1.\t\tThe
\npresent Civil Revision Application under Section 29 of the Bombay
\nRent Act has been preferred by the petitioners herein  original
\ndefendants   tenants to quash and set aside the impugned judgement
\nand order dated 23\/09\/2009 passed by learned Appellate Bench of Small
\nCauses Court at Ahmedabad in Civil Appeal No.52 of 1999, by which,
\nlearned Appellate Bench quashed and set aside the judgement and
\ndecree passed by the Trial Court dated 29\/01\/1999 in H.R.P. Suit
\nNo.2298 of 1990.\n<\/p>\n
2.\t\tRespondent
\nherein   original plaintiff   landlord instituted H.R.P.Suit
\nNo.2298 of 1990 in the Small Causes Court at Ahmedabad against the
\npetitioners herein   original defendants   tenants for eviction
\ndecree for non-use of the disputed property in question since last
\nmore than 6 months prior to filing of the Suit. Learned Small Causes
\nCourt at Ahmedabad by jugement and decree dated 29\/01\/1999 partly
\nallowed the Suit qua injunction and dismissed the Suit qua possession
\nsought by the plaintiff on the ground of non-usage of the disputed
\nproperty in question since last more than six months prior to filing
\nof the Suit.\n<\/p>\n
3.\t\tBeing
\naggrieved and dissatisfied with the judgement and decree passed by
\nthe learned Small Causes Court at Ahmedabad dated 29\/01\/1999 in
\nH.R.P.Suit No.2298 of 1990, the respondent herein   original
\nplaintiff   landlord preferred Civil Appeal before the Appellate
\nBench of Small Causes Court at Ahmedabad and Appellate Bench of the
\nSmall Causes Court at Ahmedabad by judgement and order dated
\n23\/09\/2009 allowed Civil Appeal No.52 of 1999  and quashed and set
\naside the judgement and decree passed by the learned Trial Court in
\nH.R.P.Suit No.2298 of 1990. Being aggrieved and dissatisfied with the
\njudgement and order dated 23\/09\/2009 passed in Civil Appeal No.52 of
\n1999, the petitioners   original defendants   tenants have
\npreferred the present Civil Revision Application under Section 29 of
\nthe Bombay Rent Act.\n<\/p>\n
4.\t\tMr.Ashok
\nPadia, learned advocate appearing on behalf of the petitioners has
\nvehemently submitted that the learned Appellate Court has not
\nproperly appreciated the evidence on record. The Appellate Court has
\nnot considered the fact that there was ration card in favour of the
\noriginal defendants and every month defendant No.2 was taking ration
\nfrom the Fair Price Shop. It is further submitted that even the
\nlearned Appellate Court has not properly appreciated the fact that
\nowner of the chawl, in which, the defendant No.2 is alleged to have
\nbeen residing, is not examined and, therefore, in absence of
\nexamining the owner of the chawl, in which, defendant No.2 is alleged
\nto have been residing, the Appellate Court has erred in believing
\nthat defendant No.2 was residing elsewhere and in another chawl. Even
\nconsidering the evidence of the Court Commissioner and panchnama of
\nthe Court Commissioner, story put forward by the respondent is
\nillogical.\n<\/p>\n
\t\tIt
\nis submitted by Mr.Padia, learned advocate appearing on behalf of the
\npetitioners that as per the panchnama prepared by Court Commissioner,
\nthe Suit premises was found to be open and if that is considered and
\nthe case of the respondent herein   original plaintiff   landlord
\nthat utensils were taken away by the tenants and it is the case on
\nbehalf of the tenants that the tenants have left away the suit
\npremises in that case, the landlord could have let out the said Suit
\npremises to other person and the premises could not have been kept
\nopen by the landlord. It is submitted that no landlord keep the
\npremises vacant and, therefore, it is submitted that the learned
\nAppellate Court has materially erred in passing the decree and
\nlearned Appellate Court has not properly appreciated the aforesaid
\nfacts. By making above submissions, it is requested to allow the
\npresent Civil Revision Application.\n<\/p>\n
5.\t\tThe
\npresent Civil Revision Application is opposed by Mr.N.S.Shevade,
\nlearned advocate appearing on behalf of the respondent   original
\nplaintiff – landlord. In appears on appreciation of evidence that by
\ngiving cogent reasons, the Appellate Bench has allowed the Appeal and
\npassed eviction decree on the ground of non-usage of suit premises
\nfor last more than six months prior to filing of the suit, which is
\nnot required to be interfered by this Court and, therefore, it is
\nrequested to dismiss the present Civil Revision Application.\n<\/p>\n
6.\t\tHeard
\nthe learned advocates appearing on behalf of the respective parties
\nat length. While allowing the Appeal and passing the judgement and
\norder, the Appellate Bench has considered the following facts :\n<\/p>\n
(i)\t\tRation
\ncard upon, which the reliance was placed by the petitioners herein
\noriginal defendants   tenant was issued in the year 1993 and the
\nSuit was instituted in the year 1990. The Appellate Court has also
\nconsidered that the said ration card was got issued for the first
\ntime in the year 1993 and it was not renewal of the ration card.\n<\/p>\n
(ii)\t\tThe
\nsummons of Suit was served upon the defendants at another place and
\nnot at the suit premises. Considering the same, the Appellate Court
\nhas observed that defendant No.2 was not residing in the suit
\npremises.\n<\/p>\n
(iii)\t\tThat
\nthe panchnama prepared by the Court Commissioner is also considered
\nby the Appellate Court and it is found that when the Suit was
\ninstituted, the defendants were not residing and it was open.\n<\/p>\n
\t\tConsidering
\nthe aforesaid facts and circumstances, when the Appellate Court
\ndecreed the Suit and passed a eviction decree on the ground of
\nnon-usage of premises by the defendants since last more than six
\nmonths, it cannot be said that the Appellate Court has committed any
\nerror or illegality in passing the impugned judgement and order,
\nwhich calls for interference of this Court. No case is made out to
\ninterfere with the judgement and order passed by the Appellate Court.\n<\/p>\n
7.\t\tIn
\nview of the above and for the reasons stated hereinabove, there is no
\nsubstance in the present application, which deserves to be dismissed
\nand is accordingly dismissed. No order as to costs.\n<\/p>\n
