Sikri,J.<\/p>\n<p> 1. This writ petition is filed in public interest<br \/>\n           by  the petitioner which is a society registered  under<br \/>\n           the  Society  Registration Act.  The petitioner  is  an<br \/>\n           association  of the residents of GH-13, Paschim  Vihar,<br \/>\n           New  Delhi.  Adjacent to this colony is Jwalapuri which<br \/>\n           houses  PVC  market.  The divide  between  petitioner&#8217;s<br \/>\n           colony  and Jwalapuri is a road of 40 ft.  width.   The<br \/>\n           grievance of the petitioner is that in contravention of<br \/>\n           Master  Plan  of  Delhi  and Zonal  Plan  of  the  area<br \/>\n           residential  line  in  Jwalapuri is being  misused  for<br \/>\n           commercial   purposes  and   illegal  and  unauthorised<br \/>\n           structures  have  come  up.   The  occupants  of  these  structures  who  are  doing commercial  activities  and  dealing with PVC for manufacturing and trading purposes<br \/>\n           are  expanding their activities in the area although it<br \/>\n           is  hazardous  activities.   It is also stated  in  the<br \/>\n           petition  that  from May, 1990 till the filing  of  the<br \/>\n           writ petition in 1996, six major incidents of fire have<br \/>\n           occurred  which  have not only affected the  people  in<br \/>\n           Jwalapuri  but the residents of the petitioner&#8217;s colony<br \/>\n           also.   The  activity by PVC market  generates  noxious<br \/>\n           fumes  and  unbearable  heat which is fanned  into  the<br \/>\n           colony  by  strong  surface winds and this  is  causing<br \/>\n           health and other hazards.  There has been a large scale<br \/>\n           of  abandonment  of the houses by the residents of  the<br \/>\n           petitioner&#8217;s   colony  due  to   proximity  of  PVC  in<br \/>\n           Jwalapuri.\n<\/p>\n<p> 2.                    It  is  further pleaded in the  writ  petition<br \/>\n           that  a Committee was appointed by the Govt.  of NCT of<br \/>\n           Delhi  to  examine  the  feasibility  of  shifting  the<br \/>\n           Jwalapuri  PVC market which submitted its report on 9th<br \/>\n           June, 1995.  It is also stated that the respondent No.1<br \/>\n           by  order  and  public notice dated  4th  August,  1995<br \/>\n           banned  forthwith plastic waste and PVC material  trade<br \/>\n           including stocking and collecting of such products from<br \/>\n           Jwalapuri and other adjoining localities.\n<\/p>\n<p>3.                     Feeling aggrieved by this order, writ petition<br \/>\n           No.2902\/95  was filed which was dismissed by this court<br \/>\n           vide  judgment and order dated 12th April, 1996 and the<br \/>\n           relevant  extracts  of  the said order  are  reproduced<br \/>\n           below:\n<\/p>\n<p>     &#8220;It was a condition of the allotment made<br \/>\n                      to  the traders that the plots would have<br \/>\n                      single  storey construction with only 40%<br \/>\n                      covered  area  but the traders  not  only<br \/>\n                      raised  100% construction but also 3 or 4<br \/>\n                      stories  without  leaving any open  space<br \/>\n                      and without obtaining any sanction.  They<br \/>\n                      also  occupied unauthorizedly the  common<br \/>\n                      areas,  public  lands, streets and  roads<br \/>\n                      and  all  possible available open  space.<br \/>\n                      The  dealers  increased manifold  and  as<br \/>\n                      against  479  allottees there were  about<br \/>\n                      2000, functioning in the market.\n<\/p>\n<p>                      As per the Master Plan 1962 (extract copy<br \/>\n                      filed)  the land where Jawalapuri  market<br \/>\n                      was  situated  is marked for  residential<br \/>\n                      houses.\n<\/p>\n<p>  The  fact remains that the land on  which<br \/>\n                      these  traders were settled was set apart<br \/>\n                      for  residential  use in the Master  Plan<br \/>\n                      and  it  could not have been diverted  to<br \/>\n                      any  use  other than  residential  except<br \/>\n                      after changing the land use in accordance<br \/>\n                      with Section 11A of the Delhi Development<br \/>\n                      Act,  1957.  