PUBLIC PROSECUTOR for\nOpponent(s) : 1, \nNone for Opponent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 01\/02\/2010\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tappellant has preferred this Appeal under Section 378(4) of the Code<br \/>\n\tof Criminal Procedure, 1973 against the judgment and order of<br \/>\n\tacquittal dated 22nd July 2008 passed by the learned<br \/>\n\tJudicial Magistrate First Class, Kalol, in Criminal Case No.1024 of<br \/>\n\t2006, whereby the learned Magistrate has acquitted the<br \/>\n\trespondent-accused of the charges levelled against him.\n<\/p>\n<p>The<br \/>\n\tshort facts of the prosecution case is that respondent-accused<br \/>\n\tfrequently came to the village of complainant for taking milk and<br \/>\n\tthus, there were friendly relation between the complainant and the<br \/>\n\trespondent-accused.  It is also the case of the prosecution that the<br \/>\n\trespondent-accused requested the complainant to give him<br \/>\n\tRs.01,00,000\/- (Rupees One Lac Only) as a loan for purchasing the<br \/>\n\tbuffaloes. Thereupon, the complainant had given Rs.95,000\/- (Rupees<br \/>\n\tNinety Five Thousand Only) in cash to the respondent-accused.  It is<br \/>\n\talso the case of the prosecution that against the said loan of<br \/>\n\tRs.95,000\/- the respondent-accused issued a cheque bearing No.949517<br \/>\n\tdrawn on Kalol Nagrik Sahakari Bank, Kalol. It is also the case of<br \/>\n\tthe prosecution that when on 13th March 2006 the<br \/>\n\tcomplainant deposited the said cheque in his bank, the same was<br \/>\n\treturned dishonoured with endorsement  refer to drawer .  The<br \/>\n\tappellant when informed the respondent-accused about the dishonour<br \/>\n\tof cheque, the respondent-accused asked the complainant to<br \/>\n\tre-deposit the said cheque again in next week.  It is also the case<br \/>\n\tof the prosecution that when again the complainant deposited the<br \/>\n\tsaid cheque in his bank, again the cheque came to be dishonoured on<br \/>\n\tthe ground of  refer to drawer .  Thereafter, the complainant<br \/>\n\tissued a notice dated 31st March 2006 through his<br \/>\n\tadvocate under section 138 of the Negotiable Instruments Act. Though<br \/>\n\tthe notice was served  upon the respondent-accused, he has not<br \/>\n\tbothered to pay the cheque amount to the complainant.  Therefore,<br \/>\n\tthe complainant had filed the complaint under Section 138 of the<br \/>\n\tNegotiable Instruments Act against the respondent-accused before the<br \/>\n\tlearned Judicial Magistrate First Class, Kalol on 05th<br \/>\n\tMay 2006.\n<\/p>\n<p>Thereafter,<br \/>\n\tafter recording statement of the complainant, the learned Magistrate<br \/>\n\tissued summons against the respondent-accused on 05th May<br \/>\n\t2006.  Thereafter, the trial was conducted before the learned<br \/>\n\tMagistrate. To prove the case of the prosecution, prosecution has<br \/>\n\tproduced oral as well as documentary evidence. After considering the<br \/>\n\toral as well as documentary evidence, the learned Magistrate has<br \/>\n\tacquitted the respondent-accused from the charges alleged against<br \/>\n\thim by the judgment and order dated 22nd July 2008.\n<\/p>\n<p>Being<br \/>\n\taggrieved and dissatisfied with the said judgment and order dated<br \/>\n\t22nd July 2008 passed by the learned Magistrate in<br \/>\n\tCriminal Case No. 1024 of 2006, the appellant has preferred the<br \/>\n\tabove mentioned Criminal Appeal.\n<\/p>\n<p>I<br \/>\n\thave heard Mr. Harshad Patel, learned counsel for the appellant. I<br \/>\n\thave also gone through the papers and the judgment and order passed<br \/>\n\tby the Trial Court.\n<\/p>\n<p>Just<br \/>\n\tto prove the case of the prosecution, prosecution has produced oral<br \/>\n\tas well as documentary evidence. Heard Mr. Harshad Patel, learned<br \/>\n\tcounsel for the appellant.  