC. Though<br \/>\n\tthe said notice was served upon the respondent-accused on 21st<br \/>\n\tJuly 2006, neither the respondent-accused replied the said notice<br \/>\n\tnor the respondent-accused made payment of the cheque amount.<br \/>\n\tTherefore, the present appellant filed complaint in the court of<br \/>\n\tlearned Magistrate.\n<\/p>\n<p>Thereafter,<br \/>\n\tthe trial was initiated against the respondent accused in the<br \/>\n\tCourt of learned Magistrate. To prove the case against the<br \/>\n\trespondent accused, the prosecution has examined the witnesses and<br \/>\n\talso produced documentary evidence and at the end of the trial, the<br \/>\n\tlearned Magistrate has acquitted the respondent accused from the<br \/>\n\tcharges levelled against him, vide judgment and order dated 12th<br \/>\n\tOctober 2009 in Criminal Case No.465  of 2008.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said judgment and order<br \/>\n\tpassed by the learned Magistrate, the appellant has filed the<br \/>\n\tpresent Appeal.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tV.M. Pancholi, learned advocate appearing on behalf of the<br \/>\n\tappellant, has contended that the judgment and order of Trial Court<br \/>\n\tis against the provisions of law. The Trial Court has not properly<br \/>\n\tappreciated the facts and evidence led by the prosecution and<br \/>\n\tlooking to the provisions of law itself, it is clearly established<br \/>\n\tthat the prosecution has proved the whole ingredients of offence<br \/>\n\tagainst the respondent-accused. Learned advocate appearing on behalf<br \/>\n\tof the appellant has also taken this Court through the oral as well<br \/>\n\tas documentary evidence.\n<\/p>\n<p>I<br \/>\n\thave perused the oral as well as documentary evidence. I have also<br \/>\n\tconsidered the submissions made by the learned advocate on behalf of<br \/>\n\tthe appellant. I have also gone through the papers and the judgment<br \/>\n\tand order passed by the Trial Court.\n<\/p>\n<p>Thus,<br \/>\n\tin my opinion, looking to the evidence on record, from the evidence<br \/>\n\titself, it is  clearly established that the prosecution has not<br \/>\n\tproved its case beyond reasonable doubt.\n<\/p>\n<p>At<br \/>\n\tthe outset it is required to be noted that the principles which<br \/>\n\twould govern and regulate the hearing of appeal by this Court<br \/>\n\tagainst an order of acquittal passed by the Trial Court have been<br \/>\n\tvery succinctly explained by the Hon&#8217;ble Apex Court in catena of<br \/>\n\tdecisions. Thus, the powers which this Court may exercise against an<br \/>\n\torder of acquittal are well settled. Thus, in case the Appellate<br \/>\n\tCourt agrees with the reasons and the findings given by the lower<br \/>\n\tCourt, then the discussion of evidence is not necessary.\n<\/p>\n<p>I<br \/>\n\thave gone through the judgment and order passed by the Trial Court<br \/>\n\tand have also perused the oral as well as documentary evidence<br \/>\n\tproduced before me and also considered the submissions made by the<br \/>\n\tlearned advocates of both the sides. On going through the judgment<br \/>\n\tand order passed by the Trial Court and the papers placed before me,<br \/>\n\tI am of the opinion that the Trial Court has not committed any error<br \/>\n\tin not believing the case of the prosecution. It is observed that as<br \/>\n\tper the say of the present appellant, the respondent-accused was<br \/>\n\tserved with the appellant from the year 1995 to 2000. When the<br \/>\n\trespondent-accused left the services in the year 2000, there is no<br \/>\n\treason explained by the prosecution to give Rs.50,000\/- to the<br \/>\n\trespondent-accused in the year 2004. It is also observed that vide<br \/>\n\tApplication dated 11th May 2007 the respondent-accused<br \/>\n\thas prayed  before the learned Trial Court to obtain opinion of the<br \/>\n\thand writing expert. Hand writing expert was also examined. As per<br \/>\n\tthe opinion of the hand writing expert,  9  is replaced by  7<br \/>\n\tand second  9  is replaced by  0 .  It is also observed that<br \/>\n\tprosecution has not taken initial of the respondent-accused where<br \/>\n\tthe respondent-accused changed  06  in place of  96 . It is<br \/>\n\talso observed that as per the case of the present appellant when<br \/>\n\tthere was initial of the respondent-accused at change made in month,<br \/>\n\tthen why the present appellant had not obtained initial of the<br \/>\n\trespondent-accused at change made in the year. This conduct of the<br \/>\n\tappellant is doubtful. Further, neither the appellant has mentioned<br \/>\n\tin her notice that the respondent-accused had given the appellant<br \/>\n\tthe cheque with certain corrections nor she has contended the said<br \/>\n\tfact in her cross-examination.  Thus, when as per the opinion of the<br \/>\n\thand writing expert it is proved that the cheque in question is<br \/>\n\taltered one, the case of the prosecution is not believable. It is<br \/>\n\talso observed that the prosecution has miserably failed to prove its<br \/>\n\tcase beyond reasonable doubt against the respondent-accused. I find<br \/>\n\tthat the findings recorded by the Trial Court are absolutely just<br \/>\n\tand proper and in recording the said findings no illegality or<br \/>\n\tinfirmity has been committed by it. The learned Judge has rightly<br \/>\n\tcome to the conclusion that the prosecution has miserably failed to<br \/>\n\tprove the case against the respondent accused.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\tCourt below and, hence, find no reason to interfere with the same.<br \/>\n\tHence, the Appeal is hereby dismissed at the admission stage.\n<\/p>\n<p>In<br \/>\n\tview of above, the Appeal is dismissed. The judgment and order dated<br \/>\n\t12th October 2009 passed by the learned Metropolitan<br \/>\n\tMagistrate, Negotiable Instrument Act, Court No.7, Ahmedabad in<br \/>\n\tCriminal Case No.465 of 2008 is hereby confirmed. Record and<br \/>\n\tProceedings to be sent back to the concerned Trial Court, forthwith.<br \/>\n\t Bail bond, if any, shall stands cancelled.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
