Hence, the matter is taken up for hearing today.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the impugned award dated 28.08.2000 passed by the Labour Court,<br \/>\nAhmedabad in Reference [LCA] No. 2488\/1988, whereby the Labour Court<br \/>\nhas directed the petitioner to reinstate the respondent in service on<br \/>\nhis original post with continuity of service and full back wages.\n<\/p>\n<p>3.\t\tThe<br \/>\nshort facts of the case are that the respondent at the relevant time<br \/>\nwas working on the post of Helper with the petitioner.   As the<br \/>\nrespondent was found committing theft of ball bearing materials from<br \/>\nthe petitioner Company, the respondent on 11.03.1988 voluntarily<br \/>\nresigned from the service.   Thereafter, the respondent raised a<br \/>\ndispute which was ultimately referred to the Labour Court for<br \/>\nadjudication being Reference [LCA] No. 2488\/1988. Before the Labour<br \/>\nCourt both the parties adduced evidence and after appreciating the<br \/>\nmaterial produced before it, the Labour Court allowed the reference<br \/>\nwith the aforesaid directions. Hence, this petition.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned counsel for the petitioner and perused the documents on<br \/>\nrecord.  It appears from the record that the respondent had not<br \/>\nvoluntarily resigned from the service and that the petitioner had not<br \/>\ncommunicated any letter regarding the confirmation of the resignation<br \/>\ntendered by the respondent workman. The said fact can be established<br \/>\nfrom the documents at Exhibits-19 and 20.  However, there is no<br \/>\nevidence on record to establish that the petitioner had paid any<br \/>\namount towards gratuity or other benefits, to the respondent for<br \/>\nvoluntarily resigning from the service. Apart from that the<br \/>\nrespondent had been working with the petitioner since last 17 years.<br \/>\nTherefore, I am of the view that the Labour Court has rightly passed<br \/>\nthe award qua reinstatement with continuity of service.\n<\/p>\n<p>5.\t\tSo<br \/>\nfar as the question of back wages is concerned, the Labour Court has<br \/>\nnot given any cogent reasons for awarding back wages to the<br \/>\nrespondent workman. In view of the principle laid down by the Apex<br \/>\nCourt in the case of <a href=\"\/doc\/800069\/\">Ram Ashrey<br \/>\nSingh v. Ram Bux Singh<\/a> reported<br \/>\nin (2003) II L.L.J. 176<br \/>\na workman has no automatic entitlement to back wages since it is<br \/>\ndiscretionary and has to be dealt with in accordance with the facts<br \/>\nand circumstances of each case. Similar principle has been laid down<br \/>\nby the Apex Court in the case of <a href=\"\/doc\/1628125\/\">General<br \/>\nManager, Haryana Roadways v. Rudhan Singh<\/a><br \/>\nreported in J.T. 2005(6) SC 137<br \/>\n[2005(5) SCC 591], wherein it<br \/>\nhas been held that an order for payment of back wages should not be<br \/>\npassed in a mechanical manner but a host of factors are to be taken<br \/>\ninto consideration before passing any such order.\n<\/p>\n<p>6.\t\tIt<br \/>\nwould also be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/309814\/\">A.P. State Road Transport &amp; Ors. v. Abdul Kareem<\/a><br \/>\nreported in (2005) 6 SCC 36, wherein it has been held that a<br \/>\nworkman is not entitled to any consequential relief on reinstatement<br \/>\nas a matter of course unless specifically directed by forum granting<br \/>\nreinstatement. In above view of the matter, I am of the opinion that<br \/>\nthe respondent cannot be said to be entitled for back wages.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, the petition is partly allowed. The impugned award, qua<br \/>\nback wages is quashed and set aside. The award qua reinstatement with<br \/>\ncontinuity of service is confirmed.\n<\/p>\n<p>The award of the Labour Court is modified accordingly.