Continuance in Jwalapuri  of<br \/>\n                      such traders along with their trading and<br \/>\n                      manufacturing activities would be only in<br \/>\n                      defiance  of  the  provisions  of  Master<br \/>\n                      Plan.&#8221;\n<\/p>\n<p>4.  It  is also stated that the petitioner in  the<br \/>\n           meantime  filed  another   Public  Interest  Litigation<br \/>\n           bearing  CWP No.513\/96 which was allowed vide  judgment<br \/>\n           and   order  dated  22nd   March,  1996  directing  the<br \/>\n           authorities to enforce the ban ordered by  notification<br \/>\n           dated 3rd August, 1995.  Pursuant to this judgment, the<br \/>\n           trade  has  now come to an end and certain  open  areas<br \/>\n           which  were  unauthorizedly encroached upon have  since<br \/>\n           been  cleared.   However,  the DDA has now  decided  to<br \/>\n           allot  plots  for  purpose of trade  although  area  in<br \/>\n           question  is  earmarked for residential purposes.   The<br \/>\n           petitioner in the present writ petition is aggrieved by<br \/>\n           this  decision  of the DDA and has filed  this  petition<br \/>\n           with the following prayer:\n<\/p>\n<p>  1.   Quash   the    order\/decision    of   the<br \/>\n                         respondent  No.2  DDA  whereby  the  land<br \/>\n                         located    in    Jwalapuri    meant   for<br \/>\n                         residential  use was diverted for setting<br \/>\n                         up of PVC market;\n<\/p>\n<p>  2.   direct  the  respondents  No.1 and  2  to<br \/>\n                         identify  and  remove   all  unauthorised<br \/>\n                         constructions made in the P.V.C.  Market,<br \/>\n                         Jwalapuri;\n<\/p>\n<p>   3.   to  demolish  and  remove  all  allegedly<br \/>\n                         authorised constructions made on the land<br \/>\n                         earmarked  for  residential  purpose  and<br \/>\n                         develop  the same in conformity with  the<br \/>\n                         Master Plan of Delhi-2001.&#8221;\n<\/p>\n<p>5.    Notice  to  show  cause in this  petition  was<br \/>\n           issued  to  the respondents who were  served.   Interim<br \/>\n           orders   were  passed  from   time  to  time  directing<br \/>\n           demolition    of    unauthorised    constructions   and<br \/>\n           structures.   Action  was  taken on  these  orders  and<br \/>\n           action taken reports filed by the respondents.\n<\/p>\n<p>6.                     When  the  matter came up for hearing on  15th<br \/>\n           January,   2002   Mr.Raj   Panjwani,  learned   counsel<br \/>\n           appearing  for the petitioner fairly admitted that  all<br \/>\n           the  encroachments  in the area in question  have  been<br \/>\n           removed.   He, however, made a statement to the  effect<br \/>\n           that  the  land  which was now lying vacant  should  be<br \/>\n           available  for community needs of the residents of  the<br \/>\n           area.   He,  however, admitted that the petitioner  has<br \/>\n           already  made  a representation to this effect to  DDA.<br \/>\n           Since the matter involves a policy decision to be taken<br \/>\n           by  the respondent\/DDA, it would not be proper for this<br \/>\n           court  to issue any positive direction to this  effect,<br \/>\n           particularly  when there is no such prayer in the  writ<br \/>\n           petition  also.  It would suffice if the directions are<br \/>\n           issued to the DDA to consider the representation of the<br \/>\n           petitioner  on  its  own  merits and  take  a  suitable<br \/>\n           decision  thereon expeditiously and in any case, within<br \/>\n           four  months  from the date of receipt of copy of  this<br \/>\n           order by DDA.\n<\/p>\n<p> 7. Since the purpose of filing this writ petition<br \/>\n           has  otherwise  been  served,  no  further  orders  are<br \/>\n           required  to  be  passed in this  writ  petition.
