SIRI JAGAN, J.\n                ------------------------------------\n                  W.P.(C)No.37304 OF 2003\n              ----------------------------------------\n             Dated this the 17th day of October, 2008\n\n                           JUDGMENT\n<\/pre>\n<p>      The petitioners are espousing the cause of a class of<\/p>\n<p>persons, who were originally included as other backward classes<\/p>\n<p>eligible for reservation in appointments and were later got<\/p>\n<p>themselves converted to Christianity. As per Ext.P1 order of the<\/p>\n<p>erstwhile Government of Travancore &#8211; Cochin, the list of<\/p>\n<p>backward classes included other Christians, which term was<\/p>\n<p>defined to include Pulayas, Parayas and other Scheduled Cast or<\/p>\n<p>Backward    Community     members     converted    to  Christianity.<\/p>\n<p>Subsequently, after the State of Kerala was formed, Ext.P2 order<\/p>\n<p>was issued,    whereby the Government re-defined the term<\/p>\n<p>&#8216;Backward Christians (other Christians)&#8217; to include only converts<\/p>\n<p>from Scheduled Castes and Scheduled Tribes and not converts<\/p>\n<p>from Backward Classes. The petitioners are now aggrieved by<\/p>\n<p>this.\n<\/p>\n<p>      2.   According to the petitioners, change of religion will not<\/p>\n<p>take away the status of a person as a member of a Backward<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.37304\/03                2<\/span><\/p>\n<p>Class in so far as the very same social disabilities attached to a<\/p>\n<p>person as a member of a backward class would continue to be<\/p>\n<p>attached to the converted backward class member even after<\/p>\n<p>change of religion. The petitioners submit that by Ext.P4, the<\/p>\n<p>Government held that the members of such communities have<\/p>\n<p>been agriculturists for three generations and none of them was<\/p>\n<p>engaged in toddy tapping and therefore, they are not eligible<\/p>\n<p>for being classified as backward classes. This, according to the<\/p>\n<p>petitioners, is a total erroneous view. The petitioners point out<\/p>\n<p>that if that be so, the majority of the Ezhavas in Kerala would<\/p>\n<p>not be eligible for reservation because they are no longer<\/p>\n<p>toddy tappers. The question as to whether the backward class<\/p>\n<p>member converted to Christianity would still be visited with the<\/p>\n<p>disabilities of a backward class member depends on the facts<\/p>\n<p>and circumstances, which can be ascertained only after an<\/p>\n<p>anthropological study, which is beyond the scope of a writ<\/p>\n<p>petition. Normally, such a process should be undertaken by<\/p>\n<p>the Kerala State Commission for Backward Classes appointed<\/p>\n<p>under the Kerala State Commission for Backward Classes Act,<\/p>\n<p>1993.       Representations   are   also  pending     before  the<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.37304\/03                 3<\/span><\/p>\n<p>Commission in this regard. But the learned counsel for the<\/p>\n<p>petitioners expresses a doubt as to whether the Commission<\/p>\n<p>have powers to decide this question. Section 9 of the said Act<\/p>\n<p>defines functions of the Commission.\n<\/p>\n<blockquote><p>            &#8220;9. Functions of the commission.-\n<\/p><\/blockquote>\n<blockquote><p>                  (1)   The    Commission    shall    examine<br \/>\n      requests for inclusion of any class of citizens as a<br \/>\n      backward class in the lists and hear complaints of over-<br \/>\n      inclusion or under-inclusion of any backward class in<br \/>\n      such lists and tender such advice to the Government as<br \/>\n      it deems appropriate.\n<\/p><\/blockquote>\n<blockquote><p>                  (2)   The advice of the Commission shall<br \/>\n      ordinarily be binding upon the Government&#8221;.\n<\/p><\/blockquote>\n<p>Going by the said definition, the Commission is vested with the<\/p>\n<p>function of examining requests for inclusion of any class of<\/p>\n<p>citizen as a backward class.         Here, the &#8216;Other Christians&#8217;<\/p>\n<p>converted to Christianity from backward community was<\/p>\n<p>originally included as a backward class.         Later, they were<\/p>\n<p>excluded. Now what the petitioners seek is inclusion of &#8216;Other<\/p>\n<p>Christians&#8217; converted from backward communities to be<\/p>\n<p>included in the list of other backward classes for the purpose of<\/p>\n<p>Article 16(4).    Therefore, I am satisfied that the said task<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.37304\/03                  4<\/span><\/p>\n<p>squarely comes within the function of the Commission as<\/p>\n<p>defined in Section 9 of the Act. I am also satisfied that the<\/p>\n<p>Commission is the most appropriate expert body to deal with<\/p>\n<p>this question.\n<\/p>\n<p>      3.    The learned Counsel for the petitioner would also<\/p>\n<p>seek a direction that Exts.P2 and P4 be modified for this<\/p>\n<p>purpose.     I am of opinion that, that question also can be<\/p>\n<p>considered by the Commission depending upon whether the<\/p>\n<p>Christians converts from backward classes still continues to be<\/p>\n<p>visited with the sufficient disabilities as a backward class.<\/p>\n<p>      Accordingly, I direct the 2nd respondent &#8211; Commission to<\/p>\n<p>deal with the question and take a final decision in the matter<\/p>\n<p>as provided in the Act, after complying with the procedure<\/p>\n<p>prescribed including issue of notice to all affected parties, as<\/p>\n<p>expeditiously as possible, at any rate, within a period of six<\/p>\n<p>months form the date of receipt of a copy of this judgment. I<\/p>\n<p>also direct the Commission to recommend to the Government<\/p>\n<p>as to whether Exts.P2 and P4 should be modified appropriately<\/p>\n<p>to include the &#8216;Other Christians&#8217; converted from backward<\/p>\n<p>classes also as &#8216;Other Christians&#8217;, so that the Government can<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.37304\/03                5<\/span><\/p>\n<p>take a decision as to whether Exts.P2 and P4 should be<\/p>\n<p>suitably modified if the recommendation of the commission is<\/p>\n<p>in in favour of such a course of action.\n<\/p>\n<p>      The writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                       S.
