No.5241\/2010\n21\/07\/2010\n     Shri     Abhishek      Arjaria,   Advocate     for   the\napplicant.\n     Shri     B.P.Pandey,    Public    Prosecutor   for   the\nrespondent-State.<\/pre>\n<p>     Heard on IA No.10354\/2010, an application for<br \/>\nurgent hearing.\n<\/p>\n<p>     Since the case diary is available, the application<br \/>\nis allowed.\n<\/p>\n<p>     Also heard both the parties.\n<\/p>\n<p>     Case diary of Crime No.887\/2009 registered at<br \/>\nPolice Station Maihar District Satna for the offence<br \/>\npunishable under Sections 498-A and 304-B of IPC is<br \/>\nperused.\n<\/p>\n<p>     The applicant is arrested on 4\/2\/2010 for the<br \/>\naforesaid offence.\n<\/p>\n<p>     Learned counsel for the applicant submits that<br \/>\nthe wife of the applicant died due to electric shock<br \/>\nreceived from high tension line on the terrace of his<br \/>\nhouse and that was an accident. The parents of the<br \/>\ndeceased have made omnibus allegation against the<br \/>\npresent applicant and his family members after seven<br \/>\ndays of the incident. They cooked the story against the<br \/>\napplicant and his family members. There was no<br \/>\nharassment of the deceased by the present applicant<br \/>\nfor demand of dowry. She was never kept in her<br \/>\nparents&#8217; house to show resistance. Since the deceased<br \/>\ndied in an unnatural circumstances, her parents are<br \/>\n          made allegation against the applicant. He further<br \/>\n         submits that this Court vide order dated 23\/4\/2010 in<br \/>\n         M.Cr.C.No.1926\/2010 has granted bail to the father<br \/>\n         and the mother of the present applicant. Present<br \/>\n         applicant is in custody since 4\/2\/2010. He is a young<br \/>\n         youth of 21 years of age and if he is not enlarged on<br \/>\n         bail, then his future will be spoiled, therefore he prays<br \/>\n         for bail.\n<\/p>\n<p>               Learned public prosecutor for the State opposes<br \/>\n         the   application   mainly   on   the   ground       that the<br \/>\n         applicant demanded a sum of Rs.1 lakh from the<br \/>\n         deceased and the parents of the deceased have<br \/>\n         already given him a sum of Rs.50,000\/-.\n<\/p>\n<p>               After hearing aforesaid arguments and looking to<br \/>\n         the facts and circumstances of the case, without<br \/>\n         expressing any view on the merits of the case, I am of<br \/>\n         the opinion that this is a fit case in which bail may be<br \/>\n         granted to the applicant Dharmendra Kumar Gupta.\n<\/p>\n<p>               Therefore,    the   application   of     the    present<br \/>\n         applicant under Section 439 Cr.P.C is hereby allowed.<br \/>\n         He be released on bail on furnishing a bond in sum of<br \/>\n         Rs.30,000\/- (Rupees thirty thousand) with one surety<br \/>\n         bond of the same amount to the satisfaction of the trial<br \/>\n         Court, to appear before the trial Court on the dates<br \/>\n         given by the concerned Court.\n<\/p>\n<p>               Certified copy as per rules.\n<\/p>\n<p>                                                      (N.K.Gupta)<br \/>\n                                                         Judge<\/p>\n<p>Ansari\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Dharmendra Kumar Gupta vs The State Of Madhya Pradesh on 21 July, 2010 M.Cr.C.
