SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/01\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>Present<br \/>\n\tFirst Appeal,  under sec.173 of the Motor Vehicles Act,  has been<br \/>\n\tpreferred by the appellant &#8211; original opponent No.2 &#8211;<br \/>\n\tGujarat State Road Transport Corporation challenging the Judgement<br \/>\n\tand Award dtd.31\/7\/1989  passed by the Motor Accident Claims<br \/>\n\tTribunal (Auxi.), Palanpur in Motor Accident Claim Petition No. 74<br \/>\n\tof 1984, by which the learned tribunal has partly allowed the said<br \/>\n\tclaim petition awarding a total sum of Rs.1,45,750 towards<br \/>\n\tcompensation to the claimants and holding the driver of the ST Bus<br \/>\n\tnegligent to the extent of 40% and driver of the Jeep Car negligent<br \/>\n\tto the extent of 60%.\n<\/p>\n<p>That<br \/>\n\tin a vehicular accident  between ST Bus and Jeep Car which took<br \/>\n\tplace on 12\/2\/1984, one Shankarlal Soni died and therefore, the<br \/>\n\toriginal claimants being his heirs preferred Motor Accident Claim<br \/>\n\tPetition No. 74 of 1984 before the Motor Accident Claims Tribunal,<br \/>\n\tat Palanpur claiming compensation of Rs.2,00,000.  That on<br \/>\n\tappreciation of evidence the Motor Accident Claims Tribunal held the<br \/>\n\t driver of the ST Bus negligent to the extent of 40% and driver of<br \/>\n\tthe Jeep Car negligent to the extent of 60% and on appreciation of<br \/>\n\tevidence, considering the income of the deceased at the relevant<br \/>\n\ttime at the rate of Rs.900 per month and deducting 1\/3rd<br \/>\n\tamount for his  personal expenditure, awarded future economic loss<br \/>\n\tconsidering net loss of Rs.600 and applying multiplier of 20, the<br \/>\n\tlearned Motor Accident Claims Tribunal awarded total compensation of<br \/>\n\tRs.1,45,750. Being aggrieved by and dissatisfied with the aforesaid<br \/>\n\tJudgement and Award, the appellant &#8211; original opponent No.3 &#8211;<br \/>\n\tGujarat State Road Transport Corporation  has preferred th present<br \/>\n\tFirst Appeal.\n<\/p>\n<p>Ms.Archana<br \/>\n\tPatel, learned advocate appearing<br \/>\n\ton behalf of the appellant &#8211; GSRTC has submitted that<br \/>\n\tthe appellant is not questioning the impugned Judgement and Award<br \/>\n\tpassed by the learned Tribunal so far as negligence is concerned. It<br \/>\n\tis submitted that, however,   the appellant is challenging the<br \/>\n\timpugned Judgement and Award passed by the learned tribunal so far<br \/>\n\tas quantum  is concerned. It is submitted that in the facts and<br \/>\n\tcircumstances of the case, the learned tribunal has erred in<br \/>\n\tawarding future economic loss applying multiplier of 20. It is<br \/>\n\tsubmitted that even considering the decision of the<br \/>\n\tHon&#8217;ble Supreme Court  in the case of Sarla Verma and others<br \/>\n\tVersus Delhi Transport Corporation  and another, reported in 2009<br \/>\n\tACJ 1298, at the most multiplier of 18 could have been applied by<br \/>\n\tthe learned tribunal. Therefore, it is requested to allow the appeal<br \/>\n\tto the aforesaid extent.\n<\/p>\n<p>Present<br \/>\n\tappeal is opposed by Mr.Anand L. Sharma, learned<br \/>\n\tadvocate appearing on behalf of the surviving claimants as it<br \/>\n\tis reported that except widow &#8211; respondent No.3 herein &#8211;<br \/>\n\tBhagwatiben Shankarlal Soni all other claimants have expired. It is<br \/>\n\tsubmitted that even if it is considered that the learned Tribunal<br \/>\n\tought not to have awarded future economic loss  applying multiplier<br \/>\n\tof 20 in that case also considering the fact that the learned<br \/>\n\ttribunal has not awarded any amount under the heads  of Loss of<br \/>\n\tEstate and Consortium, the  impugned Judgement and Award passed by<br \/>\n\tthe learned tribunal is not required to be interfered with.\n<\/p>\n<p>Heard<br \/>\n\tthe learned advocates appearing on behalf of the respective parties<br \/>\n\tat length.\n<\/p>\n<p>It<br \/>\n\tis true that the learned tribunal has materially erred in awarding<br \/>\n\tfuture economic loss applying  multiplier of 20, however, it is to<br \/>\n\tbe noted that it was a fatal case and therefore, the claimants were<br \/>\n\tentitled to Rs.15,000 under the head of Loss of Estate and and<br \/>\n\tRs.15,000 under the head of Consortium, which have not been awarded<br \/>\n\tby the learned tribunal. It is also required to be noted that the<br \/>\n\timpugned judgement and award has been challenged  only by the<br \/>\n\tappellant herein and the owner and Insurance Company  of the Jeep<br \/>\n\tCar, who is held to be negligent to the extent of 60% have  not<br \/>\n\tpreferred First Appeal  challenging the Judgement and Award in<br \/>\n\tquestion. Considering the aforesaid aspects and overall facts of the<br \/>\n\tcase when, though the claimants are entitled to Rs.30,000 under the<br \/>\n\theads of Loss of Estate and Consortium, the same have not been<br \/>\n\tawarded  by the learned tribunal, the impugned Judgement and Award<br \/>\n\tpassed by the learned tribunal is not interfered with. If the excess<br \/>\n\tamount awarded by the learned tribunal towards future economic loss<br \/>\n\tapplying multiplier  of more than 18 is adjusted against the amount<br \/>\n\tto be paid under the heads  of Loss of Estate and Consortium,  the<br \/>\n\tamount of compensation would come to the same figure and therefore,<br \/>\n\tthis court does not interfere with the impugned Judgement and Award<br \/>\n\tpassed by the learned tribunal.\n<\/p>\n<p>In<br \/>\n\tview of the above and for the reasons stated above, present First<br \/>\n\tAppeal fails and the same deserves to be dismissed and is<br \/>\n\taccordingly dismissed.