He has taken me through the evidence of<br \/>\n\tprosecution witnesses. He has vehemently argued that the learned<br \/>\n\tJudge has not properly considered the oral as well as documentary<br \/>\n\tevidence produced on record. He has read oral as well as documentary<br \/>\n\tevidence and vehemently argued that the complainant-present<br \/>\n\tappellant has prima-facie case and it is a good case for admission<br \/>\n\tand matter is required to be remanded. He has contended that because<br \/>\n\tof communication gap between the advocate and the complainant, the<br \/>\n\tcomplainant could not remain present before the Court when the<br \/>\n\tmatter was fixed for hearing on 22nd July 2008. He has<br \/>\n\talso contended that except 2 or 3 occasion, complainant remained<br \/>\n\tpresent on each and every adjournments. He, therefore, contended<br \/>\n\tthat the judgment and order passed by the learned Magistrate is<br \/>\n\twithout appreciating the facts and evidence on record. Ms. Mini<br \/>\n\tNair, learned Additional Public Prosecutor, waives service of notice<br \/>\n\ton behalf of the State.\n<\/p>\n<p>I<br \/>\n\thave gone through the judgment of the Trial Court. I have also<br \/>\n\tperused the reasons assigned by the learned Magistrate.\n<\/p>\n<p>At<br \/>\n\tthe outset it is required to be noted that the principles which<br \/>\n\twould govern and regulate the hearing of appeal by this Court<br \/>\n\tagainst an order of acquittal passed by the Trial Court have been<br \/>\n\tvery succinctly explained by the Apex Court in a catena of<br \/>\n\tdecisions. In the case of<br \/>\n\tM.S. Narayana Menon @ Mani Vs. State of Kerala &amp; Anr, reported<br \/>\n\tin (2006)6 SCC, 39,<br \/>\n\tthe Apex Court has narrated about the powers of the High Court in<br \/>\n\tappeal against the order of<br \/>\n\tacquittal. In para 54 of the decision, the Apex Court has observed<br \/>\n\tas under:\n<\/p>\n<p> 54.<br \/>\n\tIn any event, the High Court entertained an appeal treating to be an<br \/>\n\tappeal against acquittal, it was in fact exercising the revisional<br \/>\n\tjurisdiction. Even while exercising an appellate power against a<br \/>\n\tjudgment of acquittal, the High Court should have borne in mind the<br \/>\n\twell-settled principles of law that where two view are possible, the<br \/>\n\tappellate court should not interfere with the finding of acquittal<br \/>\n\trecorded by the court below.\n<\/p>\n<p>Thus,<br \/>\n\tit is a settled principle that while exercising appellate power,<br \/>\n\teven if two reasonable conclusions are possible on the basis of the<br \/>\n\tevidence on record, the appellate court should not disturb the<br \/>\n\tfinding of acquittal recorded by the Trial Court.\n<\/p>\n<p>Even<br \/>\n\tin a recent decision of the Apex Court in the case of State<br \/>\n\tof Goa Vs. Sanjay Thakran &amp; Anr. Reported in (2007)3 SCC 75,<br \/>\n\tthe Court has reiterated the powers of the High Court in such cases.<br \/>\n\tIn para 16 of the said decision the Court has observed as under:\n<\/p>\n<p> 16.<br \/>\n\tFrom the aforesaid decisions, it is<br \/>\n\tapparent \tthat while exercising the powers in appeal against the<br \/>\n\torder of acquittal, the Court of \tappeal would not ordinarily<br \/>\n\tinterfere with the order of acquittal unless the approach of the<br \/>\n\tlower Court is vitiated by some manifest illegality and the<br \/>\n\tconclusion arrived at would not be arrived at by any reasonable<br \/>\n\tperson and, therefore, the decision is to be characterized<br \/>\n\tas perverse. Merely because two views are possible, the Court of<br \/>\n\tappeal would not take the view which would upset the judgment<br \/>\n\tdelivered by the Court below. However, the appellate court has a<br \/>\n\tpower to review the evidence if it is of the view that the<br \/>\n\tconclusion arrived at by the Court below is perverse and the Court<br \/>\n\thas committed a manifest error of law and ignored the material on<br \/>\n\trecord. A duty is cast upon the appellate court, in such<br \/>\n\tcircumstances, to re-appreciate the evidence to arrive to a just<br \/>\n\tdecision on the basis of material placed on record to find out<br \/>\n\twhether any of the accused is connected with the commission of the<br \/>\n\tcrime he is charged with.