Justice P.N.RAVINDRAN\n\n Dated :12\/11\/2009\n\n O R D E R\n                        P.N.RAVINDRAN, J.\n                         ---------------------------\n                    W.P.(C) No. 32437 OF 2009\n                         --------------------------\n             Dated this the 12th day of November, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>      Aggrieved by Ext.P3 order passed by the Tahsildar,<\/p>\n<p>Chengannur cancelling the transfer of registry effected in favour of<\/p>\n<p>the Neduvaramcode Kshethra Samrakshana Samithi, the petitioners<\/p>\n<p>have filed Ext.P4 appeal before the Revenue Divisional Officer,<\/p>\n<p>Chengannur under Rule 18 of the Transfer of Registry Rules. Along<\/p>\n<p>with Ext.P4 appeal, Ext.P4(a) stay petition was also filed seeking<\/p>\n<p>stay of operation of the order impugned in the appeal.         Ext.P4<\/p>\n<p>appeal and Ext.P4(a) stay petition are dated 28.10.2009.         The<\/p>\n<p>appeal and the stay petitions were presented before the Revenue<\/p>\n<p>Divisional Officer on the same day itself. In this writ petition, the<\/p>\n<p>petitioners seek expeditious disposal of Ext.P4 appeal.<\/p>\n<p>      2.    Sri. P.N.Santhosh, the learned Government Pleader<\/p>\n<p>appearing for the official respondents submits that since Ext.P4<\/p>\n<p>appeal has been received and is pending, the Revenue Divisional<\/p>\n<p>Officer will consider Ext.P4 and pass orders thereon in accordance<\/p>\n<p>with law. He also submits that the Revenue Divisional Officer will<\/p>\n<p>consider the interim relief prayed for in Ext.P4(a) stay petition and<\/p>\n<p>W.P.(C) No. 32437\/09<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>pass orders thereon. In the light of the said submission, I dispose of<\/p>\n<p>this writ petition with the following directions:<\/p>\n<p>       (i) The Revenue Divisional Officer, Chengannur, shall consider<\/p>\n<p>Ext.P4(a) stay petition and pass orders thereon after notice to and<\/p>\n<p>affording the petitioners a reasonable opportunity of being heard<\/p>\n<p>within one week from the date on which the petitioners produce a<\/p>\n<p>certified copy of this judgment before him.       In order to enable the<\/p>\n<p>Revenue Divisional Officer to pass orders on Ext.P4(a) stay petition,<\/p>\n<p>further proceedings pursuant to Ext.P3 shall stand stayed for a period<\/p>\n<p>of 10 days from today.\n<\/p>\n<p>       (ii) The Revenue Divisional Officer, Chengannur, shall pass<\/p>\n<p>final orders on Ext.P4 appeal within three months from the date on<\/p>\n<p>which the petitioners produce a certified copy of this judgment before<\/p>\n<p>him, after notice to and affording the petitioners a reasonable<\/p>\n<p>opportunity of being heard.\n<\/p>\n<\/p>\n<p>                                               P.N.RAVINDRAN, JUDGE<\/p>\n<p>vps<\/p>\n<p>W.P.(C) No. 32437\/09<br \/>\n<span class=\"hidden_text\">                        3<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Ma.
