1.This  writ  petition    is   filed  on   10.8.2010<\/p>\n
 challenging the decisions reflected by Exts.P4<\/p>\n
 and P7 resulting in the blacklisting of the<\/p>\n
 petitioner from supply of containers for packing<\/p>\n
 Aravana  in   Sabarimala   for   three  consecutive<\/p>\n
 years.  Ext.P7  is  issued    making  reference to<\/p>\n
 Ext.P4. Adverting to that, it can be seen that<\/p>\n
 Ext.P4 was issued with reference to a legal<\/p>\n
 opinion that the loss, if any, sustained on<\/p>\n
 account  of  short  supply    of  cans  during the<\/p>\n
 previous year could be adjusted from the security<\/p>\n
 deposit or from the bank guarantee after giving<\/p>\n
 written notice to the petitioner. Indisputably,<\/p>\n
 the petitioner was not given any further notice<\/p>\n

 on the basis of Ext.P4 before issuance of Ext.P7.<\/p>\n
 Nor was his explanation called for before the<\/p>\n
 impugned blacklisting.\n<\/p>\n<\/p>\n
2.When this writ petition came up for admission,<\/p>\n
 this Court issued an interim order on 12.8.2010<\/p>\n
 to the effect that it is not advisable for the<\/p>\n
 Board to depend on one or two contractors only<\/p>\n
 for supply of cans for packing Aravana. It was<\/p>\n
 accordingly directed that the Board will receive<\/p>\n
 the tender of the petitioner also and process it<\/p>\n
 and file a report. Following that, the Purchase<\/p>\n
 Committee considered the offers and placed on<\/p>\n
 record the report which was considered by us on<\/p>\n
 7th September, 2010. On 8th September, 2010, orders<\/p>\n
 were      issued to     finalise   the    tentative<\/p>\n
 apportionment among the four suppliers already<\/p>\n
 identified. We also directed that the petitioner<\/p>\n
 be heard by the Board and decision be taken<\/p>\n
 tentatively. Thereupon, the Board further went<\/p>\n
 into the matter and has placed its views. The<\/p>\n
 Board has also filed an additional statement<\/p>\n

 through its Secretary. The Board has tentatively<\/p>\n
 decided that supply orders be given to the four<\/p>\n
 suppliers identified earlier, i.e., M\/s.Creative<\/p>\n
 Pack,     M\/s.Jothis  Cones,   M\/s.Moti   Packaging<\/p>\n
 Industries and M\/s.Moti Adhesives and that the<\/p>\n
 remaining    15  lakhs   cans  be  awarded to  the<\/p>\n
 petitioner at the rate of Rs.3.10 per can in<\/p>\n
 terms of further directions of this Court.<\/p>\n
3.As already noticed, the impugned decision to<\/p>\n
 blacklist the petitioner is rendered on the sole<\/p>\n
 premise that there was short supply of cans<\/p>\n
 during the previous year. As noted in our earlier<\/p>\n
 orders, the fact of the matter remains that the<\/p>\n
 Aravana Processing Unit was itself set up with<\/p>\n
 the expertise of the petitioner. It then happened<\/p>\n
 that    the  staff  of   the  Board  could not  by<\/p>\n
 themselves run the said unit and it required the<\/p>\n
 assistance of the employees of the petitioner.<\/p>\n
 Their services were, therefore, diverted for the<\/p>\n
 purpose of the Aravana Processing Unit. This is<\/p>\n
 one of the pivotal reasons projected by the<\/p>\n
WPC25191\/10           -: 4 :-<\/span><\/p>\n
 petitioner for any short fall in the supply of<\/p>\n
 cans    during the previous   year. The  impugned<\/p>\n
 decisions Exts.P4 and P7 do not reflect any<\/p>\n
 ground other than the short supply. In fact, even<\/p>\n
 going by the opinion that the Board got, the<\/p>\n
 suggestion was that there could be recovery of<\/p>\n
 loss, if any, sustained by making appropriate<\/p>\n
 deductions from the security deposit or bank<\/p>\n
 guarantee, that too, after appropriate notice and<\/p>\n
 hearing being extended to the petitioner. We are<\/p>\n
 clear in our mind that there was really no ground<\/p>\n
 at   all   for blacklisting   the petitioner  and<\/p>\n
 refusing to accept tenders regarding the supply<\/p>\n
 of cans for this year also. We may at once notice<\/p>\n
 that even for the current year, the petitioner is<\/p>\n
 engaged for the purpose of assisting in the<\/p>\n
 manufacture and packing of Aravana in the plant<\/p>\n
 noted above.\n<\/p>\n<\/p>\n
4.Having regard to the various contents of the<\/p>\n
 different statements and the reports, including<\/p>\n
 that of the Purchase Committee and the views of<\/p>\n
WPC25191\/10           -: 5 :-<\/span><\/p>\n
 the Board, we are inclined to think that the<\/p>\n
 petitioner could be granted the opportunity to<\/p>\n
 supply 15 lakhs of cans at the rate of Rs.3.10<\/p>\n
 per can, however, on condition that the payment<\/p>\n
 for such supply would be made only after the<\/p>\n
 entire supply is effected. This condition is<\/p>\n
 imposed on the basis of the offer made by the<\/p>\n
 petitioner through its learned counsel in open<\/p>\n
 court that it would supply the entire quantity<\/p>\n
 and would only then take the payment.<\/p>\n
 In the result, quashing the impugned Ext.P4 and<\/p>\n
 Ext.P7,    we order  as     above  as  regards the<\/p>\n
 allotment of the work of supply of the quantity<\/p>\n
 of 15 lakhs of cans to the petitioner. The writ<\/p>\n
 petition is ordered accordingly. No costs.<\/p>\n
