Justice P.N.RAVINDRAN\n\n Dated :01\/12\/2008\n\n O R D E R\n                      P.N.RAVINDRAN, J.\n\n                   -------------------------------\n\n              W.P.(C) Nos.31534 &amp; 31568 of 2008\n\n                   -------------------------------\n\n               Dated this the 1st December, 2008.\n\n                         J U D G M E N T\n<\/pre>\n<p>             The petitioner in W.P.(C) No.31534 of 2008 retired<\/p>\n<p>from service on 31.5.2007, while she was working as Sweeper in<\/p>\n<p>the Chengannur Municipality. The petitioner in W.P.(C) No.31568<\/p>\n<p>of 2008 retired from service on 30.9.2007 while working as<\/p>\n<p>Sanitation Worker in the Chengannur Municipality.       By Ext.P1<\/p>\n<p>order passed on 12.9.2007, the Secretary of the Chengannur<\/p>\n<p>Municipality sanctioned the terminal benefits payable to them.<\/p>\n<p>The petitioners submit that though       more than one year has<\/p>\n<p>passed thereafter, the terminal benefits has not so far been<\/p>\n<p>disbursed.\n<\/p>\n<\/p>\n<p>             2.      Sri.S.Harikrishnan,     the  learned counsel<\/p>\n<p>appearing for the Chengannur Municipality submits that payment<\/p>\n<p>of the terminal benefits sanctioned as per Ext.P1 will be made<\/p>\n<p>within four months from today.        Sri.Iype Joseph, the learned<\/p>\n<p>W.P.(C) No.31534 &amp; 31568 of 2008<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>counsel appearing for the petitioners submits that as the<\/p>\n<p>pensionary benefits have been sanctioned more than one year<\/p>\n<p>back, the Municipality cannot withhold payment even for a day.<\/p>\n<p>Ext.P1 discloses that way back on 12.9.2007, the terminal<\/p>\n<p>benefits were sanctioned to them. No reasons, other than want<\/p>\n<p>of sufficient funds, was brought to my notice for non payment of<\/p>\n<p>pensionary benefits. In my opinion, the Municipality cannot plead<\/p>\n<p>want of funds at its disposal to deny the petitioners the terminal<\/p>\n<p>benefits sanctioned to them.\n<\/p>\n<\/p>\n<p>                In these       circumstances, I dispose of the Writ<\/p>\n<p>Petitions directing the Secretary, Chengannur Municipality, to<\/p>\n<p>disburse to the petitioners the terminal benefits sanctioned to<\/p>\n<p>them on or before 31.1.2009.
