Justice S.SIRI JAGAN\n\n Dated :25\/09\/2009\n\n O R D E R\n                                S.SIRI JAGAN, J.\n\n                        ==================\n\n                          W.P(C).No.20776 of 2009\n\n                        ==================\n\n               Dated this the 25th day of September, 2009\n\n                                J U D G M E N T\n<\/pre>\n<p>      The issue raised in this writ petition is covered by the decision of<\/p>\n<p>a Division Bench of this Court in <a href=\"\/doc\/949903\/\">Bro.Joseph Antony v. Kerala State<\/p>\n<p>Electricity Board<\/a> [2009 (3) KLT 1022], the operative portion of which<\/p>\n<p>reads thus:\n<\/p>\n<blockquote><p>                  &#8220;21.   For the various reasons stated as above, we declare<br \/>\n           that inclusion of Self Financing Educational Institutions under LT VII<br \/>\n           (A) as a commercial consumer is bad in law in so far as such<br \/>\n           differentiation is not for any of the grounds specified under Section<br \/>\n           62(3) of the Act. Accordingly, we allow all the writ appeals and the<br \/>\n           writ petitions. They will be treated like falling under Tariff VI until<br \/>\n           any new notification is issued in accordance with law.\n<\/p><\/blockquote>\n<blockquote><p>                  All the Self Financing Educational Institutions were being paid<br \/>\n           at Tariff LT VI during the pendency of the writ petition.      In the<br \/>\n           appeal, we made a slight modification in the interim order and<br \/>\n           directed them to pay off at the current rate.
