He<br \/>\nwants a week&#8217;s time to explain.&#8221;\n<\/p>\n<p>2.0\tToday,<br \/>\nwhen the matter is taken up for hearing, learned advocate Mr. Gogia<br \/>\nfor the petitioner re-argued the matter and also pointed out that he<br \/>\nhas filed one Civil Application bearing<br \/>\nNo. 12910 of 2010, which<br \/>\nis at serial no. 11 of the Board today.  The same is taken up for<br \/>\nconsideration along with this Special Civil Application.\n<\/p>\n<p>3.0\tThe<br \/>\npetitioner joined services as a &#8216;Chowkidar&#8217; on<br \/>\n27th<br \/>\nSeptember 1984.  On completion of 09 (nine) years&#8217; service in the<br \/>\ncadre of &#8216;Chowkidar&#8217;, it is his claim that, &#8216;he became eligible for<br \/>\nthe first higher pay-scale&#8217;.  It is his further case that, &#8216;before<br \/>\nthat could be granted to him, he came to be promoted in the year 1996<br \/>\nin the cadre of &#8216;Clerk&#8217; and therefore, he became eligible for the<br \/>\nfirst higher pay-scale on completion of 09 (nine) years in &#8216;clerical&#8217;<br \/>\ncadre in the year 2005&#8242;.\n<\/p>\n<p>4.0\tAt<br \/>\nPage 7 of the Civil Application, an Undertaking, in a printed form,<br \/>\nis annexed.  It dated 10th June 2008 and the contents of<br \/>\nthat Undertaking are that, &#8220;I had waived promotion prior<br \/>\nto<br \/>\n5th July 1991 and as and when the<br \/>\nbenefits of the Finance Department G. R. dated 16th<br \/>\nAugust 1994 bearing no. PGR-1194-44-M-(higher pay-scale G.R.) will be<br \/>\ngranted, then if my pay will be less than the junior employees<br \/>\nof my cadre, who had accepted the promotion, then I will not demand<br \/>\n&#8216;stepping up&#8217;.&#8221;  This document is not produced along with<br \/>\nthe petition.  It appears that the authorities have passed the order<br \/>\nunder challenge taking into consideration these facts.\n<\/p>\n<p>5.0\tThe<br \/>\nCourt finds no substance in the petition.