\n<\/p>\n<p>Similar<br \/>\n\tprinciple has been laid down by the Apex Court in the cases of State<br \/>\n\tof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\n\tSCW 5553 and<br \/>\n\tin Girja<br \/>\n\tPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\n\tThus, the powers which this Court may exercise against an order of<br \/>\n\tacquittal are well settled.\n<\/p>\n<p>It<br \/>\n\tis also a settled legal position that in acquittal appeal, the<br \/>\n\tappellate court is not required to re-write the judgment or to give<br \/>\n\tfresh reasoning, when the reasons assigned by the Court below are<br \/>\n\tfound to be just and proper. Such principle is laid down by the Apex<br \/>\n\tCourt in the case of State<br \/>\n\tof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417.\n<\/p>\n<p>Thus,<br \/>\n\tin case the appellate court agrees with the reasons and the opinion<br \/>\n\tgiven by the lower court, then the discussion of evidence is not<br \/>\n\tnecessary.\n<\/p>\n<p>I<br \/>\n\thave gone through<br \/>\n\tthe judgment and order passed by the Trial Court. I have also<br \/>\n\tperused the oral as well as documentary evidence led before the<br \/>\n\tTrial Court and also considered the submissions made by learned<br \/>\n\tadvocate for the appellant.\n<\/p>\n<p>After<br \/>\n\tappreciating the oral as well as documentary evidence I found that<br \/>\n\tthe learned advocate of the complainant-present appellant and the<br \/>\n\tappellant not appeared on three occasions.  It is observed that the<br \/>\n\tmatter is pending since two years and yet the learned Judge has not<br \/>\n\tdismissed the matter till 22nd July 2008. It is also<br \/>\n\tobserved that the complainant has failed to prove beyond reasonable<br \/>\n\tdoubt that cheque was issued in connection with legal debt.  It is<br \/>\n\tthe duty of the prosecution to prove the main ingredient of Section<br \/>\n\t138 that there was a legal debt. The allegations levelled against<br \/>\n\tthe respondent-accused<br \/>\n\tis of civil in nature.  It is also observed by the learned<br \/>\n\tMagistrate that the prosecution has failed to satisfy the main<br \/>\n\tingredient of Section 138 of the Negotiable Instruments Act. The<br \/>\n\tTrial Court has observed that there are serious lacuna in the oral<br \/>\n\tas well as documentary evidence of prosecution. Nothing is produced<br \/>\n\ton record of this appeal to rebut the concrete findings of the Trial<br \/>\n\tCourt.\n<\/p>\n<p>Thus,<br \/>\n\tthe appellant could not bring home the charges against the<br \/>\n\trespondent-accused in the present appeal. The prosecution has<br \/>\n\tmiserably failed to prove the case against the respondent-accused.<br \/>\n\tThus, from the evidence itself it is established that the<br \/>\n\tprosecution has not proved its case beyond reasonable doubt.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the appellant is not in a position to show any evidence<br \/>\n\tto take a contrary view in the matter or that the approach of the<br \/>\n\tTrial Court is vitiated by some manifest illegality or that the<br \/>\n\tdecision is perverse or that the Trial Court has ignored the<br \/>\n\tmaterial evidence on record.\n<\/p>\n<p>In<br \/>\n\tabove view of the matter, I am of the considered opinion that the<br \/>\n\tTrial Court was completely justified in acquitting the<br \/>\n\trespondent-accused of the charges levelled against him. I find that<br \/>\n\tthe findings recorded by the Trial Court are absolutely just and<br \/>\n\tproper and in recording the said findings, no illegality or<br \/>\n\tinfirmity has been committed by it.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\tcourt below and hence find no reasons to interfere with the same.<br \/>\n\tHence the appeal is hereby dismissed. Record<br \/>\n\tand Proceedings to be sent back to the Trial Court, forthwith.  Bail<br \/>\n\tbonds, if any, shall stands cancelled.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
