\tThe
\npetitioner, who was working as an Unarmed Head Constable, at
\nKhatodara Police Station of Surat, has been transferred by order
\ndated 23.3.2010 to Sabarkantha District and is placed at the disposal
\nof Superintendent of Police, Sabarkantha, at Himmatnagar. Aggrieved
\nby the said order, the petitioner has approached this Court with this
\npetition making the following prayers :-\n<\/p>\n
 (A)\tThat
\nthe Hon’ble Court be pleased to issue a writ of mandamus or any other
\nappropriate writ  or order declaring that the impugned order dated
\n23.3.2010 is illegal and ultra-vires to the powers of the authority
\namounting to victimization, improper and violative of Articles 14 and
\n16 of the Constitution of India and further be pleased to
\nquash and set aside the same.\n<\/p>\n
(B)\tPending
\nadmission and final disposal of this petition, the Hon’ble Court be
\npleased to stay further operation of the impugned transfer order and
\ndirect the authorities to re-transfer the petitioner in the original
\nplace at Khatodara Police Station.\n<\/p>\n
(C)\tAny
\nother relief deemed fit to meet the ends of justice may be granted.\n<\/p>\n
2.\tThe
\npetition is based on the ground that employee upto the level of
\nConstable cannot be transferred outside the District; that the
\ntransfer is punitive action for legitimate association activities  of
\nthe petitioner; that the transfer order is passed in colourable
\nexercise of power; and that the transfer order would cause prejudice
\nto the petitioner’s interest and, therefore, the same may be quashed
\nand set aside.\n<\/p>\n
3.\tHeard
\nlearned advocate Mr Sinha for the petitioner and learned AGP Mr
\nPathak for the respondent.\n<\/p>\n
4.\tLearned
\nadvocate Mr Sinha submitted that inter-district transfer of the
\npetitioner is used as a weapon to punish him for his  association
\nactivities, since the petitioner is a party to association activities
\nand writ petition. Mr Sinha submitted that ordinarily inter-district
\ntransfers are not effected for Constables unless there are emergent
\ncircumstances. He has drawn attention of this Court towards paras
\n152, 153, 154 and 155 of the Police Manual and submitted that the
\norders are bad and may be quashed and set aside.\n<\/p>\n
5.\tLearned
\nAGP Mr Pathak has opposed this petition, According to him, the orders
\nare passed by the Director General of Police, who is at the top of
\nthe Police Department at State level and resolution dated 17.10.1979
\npermits such transfers. The transfer order is passed on
\nadministrative grounds and, therefore, the petition may not be
\nentertained.\n<\/p>\n
6.\tIn
\nrejoinder, Mr Sinha submitted that if the order is passed on
\nadministrative grounds, there is no question of any secrecy and the
\ncause may be made known to the petitioner to enable him to meet with
\nthe same.\n<\/p>\n
7.\tWhen
\nhis attention was drawn to Section 28 of the Bombay Police Act, he
\nsubmitted that these powers are not to be employed in ordinary
\ncourse. This is done where a mass of police personnel is to be
\nshifted from one place to another for emergent circumstances.\n<\/p>\n
8.\tHaving
\nexamined  the case on hand in light of the rival submissions, it may
\nbe noted that the petitioner is a Head Constable, who is sought to be
\ntransferred from one district to another on administrative grounds.
\nThe order impugned is signed by the Police Commissioner, Surat, but
\nis passed pursuant to an order passed by the Director General of
\nPolice on 19.3.2010. The order makes it clear that the transfer is
\neffected on public interest.\n<\/p>\n
9.\tThe
\ngrounds of challenge mainly are malafides, colourable exercise of
\npower, want of jurisdiction and that employee upto the level of
\nConstable cannot be transferred outside the district ordinarily. If
\nthe order is seen, there is nothing to read that it is either
\npunitive or in colourable exercise of power and there may not be any
\nsuch indication in the order ordinarily.\n<\/p>\n
9.1\tSo
\nfar as the authority or jurisdiction part is concerned, much emphasis
\nis laid  on the provisions contained in paragraph 152 of the Bombay
\nPolice Manual, which provides that under Section 28(1) of the Bombay
\nPolice Act, 1951,  the Inspector General of Police is authorised to
\nmake,  whenever necessary, inter-district transfer of police
\nestablishment without reference to the Government. It has, therefore,
\nbeen canvassed that inter-district transfer otherwise cannot be
\neffected except in exercise of powers under Section 28(1) of the
\nBombay Police Act and that is to be exercised only in emergent
\ncircumstances.\n<\/p>\n
10.\tIf
\na reference is made to Section 28(1) of the Bombay Police Act, it
\nruns as under :-\n<\/p>\n
 28.\tPolice
\nOfficer to be deemed to be always on duty and to be liable to
\nemployment in any part of the State. –\n<\/p>\n
(1)\tEvery
\nPolice Officer not on leave or under suspension shall for all
\npurposes of this Act be deemed to be always on duty, and any Police
\nOfficer or any number or body of Police Officers allocated for duty
\nin one part of the State may, if the State Government or the
\nInspector-General so directs, at any time, be employed on Police duty
\nin any other part of the State may, if the State Government or the
\nInspector-General so directs, at any time, be employed on Police duty
\nin any other Part of the State for so long as the services of the
\nsame may be there required.\n<\/p>\n
11.\tA
\nplain reading of this Section would make it clear that  every Police
\nOfficer who is not on leave or under suspension shall  be deemed to
\nbe  on duty for all purposes, and  any Police Officer or any
\nnumber or body of Police Officers allocated for duty in one part of
\nthe State may, if the State Government or the Inspector-General so
\ndirects, at any time, be employed on Police duty in any other part of
\nthe State may, if the State Government or the Inspector-General so
\ndirects, at any time, be employed on Police duty in any other Part of
\nthe State for so long as the services of the same may be there
\nrequired.\n<\/p>\n
12.\tAn
\naffidavit-in-reply filed on behalf of respondent No.2 clearly denies
\nallegations of malafides etc.. It is also denied that the order is
\npunitive in nature.\n<\/p>\n
13.\tIt
\nmay be noted that though malafides  and prejudice are stated as
\ngrounds for the petition, the allegations are too general in nature
\nand are not levelled against any individual person. Further the
\nresolutions do authorise Director General of Police to make
\ninter-district transfers of police personnel. This Court will not go
\ninto the question of sufficiency of reasons for transferring a man in
\npublic interest. That subjective satisfaction is to be arrived at by
\nthe authority concerned. The powers under Section 28 of the Bombay
\nPolice Act also do not envisage any restriction in exercise of those
\npowers and any police officer can be transferred.  Term  Police
\nofficer  under Section 2(11) of the B.P. Act is defined to mean any
\nmember of  the Police Force appointed or deemed to be appointed under
\nthe Act, and would, therefore, include any police personnel including
\na Head Constable, the rank to which the petitioner belongs.\n<\/p>\n
14.\tThis
\nCourt, therefore, would not exercise its extraordinary discretionary
\nwrit jurisdiction to interfere with the order of transfer passed in
\nrespect of the petitioner.\n<\/p>\n
15.\tThe
\npetition, therefore, must fail and stands dismissed. Notice is
\ndischarged.\n<\/p>\n
