NO. 276 OF 2000\n                = = = = = = = = = = = = = = =\n          Dated this the 19th day of October, 2010.\n\n                      J U D G M E N T\n<\/pre>\n<p>    This  appeal      is      preferred       against  the<\/p>\n<p>judgment and decree passed by the Subordinate<\/p>\n<p>Judge, Thrissur in O.S.1433\/94.               The suit is<\/p>\n<p>one for realisation of the amount due under a<\/p>\n<p>promissory  note.        It     is    the    case  of   the<\/p>\n<p>plaintiff that the first defendant had borrowed<\/p>\n<p>a  sum  of   Rs.45,000\/-        and     had    executed  a<\/p>\n<p>promissory note and in spite of demand the<\/p>\n<p>amount has not been given, hence the suit.             The<\/p>\n<p>sole    defendant        died        and      his    legal<\/p>\n<p>representatives are impleaded as supplemental D2<\/p>\n<p>to  D6.    The     contention        of   the    contesting<\/p>\n<p>defendants are to the effect that the first<\/p>\n<p>defendant has not borrowed any amount.                 The<\/p>\n<p>plaintiff has brought two ladies for the purpose<\/p>\n<p>A.S. 276 OF 2000<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>of accommodation and the first defendant granted<\/p>\n<p>them accommodation.    They wanted an amount of<\/p>\n<p>Rs.5,000\/- and the plaintiff had given to them<\/p>\n<p>at the instance of the defendant and at that<\/p>\n<p>time the plaintiff had taken blank signed papers<\/p>\n<p>and it is making use of the same the suit has<\/p>\n<p>been filed.\n<\/p>\n<p>      2.   In the trial court PW1 and DWs.1 to 3<\/p>\n<p>were examined and Exts.A1 to A4, B1 and X1 to X4<\/p>\n<p>were marked.     On an analysis of the materials<\/p>\n<p>the trial court dismissed the suit.     The trial<\/p>\n<p>court felt that the promissory note is not<\/p>\n<p>properly proved.    The Court also found that the<\/p>\n<p>signature overlaps partly on the revenue stamp.<\/p>\n<p>It is the opinion of the trial court that &#8220;So at<\/p>\n<p>the first blush, it would appear that the person<\/p>\n<p>who signed the instrument has not written the<\/p>\n<p>body of the promissory note.&#8221; When there is a<\/p>\n<p>A.S. 276 OF 2000<br \/>\n<span class=\"hidden_text\">                            -3-<\/span><\/p>\n<p>specific      denial  of   the   execution  of  the<\/p>\n<p>promissory note it was imperative on the part of<\/p>\n<p>the plaintiff to adduce satisfactory evidence<\/p>\n<p>before the trial court.        The Court also found<\/p>\n<p>that the two ladies namely Omana and Nalini who<\/p>\n<p>were alleged to be the persons had not been<\/p>\n<p>examined at all. The Court further held that it<\/p>\n<p>is   the    case   of  the  plaintiff  that  he had<\/p>\n<p>withdrawn      the  amount from   the  savings  bank<\/p>\n<p>account and from the Bank it can be seen that<\/p>\n<p>the plaintiff had savings bank account No.1258<\/p>\n<p>with South Indian Bank, Viyyur Branch. The pass<\/p>\n<p>book    shows    that  he had   only  a  balance of<\/p>\n<p>Rs.163\/- on 10.3.93 and on 1.7.93 also the same<\/p>\n<p>amount.      But it was argued that the plaintiff<\/p>\n<p>had taken a loan from the Bank on 18.6.93 and<\/p>\n<p>therefore the source is proved.      The trial court<\/p>\n<p>has    held     that he   had  borrowed  a  sum  of<\/p>\n<p>A.S. 276 OF 2000<br \/>\n<span class=\"hidden_text\">                          -4-<\/span><\/p>\n<p>Rs.50,000\/-     for  a specific  purpose  with  a<\/p>\n<p>stipulation to pay interest at the rate of 18.5%<\/p>\n<p>to the Bank. Under ordinary circumstances a<\/p>\n<p>person who had borrowed an amount at the rate of<\/p>\n<p>18.5.% interest is not expected to disburse that<\/p>\n<p>amount to another person at the rate of 10%. It<\/p>\n<p>cannot be so especially when the plaintiff is a<\/p>\n<p>money lender.     The Court below also looked into<\/p>\n<p>the account of the Viyyur Service Co-operative<\/p>\n<p>Bank ltd where also the balance amount on his<\/p>\n<p>account was Rs.3,795\/-. So the S.B.Account, the<\/p>\n<p>loan     account  and  the   co-operative  society<\/p>\n<p>account all would reveal that the plaintiff did<\/p>\n<p>not    have    a bank balance  of  Rs.45,000\/- to<\/p>\n<p>advance the amount.      It becomes important for<\/p>\n<p>the reason that it is the specific case of the<\/p>\n<p>plaintiff that he had withdrawn the amount from<\/p>\n<p>the Bank and advanced it as loan.       So in the<\/p>\n<p>A.S. 276 OF 2000<br \/>\n<span class=\"hidden_text\">                        -5-<\/span><\/p>\n<p>absence of any evidence to prove the execution<\/p>\n<p>of Ext.A1 and the surrounding circumstances such<\/p>\n<p>as absence of amount in the S.B. account etc.<\/p>\n<p>would lead to only one conclusion that the<\/p>\n<p>plaintiff has not succeeded in proving that the<\/p>\n<p>first defendant had executed a promissory note<\/p>\n<p>and borrowed a sum of Rs.45,000\/-. I do not find<\/p>\n<p>any ground to entertain this appeal.   Therefore<\/p>\n<p>the appeal is dismissed but without costs.<\/p>\n<p>                        M.N.
